The land grant index at the above repository of land grant records in Texas contains several BOYET/TT entries. Individuals may request research on land grants for each name, but a $2.00 search fee per given name is required. Write first and request the proper form to use in ordering the records. After you have returned the completed form and check for the appropriate amount, the staff will examine each file for that name and send you forms on the documents in each file with the information shown on each document with the photocopy fee for each. It is a time_consuming process, but well worth the wait.
To save further time, I have abstracted the BOYET/BOYETT names from the index. These follow:

ELIJAH WALKUP BOYETT
From Luteen Carroll, Gainesville, TX:
Elijah Walkup BOYETT, son of Eli and Sarah (JERNIGAN) BOYETT, was b. 29 Dec 1838 in Gibson Co., TN. (see Newsletter Vol VI, No. 1 and From Boyt to Boyette, p. 49 & 71). He m. Susan Alabama MITCHELL 25 Dec 1859 Gibson Co., TN. Susan was b. July 1841 probably in Gibson Co., TN, daughter of William N. and Margaret, both natives of Tennessee. Elijah states that he enlisted in the Confederate Army 25 Dec 1861, in Gibson Co. ,TN, but the records show that the date was actually 3 Dec 1861. He was in Co. H, 47th Tenn. Infantry__a unit which was organized in and consisted mostly of men from Gibson County and surrounding areas. He served from "Dec 1861 to the close of the War.. .1 was paroled in April 1865." Official records show that he was listed as "present" on the company roll for Jan and Feb 1864 which is the last roll on file. During the War Between the States, Elijah lost his right eye and part of his nose. In his pension application he notes his disabilities as "loss of right Eye, Right Inguinal Hernia, and Senility." This is verified by Edward J. Hamilton, county physician.
His application includes a statement that "I have been a bona fide citizen of the State of Texas Ever since 1870" and other records agree. He and family were in Stephens County when the 1880 U.S. Census was enumerated:
Elijah W. BOYETT 41 yrs. b. TN |
In 1900 Elijah (b. Dec 1838 TN) and Susan (b. July 1841 TX), and their youngest child, Charles (b. Sept 1882, TX) were living in Aransas Co., TX. In Elijah's pension application he states that he has "a claim on a House and 2 Lots and 4 3/4 achors (sic) of Land in Aransas and Sanpatricio Countys, but I Cant get aney thing for it one Hundred Dollars wod be a big Price for the Property. No Personal property." He answers to a question concerning his wife's property, "I have no wife." Susan d.1901 near Corpus Christi, TX.
In Elijah's application for pension from Texas is an undated deposition made by Elijah's first cousin, James E. BOYETT. James states, "I am 69 yrs old I reside at Chico, (Wise Co.] Texas.. .I personally knew E.W. BOYETT...have know E.W. BOYETT 60 yrs. Knew

(continued from page nine)
him first in Gibson Co., Tenn about 1846." This states that they both joined at Trenton, TN (county seat of Gibson Co.) in the same company "and served to the close of the war... I served with him all through the war."
A second deposition to Elijah's war service was made by J. G. REED, a farmer whose address was R.F.D. No. 1, Alvord, Wise Co., TX (about ten miles from Chico). He states that he "knew E. W. BOYETT from about 1855 until about 1875...first knew him in Gibson Co., Tenn." J.G. REED was living with Elijah's deceased Uncle Elijah BOYETT's family when the 1870 U.S. Census was taken. J.G. states that he was with Elijah when they enlisted and served in the same company. He adds, "He (Elijah) had an eye shot out and his arm broken at Atlanta Ga in 1863. I do not think he is able to earn a living...."
The application also states that Elijah lived in and owned property in Aransas and San Patrico counties, TX. Elijah applied for his pension in Houston, Harris Co., TX where he was living 15 Aug 1906. His address was 915 Taylor St. at that time, and he states that he has lived in Houston for eight months.
Elijah was a farmer, but in his application he states that he is "unable to do much work" because of his physical condition which he states is caused by "over work, strain and old age."
He died in Hopkins Co., TX and is buried in the Shirley Cemetery in Hopkins Co., TX. His son_in_law, J. C. FRONEBERGER applied for reimbursement for Elijah's burial costs. Elijah d. 24 June 1918 near Sulphur Springs, Hopkins Co., TX. His oldest daughter, Sarah E., had married Joshua FRONEBERGER; [they were residents of Hopkins Co., TX.) Sarah was born 1862 [in Gibson Co., TN and d. 1937 probably in Hopkins Co., TX;) Joshua b. 1852, d. 1924. In his application for reimbursement for Elijah's burial costs, Joshua gives his own address on 12 July 1918 as RFD #6. Sulphur Springs, TX.

Administration on the estate of said Moses BOYT has been granted to your Oratrix Polly BOYT.
Your Orators further shew unto your Honor that Molly JONES widow of said James JONES disclaims all benefit under the said will, insists on and prefers the dower and distributive share given to widows who dipart (sic) from their husbands will__Your Orators further shew unto your Honor that they are in danger of loosing the benefit of the devises and bequests to them, by reason that the said will has been lost or destroyed before being proved: And that the persons herein named as heirs at law and next of kin of the deceased James JONES claim to take by descent and by distribution the real and personal estate of the deceased as though he had died intestate: And your Orators are unable either to prove the due execution of said will, to make out a copy of its contents, or to establish its loss, without the aid of a discovery from the said heirs at law and next of kin, and are without the means of any competent and effectual remedy for the assertion of their rights, except through the interposition of this Honorable Court.
The said Arthur JONES, Willis GARNER and Betsy his wife and Thomas WISE, Mary HEDGEPETH, Borden TOLAR, Enos TOLER, Benjamin STRICKLAND & Betsey his wife, reside in Wayne county.
