The following is taken from a very poor copy of a hand-written letter from Lomenzo Caples to his mother. It appears to be written on both sides of a single sheet of paper, folded in half to make four pages. The writing, which slants to the right, appears to goes right up to very edge of the pages, causing it to be lost or indescernable due to the copy quality and/or deterioration of the original paper.

When Lomenzo filed his Declaration for Invalid Pension on July 6, 1894, he was 50 years old, living at 233 North Clinton Street, Syracuse, Onondaga County, N.Y. He indicated that he was partially unable to earn support by reason of Rhuematism, Cataracts, & Piles, Deafness & Impaired Sight. Witness H. E. Gould of Syracuse, N.Y. did not indicate the number of years he had been acquainted with Lomenzo Caples, but witness Jacob Fingar of Syracuse, N.Y., indicated an acquaintance of nine years. D. B. Hunt was the Notary Public.(4)


On July 27, 1894, Bureau of Pensions Commissioner Wm Lochren requested that the War Department furnish an official statement of the enrollment, discharge, and record of service so far as may be applicable to the allegation that Lomenzo Caples enlisted on January 5th 1864, served in Co. H, 16th Reg't, N.Y. H. A. and was discharged at New York City, August 28th, 1865 (No. 1159204). On July 28, 1894, Col. F. C. Ainsworth of the War Department replied on the same document that:
  • Lomenzo Caples of Co. A, 16" Reg't N.Y. H. A. was enrolled Jan. 5, 1864 and M.O. with Co. Aug 21, 1865.
  • Name Lomenzo Caples has not been found on rolls of Co. H.
  • From enlistment in 1864 to Muster Out in 1865, he held the rank of Private
  • During that period the rolls show him present except as follows: Dec 31. 64 to Apl 30. 65 absent on detached services in Requa Bat.24 A. C. since Sept. 1. 64
  • No medical records for treatment were found.(5)

On August 8, 1894, Doctors A. S. Edwards, F. O. Donohue, and J. D. Porter provided the following medical assessment for the Original Pension Claim, No. 1,159,204 for Lamenzo [sic] Caples, of Company H, 16 Reg't, N.Y.H.A., Syracuse, Onondaga County, N.Y., type-written on form 3-111, date stamped by the U. S. Pension Office on August 18, 1894:
Cause of Disability: "Rheumatism, catarrh, piles, deafness and impaired sight."
The Claimant's statement upon which he bases claim for Original: "That he has had rheumatism for 12 years in his legs and shoulders; that he has catarrh which has affected his throat and nose for the past 20 years; that he has been deaf in both for 15 years; that his eyesight is poor; that he can well with glasses."
The examination found the following objective conditions: Pulse rate, 100; respiration, 20; temperature, 98.4; height, 5 feet 8 ½ inches; weight, 185 pounds; age, 50 years; Carpenter. Well-nourished. Good color. Tongue clean. Hands soft.
Description of Disabilities: Objective signs of rheumatism are negative. Heart action rapid, but this in our opinion is due to functional disturbanc [sic] of nervous origin. Area of cardiac dullness not enlarged. No murmurs or friction sounds. Apex beat felt at 5th intercostal space with normal impulse. No cyanosis, oedema or dyspnoea. He cannot hear ordinary conversation at 6 feet in either ear. This claimant has well marked naso-pharyngeal catarrh. The mucous lining of his throat and nose is congested. We are of the opinion that this deafness from which claimant suffers is of catarrhal origin. Snellen's types show D equals 18 at 6 meters both eyes without glasses. He cannot see small type at any distance without glasses with either eye. D equals 1 at 12 inches each eye with glasses. There is no abnormal appearance of claimant's eyes. Examination of his rectum reveals nothing abnormal. We find nothing abnormal with reference to his abdominal viscera. Chemical analysis of his urine shows no abnormal ingredient. Specific gravity 1022; acid reaction; no albumen; no sugar. No other disability is found to exist.(6)

On September 24, 1894, War Claim Attorney A. B. Jones wrote the following in a brief, type-written note to Hon. Com. of Pension:
"In regard to the Declaration of Lomenzo Caples Claim NO. 1,159,204 I enclose you his Discharge Paper and upon Examination you will readily see how the mistake in his Company would occur. To-day he tells me he was in Co. A 16th. N.Y.H.A. and not Co. H. as in application."

