To the Surveyor-General, Greeting,

You are forthwith to admeasure and lay out, or cause to be
admeasured and laid out, unto Thomas BOYT, a Plantation, containing
Two Hundred Acres of Land, in the County of Dobbs on the Marsh
Branch Joining his own & John Mitchel's lines

Observing his Majesty's Instructions for running out Lands; Two just and fair Plans whereof, with a proper Certificate annexed to each, you are to return into the Secretary's Office, within Twelve Months from the Date hereof: And if the Warrantee shall not within Eighteen Months from the Date hereof, take out a Patent for the said Land, this Warrant, and all Proceedings thereon, shall be void and of no Force; and the said Land shall be deemed vacant and free to be taken up by any other Person.

The first record transcribed above is the Grant awarded to Thomas BOYT of Dobbs County, North Carolina.  According to law a survey was required, and this was completed and recorded on 29 Nov 1763 as is transcribed immediately above.  Although neither the 48 acre grant dated 25 December 1762 nor the 200 acre grant which is dated 20 April 1763 identify Thomas BOYT as junior or senior, the survey record clearly shows that this 48 acre
grantee was Thomas BOYT, Jr.

Apparently Thomas BOYT had previously purchased or been granted land adjacent to the 48 acre grant, because the record states that part of the 48 acre parcel is bounded by “his own line” which refers to a previously established boundary.  Thomas BOYT Jr.'s neighbors were John MITCHELL and John SASSER.  Thomas BOYT's 200 acre plantation was shown to be adjacent only to lands belonging to John MITCHELL.  Both the 48 acre and 200 acre properties were situated on the Marsh Branch in Dobbs County.

Dobbs County was organized in 1758 from Johnston County.  It was discontinued in 1791. A portion of Dobbs County was used to create a part of Wayne County in 1779; what remained of Dobbs County became Lenoir County in 1791.

The following wills, recorded in Wayne County, North Carolina, are probably for Thomas BOYT Sr. and Jr. of Dobbs County, although there are at least two other Thomas BOYET/BOYTEs that appear in the records of Wayne County for this same period.  One is the son of Thomas BOYTE, Jr. as named in his father's will dated 15 February 1816, and the fourth Thomas BOYTE served as a witness to the same will.

Thomas BOYET (Sr.) left a will which was probated in Wayne County, North Carolina during the January term of court in 1787.  It reads as follows:

In the name of God Amen. I Thomas BOYET of the province of North Carolina and County of Wayne. Planter, being of perfect mind and memory, make this my last will and Testament, first, I desire to be buried in a decent manner at the descressition (sic) of my executor, my Temporal Estate first I give and bequeath to my beloved son Shadrack BOYET a piece or land, Begining (sic) at a white oak and down the Branch to the Puckkosen to the line and to the Begining (sic)  I give & bequeath to my beloved son Amos BOYTE (sic) A piece of land which was Called Mitchel's Land the Land which is on the East side of the said Branch in that Tract to him I give and bequeath to my son and I give and bequeath to my beloved Wife Her life Time my estate to maintain her on, and after her decease, my Hole (sic) and sole estate to my beloved son Thomas BOYET, I constitute and appoint my beloved son Thomas BOYET and Amoss BOYT my hole (sic) and sole executors, and annull all former wills & Legacies by (86 written between these two lines] by (sic)

The Inventory of the Estate of Thomas BOYET is recorded on page 103 and is No. 29.  It is dated April Court 1787.  The first sentence of this record states, ".. .the Estate of Thomas BOYET Dec'd 11 Nov 1786...”  which is probably his death date.  The inventory lists both household and farming items and stock.

Thomas BOYTE (Jr.) also of Wayne County, North Carolina, made his will on 15 February 1816.  It was recorded in Wayne County as follows:

