Will of Mary POWELL (Luff) 1776 - 1842 Widow of Isaac POWELL of Fareham
In the name of God Amen. I, MARY POWELL, widow of ISAAC POWELL, being sick and weak of body , but of perfect mind and memory thanks be given unto God, do make this my last Will and Testament, that is, I give to my daughter ANN POWELL all the household goods and furniture I have in the house I now live in at my death, after my death and Funeral expenses are paid and the money my eldest Son ISAAC POWELL has lent me from the 15th Jun 1842 be paid with lawful interest for the same, and likewise all my just debts be paid, my Will is, that the remainder of the property that my Uncle JOHN LUFF left me at Titchfield, the same I mean, that MRS BOWYER in the Parish of Titchfield is receiving the interest for, at the death of MRS BOWYER I will and desire the same to be shared between my children, which are as follows, ISAAC POWELL, whom I make Executor to this my last will and Testament, ELIZA , WILLIAM, SARAH, JOHN, JAMES, GEORGE and ANN POWELL. Should any of my children be dead, my will is that their children do receive their parents part equally between them . My Will is that my daughter ANN POWELL do receive Ten pounds more than either of my other children on the account of the trouble she has with me, all my other children, my Will is that they do share equally alike, after all my debts be paid. My Will and wish is for my eldest Son ISAAC POWELL to be executor of this my last Will and Testament. I, MARY POWELL residing in the Parish of Fareham in the County of Hampshire, do declare this to be my last Will and Testament, in witness whereof I hereunto set my hand and seal this 22 Day of September 1842.

On the twenty third day of November 1849, ISAAC POWELL the executor named in the
above written Will, was duly sworn well and truly to administer and that the
above named Testertrix died on or about the twenty second day of October, One
thousand eight hundred and forty two and that all the goods, chattels and
credit which were of the above named Testertrix at the time of her death, do
not amount in value to the sum of Two Hundred Pounds, as he verily believes

In the goods of MARY POWELL, deceased.
ISAAC POWELL of Fareham in the County of Southampton, Gardener, executor named in the Last Will and Testament of MARY POWELL, late of Fareham in the County of Southampton, widow, deceased, maketh oath and saith that the reason why the Will of the said Mary Powell was not proved before, is that the said Mary Powell was entitled under the Will of JOHN LUFF, late of Titchfield in the County of Southampton, Yeoman, deceased, to a Neversionary Interest in a share of the Residuary Estate of the said JOHN LUFF, deceased, subject to a Life interest of the said John Luff's wife Elizabeth therin. And the said ELIZABETH LUFF, afterwards ELIZABETH BOWYER departed this life on or about the twenty first day of October, last, and the share of the said Mary Powell in the Residuary Estate of the said JOHN LUFF, deceased is now become payable to this deponant as the executor named in the said Will of the said MARY POWELL, deceased . And the Deponent further saith that the said Mary Powell did not die possessed of effects other than the share of residue hereinbefore mentioned, sufficient to pay the expense of proving the said Will and other expenses incident thereto as this deponent verily believes . SAMUEL BIDEN of Fareham in the County of Southampton, Cooper, one of the witnesses to the last Will and Testament of Mary Powell late of Fareham in the County of Southampton, widow, maketh oath and saith that he was present at the execution of the said will on the 22nd day September 1842 and that the said Will was then read over and fully explained to the said Mary Powell in the presence of this Deponent and she appeared perfectly to understand the same and declared it to be her last Will and Testament and the said Mary Powell set her mark at the foot of the said Will in the presence of the witnesses thereto. And SAMUEL DRAPER a person then present at the requestand in the presence of the said Mary Powell and in the presence of the witnesses thereto wrote opposite the said mark, the works " The mark of Mary Powell" And this deponent further maketh oath and saith that the names "SAMUEL BIDEN" " THOMAS MATTHEWS" and "HENRY BECKETT" as the witnesses to the execution of the said Will is the proper handwriting of this deponent and the said Thomas Mathews and Henry Beckett respectively. And that they this deponent and the said Thomas Matthews and Henry Beckett signed their names as witnesses to the execution of the said Will at the request and in the presence of the said Mary Powell the Testatrix, and in the presence of each other on the said 22nd day of September 1842.
