In 1749, John and his two brothers all made wills in Essex Co., VA .in the year 1749 John made his will 26/Apr/1749. John died first making his brother, Henry Young, his executor. The will of John Young was exhibited in court by Henry Young on Sept 19, 1749. Henry Young was set to make inventory of the estate, but was deceased by the time inventory was brought to court on July 17, 1750.
Another brother, Williamson Young, made his will April 22, 1749 His will was signed by H. Young. The will of Williamson Young was brought into court on July 17, 1750
The third brother, Henry, had been alive when the other two wills were written. Henry wrote his will on October 30, 1749. His two brothers had already died so he named his wife executrix along with her father, Maurice Smith and his son, John Smith, of the County of King and Queen along with his son William Young.
So, this John Young died without any of his brothers living long enough to take care of his three children. He does not name his wife in the will, so we have to assume she had predeceased him. His wife's brother, John Smith, stepped in and became guardian for the three children on July 17, 1750. Court Order Book 1749-1751 pg 149
WILL
In The Name of God Amen. I John Young of the Parish of South Farnham
in the County of Essex being sick and weak of body but of sound and disposing
mind and memory do make this my last Will and Testament in manner and form
following. First I give my body to the Earth to be buried in such decent manner
as my Executor hereinafter mentioned shall think fit. Trusting in the
merits of my blessed Saviour Christ for the Salvation of my Soul. And as
to my worldly Estate which it hath pleased Almighty God to bestow me with.
I give devise and dispose of in manner following:
Imprimis. I give devise and bequeath unto my son
John Young and his heirs forever the Land and Plantation whereon I now live and
if the said John Young should die without heir, I give devise and bequeath the
said Land & Plantation to my Daughter Mary Young and her heirs forever..
Item. I give and bequeath unto my Son John Young and my
Daughters Mary and Fanny Young all the rest and residue of my Estate of what
nature or kind soever to be equally divided among them.
Lastly, I appoint my Brother, Henry young, Executor of
this my last Will and Testament. In Witness whereof I have hereunto set my
hand and seal this Twenty sixth day of April 1749.

At a Court held for Essex County at Tappanhannock on the 19th day of
September Anno Dom. 1749
This Last Will and Testament of John Young deceased was this day exhibited in
Court by Henry Young, the executor therein named which was proved by the Oath of
the said Executor and also by the oath of Edward Conner and William Young two of
the witnesses thereto and thereupon was admitted to record and is truly recorded