In the Name of god Amen
I Thomas BOYTE of the County of wayn (sic) and State of North Carolina being Weak of Body But of Sound and parfect (sic) mind and memory bless Be god Do this 15th day of Fabruary (sic) one thousand Eight. (sic) hundred and Sixteen do make and order this My Last will and Testament in mannar (sic) and form As followes (sic) to wit I ?mipermise? my will and Desire is that all my jest (sic) Dets (sic) be paid by Executors Heareafter (sic) named Second my will is my (“beloved” written above line] son Henry BOYTE the land and other things that I have given him to be his part. (sic) and my beloved Son Elisha BOYTE the Land and other Things that I have given him to be his part also I give to my beloving (sic) Son Howell BOYTE all the Land that on the North Side of the rode (sic) that goes to Waynsboroug (sic) of a pallin [patent?) of Sixty Acers [blank space) Also my Lot in waynesborough [”e” written above the line] As Also I give to my beloved Son Thomas BOYTE the young gray mare bridel (sic) and Sadel (sic) and one Bed and furnituer (sic) when he marries or gits free Also I give to my beloved Son William BOYTE my Strase Coalte (sic) bridel and Sadel one bed and Furnatuer (sic) Also one Negrow (sic) gal by the name of Delce [or Delie] not to be taken from his (sic) Mother dureing (sic) her naturl (sic) Life without hir (sic) Consent Also I give to my beloved son Patrick BOYTE All the ["rest of my" written above the line] Land that I have not given away aftar the deth (sic) of my beloved wife Also one negrow (sic) Woman by the name of Chreara and one negrow Boy by the name of tom [not to taken from his mother during his naturl life” written above the lines) also I give to my beloved

Apparently the settlement of Thomas BOYTE's estate took several years.  During the November 1827 of court for Wayne County, a record is included pertaining to the valuation of the estate's
negroes as follows:

Agreeable to an order directed to us from the County Court of Wayne to Value the negroes belonging to the estate of Thomas BOYTE dec'd Report as follows, negro Girl Rose & Child Valued at Four Hundred

and fifty Dollars. Girl Julian Valued at Four Hundred dollars, Edy Valued at Two Hundred dollars Boy Elbert Valued at One Hundred and Eighty five dollars, Boy Tom Valued at one Hundred and Eighty five dollars. amounting in all to fourteen Hundred & Twenty dollars all which is Respectfully Submitted by your Committee August 29 1826

This appears to be the final settlement of the estate of Thomas BOYET, (Jr.).  Because of the stipulation in his will that the negroes Rose and Julian were to go to his wife and were not to be sold until after the death of his wife, Elizabeth, it can be assumed that Elizabeth died prior to 20 November 1826 when the negroes were sold.

Of primary importance is that this record along with Thomas Jr.'s will, provided all necessary clues to the husbands' names of Thomas Jr.'s daughters.  Ann BOYTE married Henry SASSER.  Nancy BOYTE married John HOWELL.  Polly BOYTE married John BOYTE; Rebecca "Bekke" BOYTE married John ThOMPSON.

This final accounting also provides the information that Equilla's
husband Elijah LANGSTON was deceased in November 1827, and Uriah
LANGSTON had been appointed guardian of Elijah and Equilla's son,
William LANGSTON prior to the settlement of Thomas Jr.'s estate in
November 1827.

Amos BOYTE's will:
In the name of God Amen I Amos BOYTE of the County of Wayne and State of North Carolina being sick and weeke (sic) of body but of Sound Mind and Memory do this 2nd day of April 1826 make and publish this my last Will and testament in maner (sic) following first I lend to my wife Elizabeth BOYTE during her life time or Widowhood One fether (sic) bed and furnature one Sow and Six pigs one Cow Cauld (sic) the Langston Heiffer and her calf five barrels Corn one Hundred weight of flax from the brake and the Cotton patch at the Houses the field ajoining it on the rode (sic) the apple orchard and the field on the left hand of the rode going to the mill nere (sic) the long branch one wheel and card and one pot to be her choice and all the bacon that I (sic) one wash tub one Warter (sic) pale (sic) one bred (sic) tray and the dwelling House I Give to my Sun (sic) Dempsey BOYTE a peace (sic) of land ajoining the land of Uriah LANGSTON beginning at my corner up the branch and run down the branch untill (sic) ?run? east Come Will hit the black haw tree in the field and then [blank space] East to the back line then with Uriah LANGSTONs line run to the beginning the sad (sic) Dempsey to pay Uriah LANGSTON the are (sic) of Charty (sic) JONES tene (sic) Dollars Out of the land to Stephen BOYTE my Sun (sic) I Give appease (sic) of land begining (sic) where Dempsey hits the back line and with the line to a white Oake (sic) on the rode (sic) run the long branch then with the road to the bars that goes in to the apple orchart (sic) then to a White cake tree in the field neare the plum Orchart (sic) and Strate (sic) on to the line in the branch the Said Stephen to Give out his parte (sic) this land ten dollars to the ares (sic) of my Sun Moses BOYTE all the rest of my land to be equally divided betwin (sic) my Suns (sic) Micajah and Amos BOYTE by their paying ten dollars each to the airs (sic) of Moses BOYTE I give to my Sun John BOYTE my negro man Cadis and one horse Cicielo.
