[Text of Will]
This is the last Will and Testament of me George Henn of DuffieId in the County of Derby, Gentleman, made this first day of September one thousand eight hundred and thirty eight.

First, I give and devise all that my copyhold, messuage, dwelling house or tenement with the garden, outbuildings and appurtenances thereto belonging situate, standing and being in Duffield aforesaid and now in my own possession unto Elizabeth Cooper, now living with me, niece of my late wife and daughter of John Cooper of Church Gresley, her heirs and assigns forever.

Also, I give and bequeath all my household goods and furniture, plate, linen, china, beds, bedding and all other my effects in and upon my said dwelling house and premises in Duffield aforesaid unto the said Elizabeth Cooper, her executors, administrators and assigns absolutely forever.

Also, I give and bequeath the sum of three hundred pounds now due and owing to me from the said John Cooper and secured to me in mortgage of certain hereditaments belonging to him the said John Cooper, situate in Church Gresley aforesaid, with all interest due thereon at the time of my decease, unto the said Elizabeth Cooper, her executors, administrators and assigns, absolutely forever.

Also, I give, devise and bequeath all the rest, residue and remainder of my messuages, dwelling houses or tenements, closes, pieces or parcels of land, hereditaments and real estate whatsoever and wheresoever and also the rest, residue and remainder of my ready money and securities and all other my personal estate and effects whatsoever and wheresoever, and of which I shall die possessed, interested in and entitled to (except what I have hereinbefore specifically disposed of) unto and equally between and amongst all and every the sons and daughter of my late brother John Henn and my late sister Catherine Hunt, late wife of Joseph Hunt of Duffield Bank, and also between and amongst the nephews and nieces of my late wife Alice Henn deceased, being the sons and daughters of her brothers and sisters (excepting only to Mary the wife of George Cooper of Duffield aforesaid, farmer and gardener), which said excepted share of the said Mary Cooper (in consequence of her easy circumstances in life), I give, devise and bequeath to her two brothers William Cooper and Joseph Cooper in equal shares and proportions, and to their several and respective heirs, executors or administrators and assigns forever, as tenants in common and not as joint tenants in addition to the shares and interests of them the said William Cooper and Joseph Cooper under this my will, in equal shares and proportions and to their several and respective heirs, executors and assigns forever, to take as tenants in common and not as joint tenants, subject nevertheless, and I hereby charge and make chargeable the said last mentioned estates and effects with the payment within twelve months next after my decease of all my just debts, funeral and testamentary expences and the expences of proving this my will.

And, whereas I am or may be seized or possessed of estates, lands, tenements and hereditaments at mortgage in fee thereof or as trustee for other persons and not in my own right absolutely, herein order to facilitate the reconveyance, resurrender or assignment of any mortgages in fee and the execution of any trusts vested in me, I do hereby give and devise all estates, land, tenements and hereditaments whereof I am or may be seized or possessed as mortgagee in fee or as trustee, and all my title and interest therein unto William Gamble of the last house in the Parish of Duffield aforesaid, farmer, upon trust that he the said William Gamble, his heirs and assigns do and shall convey, surrender, assign and assure, order and direct the same respective estates, lands tenements and hereditaments unto such person or persons for such uses, ends, interests and purposes and in such manner as I should in case I had been living, have been bound or required or ought to have conveyed, surrendered assigned, assured and disposed of the same.

And, I do hereby nominate, constitute and appoint the said Elizabeth Cooper, the said William Gamble and Joseph Moreton of Duffield aforesaid, sailor, joint executrix and executors of this my will, hereby revoking and making void all former and other will and wills by me at any time heretofore made and do publish and declare this only to be my last Will and Testament, In Witness whereof I have hereunto set my hand and seal the day just above written.

Signed by the said George Henn in the joint presence of us who in his presence have hereunto set ou hands as witnesses.
