This Indenture made the first day of March in the year of our Lord one
thousand Eight hundred & five & in Twenty ninth year of the
independence of the United States of America. Between Joseph Cathcart [Jr?]
of the State of South Carolina, Chester District, David Cathcart of the
State and District aforesaid of the other part which the said David
Cathcart stands as security for the above mentioned Joseph Cathcart in the
sum of one hundred and thirty dollars in a note of land given to Thomas
Miller in consideration therefore for this better security as the above
mentioned David Cathcart and for the [safe] keeping him the said David
Cathcart free from any damages from said note of one hundred & thirty
dollars and for [diverse] other goods, services and considerations him the said
Joseph Cathcart thereunto moving hath Bargained & sold & by these
presents do Bargain sell unto the said David Cathcart his heirs and
assigns seventy five acres of land and Gray [Horse/House?] twelve years
old which the said Joseph Cathcart had now in his possession to have and
to hold and singular the above mentioned property to the said David
Cathcart his heirs and assigns as his or their own property & for
their use forever providing always and upon condition [nonetheless] that if
the said Joseph K. Cathcart his heirs & assigns shall well and truly
pay the above mentioned note of one hundred and thirty dollars, according
to the [terms] and Effect of these presents [Writing without that _____
henceforth the present writing and very grand matter & thing herein
contained him and purpose the ____ notwithstanding and __the said David
Cathcart for himself his heirs and assigns doth warrant and grant to and
witness the said Joseph Cathcart his heirs and assigns by these presents
that until breach or non-performance what be made of the consideration

to me in hand paid by Henry McKinney at the Signing and Delivery of these

Pledged forever bind Delivered unto the said Henry McKinney and by these presents
have Bargained Sold Pledged [setover] and Delivered unto the said Henry
McKinney his heirs Executors administrators or assigns all that [Message]
tenement plantation or trust of Land whereupon I now live containing one
hundred acres more or less adjoining land of John Culp Johnston formerly
called Nightingales Land, and land of William [Crafsoth] with all its
profits and appurtenances likewise one bay horse about eight or nine years
old, fourteen and half hands high also one Gray mare about five years old
about fourteen hands high. Likewise
six head of cowbeasts and I the Sd. David Cathcart do hereby Warrant and
Defend all and Singular the aforementioned property to the s.d Henry
McKinney his hiers and assigns forever....
Provided Nevertheless if the Sd. David Cathcart shall well and
truly pay or cause to be paid to the S.d Henry McKinney or his order
before the expiration of Eight months from this Date Seventy-five Dollars
with lawful interest without fraud or Delay the ___ statement or
obligation shall cease and be void or if otherwise to remain in full force
and Virtue in Law in testimony whereof I hereunto set my Hand and affix my

County in the State aforesaid, planter in consideration of two Hundred
Dollars to me paid by John Cathcart of said state and county, planter, Has
granted bargained and sold and Released and by these Presents do Grant
Bargain Sell and release unto the said John Cathcart a plantation or tract
of land containing seventy five acres now situated in Chester County on
both sides of Fishing Creek being one part of a tract of land.
Land of one hundred an fifty acres originally granted unto Peter
Culp and by him divided by Will to Jno Culp and by him conveyed unto
Philip Cline and by him conveyed unto Thomas Miller.
Beginning on a White oak on the South side of Fishing Creek on ___
Letter line and with said line N 30 E 23.79 to a White oak ___ marked
thence South 50 E 31-62 to a stake thence South 30 W 23.72 to a stake
thence N 60 W 31.62 on Jno Culp’s line to the Beginning.
Together with all and Singular the Rights members hereditaments and
appurtenances to the said Premises belonging or in any wise incident or appertaining.

Whereas I, this said John Cathcart am justly indebted to Moses
Lamont the sum of fifty seven Dollars and fifty Cents by my note of hand
or obligation Bearing Date the 29th day of October in the year
of our Lord one Thousand Eight Hundred and Six with Interest thereon as I
the said promissory note or obligation Relation thereunto being had doth
now fully and at large appear Now Know Ye that I the said John Cathcart
for the better serving the payment of the said sum above mentioned unto
the said Moses Lamont, his heirs Executors Administrators or assigns
together with lawful interest for the same have bargained and sold and by
these presents to bargain and sell and in plain and open market deliver
unto the said Moses Lamont one Waggon & [Game] of furniture belonging
thereunto to have and to hold the said Waggon and furniture and [Game]