The enclosed discharge paper is in very poor condition and difficult to read. What can be discerned is the following:
  • Lomenzo Caples was born in Mohawk, New York
  • He was 21 years old, 5 feet 7 inches, dark complexion, black eyes, brown hair, occupation Cooper.
  • Discharged August 21, 1865, Washington, D.C.(7)

On March 23, 1895, 43 year old Frank LaGrange, 2802 Lodi Street, and 50 year old F.W. Edick, 1109 S. Geddes Street, provided the following General Affidavit to A.B. Jones:
Deponents have been acquainted with this applicant for thirty years or more. Said Edick has employed Caples a good deal and both of us know him as a neighbor hence our means of knowledge.
We have hear the names of the troubles upon which he makes a claim stated in our presence and in our opinion none of said disabilities are due to or contracted by means of bad or vicious habits and in also believe they are old chronic troubles which prevent him from doing hard work of any kind and justly entitled to a pension.
Deponents made the above statements verbally to A. B. Jones at Syracuse, N.Y. Mar 22 -90 and he reduced the same to writing in our presence and read it to affiants prior to affixing our signatures to same and we declare the paper to be correct so far as our memory or knowledge at this time.

On April 14, 1895, A.W. Guernsey, Special Examiner for the Eastern District, certified that the reputations of F. W. Edick, of 1109 S. Geddes Street, and Frank LaGrange, of 2802 Lodi Street, Syracuse, N.Y. were each "reported good". The hand-written notes of Notary Public Marcus B. Rathburn are practically illegible.(9)


It appears that Lomenzo was approved for rheumatism, catarrh, piles, deafness, and disease of eyes on May 25, 1895, by legal reviewer H. H. Hough, but that on May 31, 1895, he was "Approved for rejection no ratable disability under At of June 27, 1890.(10)


On December 19, 1899, 55 year old Lorenzo [sic] Caples, of West Monroe, Oswego County, N.Y., filed a Declaration for Invalid Pension and appointed Freeman Farrar of Central Square, Oswego County, N.Y. as his true and lawful attorney to prosecute his claim for the sum of $10. Witness Aaron J. Brewster of West Monroe reported knowing Lorenzo for one year and witness J. W. Mutter of West Monroe reported his acquaintance with Lorenzo as twenty years.(11)


On September 14, 1900, 56 year old Lomenzo Caples, P.O. address 2222 Lodi Street, appeared before Albert E. Post, Commissioner of Deeds, Syracuse, N.Y., and provided the following General Affidavit:

Lomenzo Caples being Duly Sworn. According to [?] Deposes & Says that he has never received any Order for Medical Examination from the Bureau of Pensions on the 22nd of July 1900 the Above Afiant Called at the P.O. at West Monroe Oswego Co Ny & Called for his Mail & he Was Informed by the Post Master Edward Whitman that he had Received a a Letter from Washington but had given it to Someone to Deliver to me but he could not State who it was & therefore [--- a fold in the document obscures part of the text --- ] that & May Received an Order.

On January 16, 1901, Doctors J. A. Lane, F. O. Donohue, and F. W. Slocum provided the following assessment of Lorenzo Caples in Syracuse, NY:
Cause of Disability: "Rheumatism, Piles, Catarrh, deafness, disease of heartand disease of eyes."
The Claimant's statement upon which he bases claim for Original: "That he has rheumatism for 25 yrs. in his shoulders, back, legs and arms. That he has piles for the past 15 yrs. which protrude and bleed. That he has catarrh in his head of long standing. That he is deaf in the left ear for 12 yrs. past. Has palpitation of the heart and shortness of breath; sign is failing for the past year."
The examination found the following objective conditions: Pulse rate, 104-110-144; Respiration, 22-24-28; Temperature, 98-4; Height, 5 feet 8 inches; Actual Weight, 175-1/2 pounds; Age, 57 years.
Fairly nourished, good color, tongue furred, hands soft. This claimant has 3/4 voluntary motion only in each shoulder joint. He is stiff in the muscles of the small of his back. The limitation of motion in the shoulders and stiffness in the muscles of the small of his back are results of rheumatism. The objective signs of rheumatism elsewhere are negative. He has a weak and irritable heart. There are no murmurs. The apex is felt at the 5th intercostal space. There is no dyspnoea, cyanosis or oedema. His heart rises from 104 to 144 after slight exercise. We find 2 pile tumors at the anal margin which measures respectively ½ and 1/4 inches. There is no tendency to ulceration or bleeding. No other abnormal condition of his rectum is found. He has catarrh in his nose and throat. The mucous lining of these passages is congested. There is no resulting disability from this. He can hear ordinary conversation at 6 ft. either ear. Snellin's types show D-12 at 6 meters without glasses each eye. D-O.8 at 12 inches with glasses each eye. No indications of vicious habits. No other disability is found to exist."
RATING. "We find that the aggregate permanent disability for earning a support by manual labor is due to rheumatism, piles, and disease of heart, and warrants a rating of $12 a month. Not due to vicious habits.(13)

