[WILL]
I John Whiteaker of the Parish of Church Gresley in the County of Derby
being of sound mind and memory and being possessed of several Houses and
Land in the said parish do hereby make my last Will and Testament.
First I desire that all my debts may be paid out of any Personal Estate
(Except what is charged upon any Real Estate by Mortgage)
Also to my Wife I give and bequeath the House and Croft with everything
thereto belonging now in my own possession the House and Garden in the
occupation of William Cooper and the House and Croft with every thing thereto
belonging in the occupation of Thomas Barkley and the House and Garden
in the occupation of William Bath all within the said parish of Gresley
for her life.
Also I give to my wife all my personal estate whatever after payment
of my just debts.
After my wife’s decease I give and bequeath to my son John and his
heirs the House and Croft with every thing thereto belonging now in my
own Possession the House and Garden in the occupation of William Cooper
and the House and Garden in the occupation of William Bath with every thing
belonging thereto and the said three house shall be charged with the payment
of all money that shall be charged by Mortgage upon all my Houses and land
at my decease.
Also to my Son Thomas and his heirs after my wife’s decease I give
and bequeath the House and Croft with every thing belonging thereto now
in the occupation of Thomas Barkley of every charge.
And if either of my sons marry during the life of my wife I hereby
give them power to give by their will whatever they would have been intitled
to at my wife’s decease.
And I do hereby constitute and appoint my wife sole Executrix of this
my last Will and Testiment and do hereby revoke and disannul all former
bequests Wills and Legacys by me heretofore in any wise left or made declaring
and confirming this to be my last Will and Testament in witness thereof
I have hereunto set my hand and seal this 27th day of Febry 1781.
