[WILL]
This is the last Will and Testament of me Robert Hough of the parish of Ashby de la Zouch, Farmer, subject to the payment of all my just debts funeral and testamentary expences I Give and bequeath all my Household Goods and Furniture live and dead Farming stock money and securities for money and all other my Personal Estate and effects of every description whereof I shall die possessed unto my friend John Lever of Ashby de la Zouch in the County of Leicester, Draper, his executors administrators and assigns upon Trust for the use and benefit of my mother Mary Hough and her assigns during the term of her natural life so and in such manner that she may enjoy the same for her sole and separate use free from the control debts engagements or interference of her husband and I direct that the receipt and receipts of the said Mary Hough shall in cases be a good and sufficient discharge for the monies or effects which shall be paid or delivered to her by virtue of this my Will and my will is that my said Trustee shall have the disposition and management of my Estate and Effects in such manner as in his opinion and discretion shall be most conducive to the benefits of my said Mother and the legatees herein after named. And from and after the decease of the said Mary Hough I give and bequath all my said Personal Estate and effects unto my Brothers and Sisters Mary Hough, Hannah Hough, Rebecca the wife of Robert Dolman, Thomas Hough and Charles Hough in equal shares and proportions. And my will is that the shares of the said Rebecca Dolman Mary Hough and Hannah Hough shall be for their sole and separate use respectively independntly of any husband or husbands and free from their control debts or engagements, and that their respective receipt and receipts shall be an effectual discharge and effectual discharges for their respective shares without the signature of their several husbands. And I appoint the said John Lever sole Executor of this my Will. And hereby resolving all other wills by me made I declare this only to be my last Will and Testament.


In witness whereof I have hereunto set my hand and seal this third day of May in the year of our Lord one thousand eight hundred and twenty seven.
To all whom these Presents shall come
We John Lever of Ashby de la Zouch in the County of Leicester Draper, Mary Hough of the same place Widow Charles Hough of the same Place Farmer Thomas Hough of Ticknall in the County of Derby Wheelwright Mary Hough of Calke in the said County of Derby spinster Hannah Hough of Ashby de la Zouch aforesaid Spinster and Robert Dolman of Melbourne in the said county of Derby yeoman and Rebecca his wife send greeting Whereas Robert Hough late of Ashby de la Zouch aforesaid Farmer deceased by his last Will and Testament in writing bearing date the third day of May one thousand eight hundred and twenty seven appointed the said John Lever sole executor thereof. And whereas the said Mary Hough widow is the mother of the said Testator and a cestuique use for life under the said will And the said Charles Hough Thomas Hough Mary Hough spinster and Hannah Hough and Rebecca the wife of the said Robert Dolman are brothers and sisters of the said Testator and legatees under the said will and as such are severally and respectively entitled to take out letters of Administration to the estate and effects of the said deceased
And whereas the said Mary Hough widow Charles Hough thomas Hough Mary Hough spinster Hannah Hough and Robert Dolman and Rebecca his wife are desirous of declining to take out letters of Administration. Now know all ye that we the said John Liver Mary Hough widow Charles Hough thomas Hough Mary Hough spinster Hannah Hough and Robert Dolman and Rebecca his wife for divers good causes and considerations as thereunto moving Have and each and every of us Hath renounced disclaimed and given up and by these presents Do and each and every of us Doth absolutely and forever renounce desclaim and give up all execution executorship and administratorship of or to the said hereinbefore in part recited Will of the said Robert Hough deceased and of and to all and every or any other will or wills codicil or codicils or testamentary writing or writings whatsoever by him the said Robert Hough deceased at any time or times made and the probate and probates of the same and every of them respectively and all and each of our right willpower and authority whatsoever to prove the same or part (?) under or by virtue of the said will or to perform all or any of the trusts thereof or otherwise administer interfere or intermeddle with the estate and effects of him the said Robert Hough deceased and to the end and intent that this renunciation and disclaimer may more certainly take effect we do hereby constitute and appoint any one or more of the procurators or procurator or others or other of the Archdeaconry Court of Leicester to be our lawful proocurators or procurator or proctors or proctor or Attornies or Attorney for us and each of us and our and each of our name to appear before any ecclesiastical or other competent judge or person and for us and each of us and to our and each of our name to pray and procure this renunciation and disclaimer to be admitted and accepted or otherwise for us and each of us and in our and each of our name to renounce and disclaim as well the execution and executorship of the last will and testament of the said Robert Hough deceased as also the administration of all and singular his goods and chattels rights and credits
And we do hereby severally ratify and promise and agree to ratify and promise allow and confirm all and whatsoever our and each of our procurators proctors and attornies or any or either of them shall lawfully do in the premises by virtue hereof In witness whereof the said parties to these presents have hereunto set their hands and seals the seventeenth day of November One thousand eight hundred and twenty seven.
