Marriage, Cohabitation, Divorce, Bastardy Records
of Wayne Co., North Carolina
by Charlotte Carrere (Wayne County Carolina Abstractors)
There are only twenty-two marriage bonds that have survived for Wayne County for the period
1790-1832. There are none for any BOYT/E-BOYET/T/E, but Henry BOYTE (along with
Zachariah HAM) served as bondsmen for the marriage of Jesse HARPER and an unnamed bride
who signed the bond on 17 May 1814.
The author of this compilation searched through the first twenty eight deed books of Wayne County in "order to prove marriages by deed records." The reference is to deed book and page numbers.

Elijah BOYT/BOYETT b. est 1798 in NC; parents unknown. He lived in Dickson Co., TN. He served from TN during the first Seminole Indian War between 31 Jan and 30 June 1818. He was in Bell's Company of TN Volunteers. Elijah was probably living in Stewart Co., TN in 1818 for he enlisted from there. According to his military pension application, he married on 20 Aug 1818 (at the same time he supposedly was serving in the military during the Seminole War). This date may be inaccurate as their first known child was ot born until 1825. Another fact that indicates that 1818 is in error for their marriage year is that his wife Martha PERVES would have been only thirteen years old at that time. Martha was b. 1805 and d. after 1866 in Obion Co., TN. About 1828 the family may have moved inot southern Illinois, for a son William was supposedly born there in 1830. Elijah and family moved to the countyline area between Gibson and Obion counties, TN around 1840. Elijah d. in Mason Hall, Obion, TN on 8 Nov 1843. Martha d. sometime after 1866, possibly in Arkansas. Their children: Cullen John, William, Barney Smith, Elijah L., Anne, Elizabeth, Eliza, and Susanna. [BNII:3:l1-12)

After Ephraim's death Gibson SLOAN was appointed guardian of his children. Ephraim sold lands in Duplin Co., NC on 12 Jan 1778, but the transaction was recorded in Sampson Co., NC which could possibly indicate that he resided in Sampson County at that time. adjacent to James PATE's line. He was listed on the 1779 Tax List for Dobbs Co. They lived in Wayne Co., NC in 1790 and owned land which was adjacent to land owned by William SASSER (on which David DAVIS lived), John PAGE, John WIGGS, and William JERNIGAN; this was located on the south side of Little River. In the 1790 census in his home were three males b. aft 1774 and six females. Priscilla's father's estate provided them with several parcels of land in Wayne Co., NC which they sold after her mother's death. He received an eighty acre grant from the State on 11 July 1788. Deed Book 4, p.326, #206 for Wayne Co., NC shows that on 29 Sep 1789 Etheldred BOYET purchased from the State, eighty acres in Wayne Co., on the west side of Little River and west side of Beaverdam Swamp at the rate of fifty shillings per 100 acres. Adjacent land owners were Matthew RAIFORD's old line," Nicholas TYDER/TYNER, and BRADUS. Book 5, p.180 shows that Etheldred received 10 lbs. specie from Lewis GURLEY on 14 Oct 1789 for land on the west sides of Little River and Beaverdam Swamp. Adjacent owners of the eighty acres were "Mathew RAIFORD's old line" and "near Nicholas TINER's." This transaction was not recorded until Jan 1792. On 30 Dec 1800, in Wayne Co., NC, another deed was transacted which listed 150 acres of land adjacent to Etheldred's own lines; one witness for this deed was Joseph Ballard BOYT. In 1800 both Etheldred and Priscilla are shown to be b. bef 1755; in their home were two females and one male b. bet 1774 and 1784, one girl and one boy b. bet 1784 and 1790, and two girls b. bet 1790 and 1800. Etheldred owned five slaves in 1800. Apparently one son and two daughters had either married or died between 1790 and 1800. Etheldred, Priscilla, and family were living in Wayne Co., NC in August 1807 when he filed a suit against Stephen SASSER; Jehu BOYT was a witness. Etheldred was paid for three days attendance at court; in a deposition he stated that the distance to court from his home was thirty-four miles and that he attended court three times during the month of August 1807. On 3 October 1807 a certificate was recorded for "Ethelred BOYT and his wife Priscilla also his daughters Betsey, Betheny, and Martha" as "acceptable members of Methodist Episcopal Church in Wayne County, Raleigh Circuit, State of North Carolina." This document was signed by Chirstopher S. MORNING with a postscript which reads, "The Lord bless you all ways and make you a blessing where you go. C.S.M." About 1808 the family had moved to Tennessee, in 1809 and 1810 Etheldred is listed in the Williamson Co., TN tax list. He owed one thousand pounds of port to G. D. READ which on 23 Aug 1810 was to be paid to Moses TURNER. By 1812 they were living in Bedford Co., TN where he purchased 340 acres for $1,050.00 on 19 Jan 1812. Witnesses to this transaction were Jehu and James BOYET, probably his sons. In 1812, during the War of 1812, Etheldred and two sons, Jehu and James, served in Capt Lewis Medlin's Company, 28th Regiment, Tennessee Militia for Bedford Co. County Judge Allen LEEPER made a list of 98 men who served; this is on file at the Tennessee State Library. It noted that Medlin's District was in the Sinking Creek and Rock Creek area south of Duck River and above the Lincoln Co., TN line. Later this was Districts 19 and 20 of Bedford Co. A receipt was recorded for "Athaldratt" BOYT for "$9.87 ½ c [sic] in full of his account with us to present date..." 28 Dec 1819; it is to THOMPSON and WARDLOW by John C. SAWYERS. He bought a negro, "Jack" from James BOYET on 3 Aug 1824, as recorded