On June 15, 1901, Fred Wehrli, of 1122 N. State Street, Syracuse, N.Y., provided the following affidavit to Albert E. Post, Com'r of Deeds, Onondaga County:
"... that he has been acquainted With Lomenzo Caples for About ten years last past & Since he moved to the City April 23 1900 & have Seen him as often as twice a week i Know that he troubled [sic] with Rheumatism & at one time he was laid up for a month & is not able to perform Manual Labor & Some of the time i have lived in the same house with him i have heard him Complain of the Piles and Seen him so bad that he could not Sit Down.

On June 15, 1901, 40 year old Leander J. Fort, 122 Briggs Street, Syracuse, N.Y., provided the following affidavit to a Albert E. Post, Com'r of Deeds, Syracuse, Onondaga County:
"... that he has known Lomenzo Caples About ten & a half years & Since he moved to Syracuse N. Y. that he Knows that he has Been Laid up with Rheumatism & is Still Troubled with the Same for I see him every Day & that I know that on account of Rheumatism Piles [sic] that he is not able to do manual Labor my means of Knowing is that i live near him & see him & talk with him every Day.

On July 16, 1901, 57 year old Lomenzo Caples, 29 Huntly Street, Syracuse, N.Y., provided the following affidavit to Notary Public [Wm Sears?], Syracuse, Onondaga County:
... That he is unable to comply with the requirements of the pension bureau dated April 17, 1901 in regards to furnishing medical evidence of his physical condition from Dec 30 1899 to present time, he has furnished proof of Law he had been from the time he Came to the City of Syracuse in Apr 23 1900 to June 15 1901 By Fred Wehrli and Leander J. Fort of Syracuse, That he is unable to furnish Evidence of his Condition of health from Dec 30 1899 to April 23 1900 for the reason his a tailor by trade and being so much indoors my neighbors Could not have occasion to know and the physician that treated him Claims that he knows he treated him but he never had put down what he treated him for, and he had forgot so he did not want to make a statement for him, he thinks the reason are, that he is not much in sympathy with the old veterans having pensions, for he Certainly treated him a nomber [sic] of times for rheumatism and Piles.

According to Invalid Pension form 3-356 (Old No. 3-145a.), Lorenzo [sic] Caples, 29 Huntly Street, Syracuse, N.Y., a Private with Co. A., 16th Reg't, N.Y. Vols H. Art'y, was awarded a pension of $6 per month commencing July 20, 1901 for partial inability to earn a support by manual labor.(17)


On April 11, 1902, in his Declaration for Increase of Pension, Claim No. 1031385, 57 year old Lomenzo Caples, of Syracuse, N.Y., provided the following explanation for his request to Onondaga County Notary Public Michael Kohles:
... that he believes Himself to be Pensionable in a higher degree on Account of increased disability that he is not able to dress himself with the aid of the another person & he makes this Application with the View of being rated higher his is totally disabled to earn a Living by Manual Labor.

