[WILL]
This is the last Will and Testament of me Andrew Simpson of Midway in the
Parish of Hartshorn in the County of Derby, Earthenware Manufacturer.
First I will and direct that all my just Debts, Funeral, and Testamentary
Expenses shall be fully and duly paid out of my property.
I then will and direct that the whole of my property, whatsoever and
wheresoever, either in Money, Notes, Bonds, Furniture, or any other sort
of property whatsoever, belonging unto me, shall be placed out on such
Security and at such Interest as my hereinafter named Executors shall deem
proper. And furthermore I will and bequeath the whole of the Interest arising
from such property unto and for the use of my Dear Wife Ann, for and during
the term of her natural life, with a proviso that my Daughter Hannah Simpson
shall have a maintenance out of the said property as long as she remains
unmarried.
And if at any time, during the life of my said Wife, my Executors should
deem such Interest insufficient for hers and my daughter’s maintenance
I hereby will and direct that my said Executors shall be empowered to draw
out such sum or sums of Money from the Principal, as they shall think proper,
and pay the same to my said wife.
And also at the expiration of one year from the Death of my said wife,
and after all her funeral expenses shall have been paid, I will and bequeath
the Residue of all my property amongst my two Sons Andrew Simpson, and
Moses Simpson, and my Daughter Hannah Simpson share and share alike. And
if any one of my said children should die before he or she attains such
property, leaving no lawful Heirs, his or her Share shall be equally divided
amongst the surviving of my said children.
And lastly I hereby nominate and appoint my friend Charles Brunt of
Midway aforesaid and my friend John Cole of Midway in the Parish of Newhall
in the County aforesaid to be the Executors of this my last Will and Testament.
In witness hereof I have hereunto set my hand and seal this Seventeenth
day of July, One thousand eight hundred and thirty three.
Signed, sealed, published, and declared by the said Testator as his
last Will and Testament in the presence of us the subscribers: Willm. Brunt,
Mary Brunt, Ann Bucknall.