in Bedford Co., TN. He paid Thomas ROSS $185 "in full." Another receipt notes, "Received of Etheldridge BOYETT by this lady ten dollars & 37 ½ cents in full of his account with us [signed] B. WILLIAMS & Co." Etheldred d. aft 25 Sep 1828 and bef 1830 probably in Bedford Co., TN. Another receipt signed by James PARTON and dated 2 November 1833 states, "Received of James BOYET my fee for services as Commissioner to lay off his portion of land in Estate of Ethelred BOYET, deceased." Priscilla d. probably in 1836/8 in Bedford Co., TN. Bedford County was divided in 1836 and Marshall County was created. Some of the children lived in both counties. Children: Jesse, Bethena, Jehu, Martha, Elizabeth, Alsy or Alcey, James, Nancy, and Zelpha. [TGM, LRBTN, LRWNC, TLWTN, TLDNC, TRDNC, 79WNC, 8OWNC, 83BTN, TNSLIB, WWCNC, BNI:3:5]

list as a resident in Capt. Johnthan (sic) STANSIL's Company. George owned 300 acres and had one free poll, no black polls, or stud horses. In 1800 he was taxed for 300 acres in O'NEIL's Co.; at that time he was also taxed for one black. In 1802 and 1803 he was taxed on the same, but in PRICE's district. The 1804 tax list for Johnston Co., shows that he owned 400 acres. By 1805 he was taxed in PRICE's District for 600 acres and one black. In 1805 and 1810 he was appointed overseer of the road in Nathan STANSIL's place according to Johnston Co., NC Court Records. In 1806 he had 600 acres and 3 blacks and remained in PRICE's District. In 1807 he was only taxed for 500 acres and no blacks. In 1810-1814 he was taxed for 800 acres in Price's District; only in 1812 was he taxed for a black. In 1815 and 1816 he had 700 acres valued at $500 and was in HOLDER's District. He served in the War of 1812 and applied for and received a pension from the federal government. In 1817 he had 700 acres in HOULDER's District, valued at $300 and located on the Little Buffalo, but the 1818 tax list shows him with 860 acres valued at $800 in HOULDER's District. The 1819 list shows the same number of acres valued at $860 on Little Buffalo, and he did not have to pay a poll tax indicating that he was exempted for some reason. In 1820 he was taxed on 860 acres and paid the poll tax. He was in O'NEAL's District in 1819 and 1820. He may be a brother of Isaac of Edgecombe Co., NC or Joseph BOYET who is listed in 1799 tax list for Johnston Co., NC in Capt. Simon PEARCE's Company, eleven households from Patrick O'NEAL. Sometime prior to 1850 a slave house was built on the land; it is listed in a National Register of Historic Places because of its unique construction. It is a one-room log house of hand-hewn planks held together by full dove-tail notches and pegs. The unusual mud and stick chimney is the only one known to be still in tact in North Carolina and is located on the farm near Kenly, NC in the Glendale Community. In 1850 George and Tamsey were living with their son, Larkin G. At that time they were farming 100 acres and the main crops were corn and sweet potatoes. At an advanced age, George became blind. George's will is dated 10 Aug 1844 and was probated in Johnston Co. during August Court, 1852 recorded in WB I, p.659. George had one son and one daughter both b. bet 1790 and 1800; he was bet 26 and 45, and there were two females b. bet 1774 and 1784. Their children were: Penelope, Cally, Larry, James, Garry, Martha, and Larkin G. [TLJNC, TRJNC, RWPEN, CRJNC, WBJNC, 85JNC, 1812P, 8OWNC, BNII:4:2-3J

Joseph BOYET witnessed David WORRELL's last will on 10 Dec 1788 in Wayne County which was recorded in Will Book I, p.161 and numbered 78. The will was presented to January Court 1789. It is possible that Henry was a son of Joseph. In Deed Book 12, page 236 is a deed from Henry BOYTE to Mary BOYTE, both of Wayne Co., dated 15 Aug 1827. He received $300 from Mary for land on the south side of the Nahunta and on both sides of Dennis's Branch containing 236 acres. Adjacent land owners were John MITCHELL and a RAIFORD. Witnesses were Avery BOYTE, Robert BOYTE, and Henry BOYTE. The deed was proven in court and registered Aug 1827. Wayne Co., NC Deed Book 13, page 269 shows a mortgage between Mary BOYT and Henry BOYT for debts owed James C. COLE and Arnold BORDEN of the firm of Arnold BORDER and Co. The parcel of land contained 200 acres; other property included was a twenty-eight year old slave names Charles, and two horses. The debt was for $247 which BORDEN Co. paid John and Richard WASHINGTON, Merchants of Waynesboro, and two other debts; one due Washington and Wright Merchants for $107, and a $351.78 debt Henry and Mary owed BORDEN and COLE. Mary BOYT and Henry BOYT were allowed to keep possession of said land, negro, and horses according to the mortgage signed 21 Nov 1827 and registered in the Nov 1827 court. On 5 Aug 1831 as detailed in Deed Book 15, page 478, Henry BOYTE and Mary BOYTE of Wayne Co., sold their land to Arnold BORDEN and Co. (for the $700 debt). Their land was described as being 200 acres on the south side of the Nahunta and both sides of Dennis Branch. Witnesses were James GRANTHAM and Raymond FREELY. ft was registered in Feb 1833 court. Henry's mother, "Polly" BOYTE wrote her will on 12 Aug 1837 and it was probated during the February term of court in 1838 in Wayne Co., NC on the oaths of the two witnesses, Stephen PATE and Thomas A. DEANES. Apparently Henry was the only surviving child of Polly in 1837. [LRWNC, WBWNC]