On July 30, 1902, Lorenzo [sic] Caples was examined by Doctors John D. Tripp, T.B. Ryan, J.H.[?] Benedict, under Pension Claim No. 1 031 385. His address is listed as Corner of New Butternut & Briggs Street, Syracuse. He was seeking an increase in pension benefits from his $6 per month. He provided the following statement: "I contracted rheumatism many years ago. My heart has troubled me for 5 years or more. I have had piles for 20 years. I am deaf and my sight is getting poor. I have catarrh." The physicians made the following assessment:
Birthplace, N.Y. State; Age, 57; Height, 5-7; Weight, 165 pounds; Complexion, Florid; Color of eyes, Brown; Color of Hair, Gray; Occupation: None; Permanent marks and scars other than those described below, Scar on both thighs; Pulse Rate, 90-110-120; Respiration, 20 20 32; Temperature, 98-5.
Chest well formed measures 36 inches forced expiration, 38 inches forced inspiration. No rales murmurs or dullness over chest walls. Palpitation reveals n o unnatural conditions of liver or spleen. Rheumatism affects left shoulder back and hips. He is unable to bend, is lame in left hip. There is marked tenderness over sciatic notch in left hip. There is tenderness over lumbar region. Motion restricted see diagram. Muscles fairly well developed but soft and flabby. Heart: Apex beat can be felt and seen fully 3 inches below and ½ inch to left of nipple line. There is a well marked blowing sound at 3 space just to left of sternal center. Dullness extends past sternal center ½ inch. To right. There is a marked atheromatous condition of blood vessels, fingers are clubby and blanched. Cyanosis in lips and dyspnea constant. Atheroma of pulmonary artery. The rectum is inflamed ulcerated and prolapsed fully one inch. No fissures or stricture. No pile tumors. Hemorrhoidal vessels engorged. He is suffering from nasal and post nasal catarrh. Uvula elongated and posterior walls of throat are lined with catarrhal mucous. Inner canals are slightly affected with catarrhal deposit. He can hear ordinary conversation at any distance around the room. Deafness not to a pensionable degree. Both eyes are cataractus. Pupils respond slowly to light. He reads with left eye 1/80. Right eye 1/40. With glasses 10/16. Urine Pale acid Spc Gv 1022. No sugar No albumen. No evidence of vicious habits. No other disabilities found. We think his aggregate permanent disabilities due to Rheumatism. Disease of &blood [sic] vessels. Disease of rectum. catarrh and impaired sight and is incapacitated from earning his support by manual labor to that degree that he is entitled to $10 Dollars Pr Month.(19)

According to Increase of Invalid Pension form 3-357 (Old No. 3-145b.), Lorenzo [sic] Caples, residing at the Corner of New Butternut & Briggs Streets, Syracuse, N.Y., a Private with Co. A., 16th Reg't, N.Y. Vols H. Art'y, was awarded a pension of $8 per month on January 20, 1903, commencing July 30, 1902 for partial inability to earn a support by manual labor.(20)


On January 13, 1904, 59 year old Lomenzo Caples appeared before Notary Public Albert E. Post, Syracuse, N.Y., believing himself "... to be entitled to an increase of pension and re-rating as the rate originally allowed him was too low and not commensurate with the extent of his disability, which has existed in a permanent degree since discharge and before Application,
He also believes he is Entitled to a pension from the date of Application which was placed on file in the pension bureau July 10th 1899, And that when he drew his pension he only drew it from July 20, 1901 leaving [seven years?] [?] pension due him for which hereby [sic] applys [then, in a different handwriting] the Same Disability Existed from the Date of his first Application.

On February 24, 1904, Lorenzo [sic] Caples was examined by Doctors [?], J. F. Lane, and F. W. Slocum for Increase in Pension Claim No. 1 031 385. His address was listed as Syracuse, N.Y. He was again seeking an increase in pension benefits from his $8 per month. His statement was provided as follows: "That he has had rheumatism in his shoulders, back, arms & legs 15 yrs; not able to do any kind of work in 3 yrs. in consequence of rheumatism. Disease of heart 8 yrs., palpitation, dizzy spells, pain over the heart & shortness of breath; disease of the rectum since the service." The physicians made the following assessment:
Birthplace, Mohawk, N.Y.; age, 59 years; height, 5-8; weight, 173 pounds; complexion, dark; color of eyes, brown; color of hair, brown; occupation, Carpenter; pulse rate: 92-100-136; respiration, 24-24-29; temperature, 98-4.
Well nourished; good color; hands soft; tongue furred. Chest is symmetrical & measures on forced expiration 35"; on forced inspiration 38".
CHEST:- Percussion & auscultation show healthy lungs throughout.
HEART:- The area of cardiac dulness [sic] extends from the 4th rib to the 6th inter costal space. The heart's action is extremely rapid & feeble. The apex beat is felt behind the 6th rib on the nipple line, with rapid & feeble impulse. There are no murmurs. Claimant has dyspnoea; no cyanosis or oedema.
KIDNEYS:- Urinary analysis show acid reaction. Straw color. SP. Gr. 1018. No albumen. No sugar.
RHEUMATISM:- Claimant has ½ voluntary motion only in each shoulder joint, upper range; 1/3 flexion motion only in his right hip joint; ½ flexion motion only in his right knee & right ankle joint; 2/3 flexion motion only in his left knee & left ankle joint. Claimant drags his right foot & is lame in walking. The grasping power of his right hand is markedly impaired. The finger joints are enlarged. Claimant is obliged to use a cane in walking. With the exception of his finger joints, there is no disparity in the size of any of the corresponding joints. Claimant cannot get out of the chair of dress & undress himself without assistance & is entirely incapacitated for all kinds of manual labor and permanently so due to rheumatism alone.
DISEASE OF THE RECTUM:- We find 2 pile tumors - one 1/3" in diameter; the other 1/4" in diameter. The mucous membrane of the rectum is inflamed & irritable. There are no evidences of vicious habits. No other disability is found to exist.
RATING:- We find the aggregate permanent disability for earning a support by manual labor is due to rheumatism, disease of heart & rectum, & not due to vicious habits, & warrants a rating of $12 a month. Nothing for any other alleged disability.(22)

According to Increase of Invalid Pension form 3-357, Lorenzo [sic] Caples, residing at the Corner of New Butternut & Briggs Streets, Syracuse, N.Y., a Private with Co. A., 16th Reg't, N.Y. Vols H. Art'y, was awarded a pension of $12 per month on June 2, 1904, commencing February 24, 1904 for total inability to earn a support by manual labor.(23)


On May 17, 1904, Bureau of Pensions Acting Commissioner Davenport sent form 3-370 (Old No. 3-077) to Albert E. Post, Syracuse, N.Y. inquiring the Claimant's post office address. A fold in the paper obscures part of the inquiry. "... This is required for the reason that the Claimant lives in Syracuse N.Y. a City having a free delivery post office." Albert E. Post replied at the bottom of the page on May 18, 1904 "Cor of New Butternut & Briggs St."(24)


Here, the pension file contains several pieces of documents relating to the death, on August 26, 1906, of Lomenzo Caples. A partial copy of his death certificate is included, along with partial copies of other documents, one that looks like a copy of Lomenzo's and Hannah's wedding certificate.(25)


State of New York, Department of Health--Bureau of Vital Statistics, Certificate and Record of Death, County of Onondaga, City of Syracuse, 902 Center Street, Lorenzo [sic] Caples. Place of Death: 902 Center Street; 63 years of age; Male; White; Married; Born in New York State; Father: William, born in New York State; Mother: Lucy Louer, born New York State; Date of Death: August 26, 1906; Cause: Cerebral Hemorrhage, duration of about 5 yrs.(26)


On September 4, 1906, just a few days after Lomenzo's death, his widow Hannah filed the following Declaration for Widow's Pension with Notary Public Carrie R. Tenny:

          On this 4th day of September, A.D. one thousand eight hundred and ninety 1906, personally appeared before me, a notary public of the City of Syracuse N.Y. within and for the county and State aforesaid Hannah M. Caples, aged 55 years, a resident of the City of Syracuse, county of Onondaga, State of N. Y., who, being duly sworn according to law, declares that she is the widow of Lorenzo [sic] Caples , who enlisted under the name Lorenzo [sic] Caples at ----, on the 5 day of January, A.D. 1864, in Co. A. 16 N.Y. H. Arty, and served at least ninety days in the late War of the Rebellion, in the service of the United States; who WAS HONORABLY DISCHARGED Aug. 21-1865, and died August 26-1906. That she was married under the name Hannah M. Manwaring, to said Lorenzo [sic] Caples, on the 2 day of December 1867 by Rev. [M?] Birdsley, at Malarey Oswego Co. N.Y. there being no legal barrier to said marriage. neither of them had ever been previously married & they were never divorced. That she was not remarried since the death of said Lorenzo [sic] Caples. That she is without other means of support than her daily labor. That names and dates of birth of all children now living under sixteen years of age of the soldier are as follows:
Ethel Caples, born Feb. 21, 1893. That she has not heretofore applied for pension and the number of her former application is he drew pension Cert. No. 1 031.385. That she makes this declaration for the purpose of being placed on the pension roll of the United States under the provisions of the Act of June 27, 1890.
She hereby appoints GEORGE H. TENNY, of Syracuse, State of New York, her true and lawful attorney to prosecute her claim and receive a fee of $10. That her post-office address is 902 Center St. Syracuse, County of Onondaga, State of N.Y.

I, Hannah H [sic] Caples do hereby certify that I own no [b--ls?] stocks or mortgages, and no real estate I have no means of Support whatever and have not had Since my husbands death except that provided by my Son who is 17 years of age, and he gets only one dollar a day. I live rented rooms and I am back on my rent and grocery bill. and need my pension very much. my husbands life was not insured for any amount. I cannot prove any marriage by the minister who performed the cerimony, as he is now dead. he died without giveing us a marriage certificate. So I have none. and there is no church record. neither I nor my deceased husband was ever married previous to our marriage to each other and we lived together as husband and wife until his death. we were never divorced. and I have not remarried since his death. I have liveing witnesses to my marriage. This is written in my presence as I direct.

On October 18, 1906, 63 year old Daniel Marks of RFD 1, Cicero, Onondaga County, N.Y., and 47 year old Sarah A. Powers, Town of Cicero, North Syracuse, Onondaga County, N.Y., provided the following General Affidavit to Onondaga County Notary Public O. H. Pool:
That they are personally acquainted with Hannah M. Caples and have been with Lorenzo Caples Husband of the Claimant and have been for the last forty five years and both of said Deponents were present at the Marriage of the said Lorenzo Caples and Hannah M. Caples in on Dec 2nd 18667 and Know they are or were the original parties and that said Claimant as the party that was married and on said Date at Mallory in Oswego Co. N.Y. on that date and know that said Claimant has not been since married. Deponent Daniel Marks says have brought up said Claimant and have been personally acquainted with said party every [sic] since. Deponent Sarah A Powers says have Know [sic] said [party] every [sic] since a Child personally. and am a sister of said Claimant and Know that neither of said parties were before married or afterwards or divorced and that said Claimant lived with her said husband till the time of his death.

That I am a Sister of Hannah M Caples and I therefore know that She never was married previous to her marriage to Larenzo Caples, although I am younger then Mrs. Caples. I also knew Larenzo Caples in his early youth and to the best of my knowledge and belief he never was previously married. I was present and witnessed the marriage ceremony performed between them. Said marriage took place at Malarey Oswego Co. N.Y. on the 2nd day of December 1867 by Rev. Mr. Bardsley. I am given the date by Mrs. Caples. they lived together as husband and wife from their said marriage until his death. they were never divorced and She has not remarried. Hannah M. Caples owns no real estate or personal property except a poor amount of household furniture. She has o means of Support whatever except that provided by her Son who is 17 years of age. She is very destitute and in a poor State of health and unable to work and help herself. this is written in my presence as I direct.

On October 22, 1906, 63 year old Daniel Marks of R. F. D. No. 1, Syracuse, Onondaga County, N.Y. provided the following General Affidavit to an Onondaga County Notary Public:
That I am the Stepfather of Hannah M. Caples I was married to her mother when She was about 8 years old. She lived with us until She was married on December 2- 1867. I was present at the Said marriage and know She was never married previous to the Said marriage to Larenzo Caples and She lived with him as his wife from the 2nd day of Dec. 1867 until his death. they were never divorced and she has not remarried. I was also acquainted with Larenzo Caples from his early youth and to the best of my knowledge and belief he never was previously married.
          Hannah M. Caples is poor and destitute and has no means of support except that provided by her Son who is only 17 years of age and her health is very poor. his life not insured for any amount and She has no income.

Dear Madam:
          This is in response to your letter of September 30, 1936, concerning any entitlement you may have to increase of pension as widow of the above named Civil War veteran.
Upon examination of the records, it is shown that you have been in receipt of pension under the Act of May 23, 1928, at the rate of $40.00 per month, from June 27, 1928, on account of having attained the age of seventy-five years. The next higher rate,$50.00 per month, is provided under the Act of July 3, 1926, for those widows of Civil War veterans ow were wives of the veterans during the period of their services in that War. It is shown by the records in your case that you were married to the veteran on December 2, 1867, more than two years after the Civil War had terminated. It is not shown, therefore, that you have title to the $50.00 rate.
          The $40.00 rate which you are now receiving is the maximum rate provided under existing law for the widow of a Civil War veteran (otherwise entitled), who was married to the veteran subsequent to that War.
          Under existing law, physical condition is not a factor for consideration in widows' claims.
          All communications relative to this case should bear the name of the veteran and refer to the number XC-971,662.