Agents from time to time and at any time hereafter [peaceably] and quietly
to take into any or all the _____ Lands or Tenements of the said John
Cathcart and to take the said Waggon Gins & furniture and it is hereby
covenanted & agreed upon by and between the parties to these presents
that if the said John Cathcart shall pay or cause to be paid the said note
of hand unto the said Moses Lamont or assigns against the 20th
day of September Eighteen Hundred and ten and the Interest due through
this Mortgage & any pact thereof to be void & of none Effect
otherwise the said Moses Lamont may take the said Waggon and furniture

the said Robert Cathcart all that plantation or tract of land containing
eighty acres or less … on the waters of Rocky Creek on the south side of
the said Creek being composed of those ___ parcels of land ___ past
about sixty five acres conveyed from George and Agnes Keys to me

granted to May Bradford the fifth day of November 1787 adjoining land

& Adams vs. Alexander Rosborough to me directed commanding me that of
the goods and chattels lands and tenaments [sic] of Alexander Rosborough
to levy the sum of Eleven hundred & Ninety Seven dollars12 cents
damages and costs. I have seized and taken of the lands and
tenaments of the said Alexander Rosborough all that certain piece parcel
and tract of land containing four hundred acres more or less, situate and
being in the district of Chester whereon Alexander Rosborough now
lives. Joining lands of Major John Moore, Henry McHenry and John Rosborough.
And whereas the said premises with their appurtenances since the seizure
by me made by virtue of the said writ of fieri facias before mentioned
have been exposed to sale at public venue and purchased by Robert
Cathcart, James Cathcart & David McDowell for the sum of Four Thousand
and Seventy Dollars being the highest sum that was bidden therefore now
know ye that I William A. Rosborough, Sheriff aforesaid by virtue of the

aforesaid and by virtue of the statute in such case made and provided and
for and in consideration of the said sum of Four Thousand and Seventy

Land containing one hundred and five acres, bounded by the Lands of David
Lyle, Griffin Nunnery [note: in 1850 census, his household number is

Hemphill ___ in Equity or his successors in office the full sum of Five

Negroes to the said Robert Cherry his heirs Executors and Administrators
in trusteeship for the following purposes to sell such of said property as
may be necessary to pay any or all of my just debts; and secondly after
the payment of my said debts to had said property as conveyed in trust for
the use of my said wife Nancy J. Cathcart and to apply the proceeds
derived from the [house] and rent or sale of said property to the use and
benefit of my said wife and in further trust that the said Robert Cherry
shall sell, [have] rent or otherwise dispose of the said property
according to the wishes of my said wife _____ writing and in case the said
Robert Cherry shall decide to deliver up the said trust on the said Nancy
J. shall [decide] that the trustee shall be changed or if either of the
said parties shall remove from the State then and in either of the above
contingencies it shall and may be lawful for the said Robert to surrender
his said trust to the said Nancy J. or for the said Nancy J. to appoint
another trustee instead of the said Robert; and the said Robert to be held
harmless for all acts and transactions with respect to said property which
shall be done in accordance with the wishes of my said wife.

a mortgage of ___ if deemed necessary to the Ordinary for the payment of
the purchase money and paying interest from the day of sale.

Robert Cathcart Estate. State of South Carolina Fairfield
District. Know all men by these presents that we James Cathcart,
Richard Cathcart, John Harrison, and David McDowell and holden and firmly
bound unto J. S. Stewart Esquire ordinary for the District of Fairfield in
the full and just sum of Seventy Five Thousand dollars lawful money
of this State to be paid the said J.S. Stewart or his successors,
ordinaries of this District, or their certain attorney or assigns.
To which payment well and truly to be made we bind ourselves, and every of
us, ours and every of our Heirs Executors and Administrators for the whole
and in the whole, jointly and severally firmly by these Presents sealed
with our seals and dated the twenty seventh day of October in the year of
our Lord one thousand eight hundred and forty seven. The condition
of this obligation is such that if the above bound James Cathcart and
Richard Cathcart, Administrators of the goods and chattels and credits of
Robert Cathcart, deceased, do make a true and perfect inventory of all and
singular the goods, chattels, and credits of the said deceased, which have
or shall come into the hands, possession or knowledge of the said James
Cathcart and Richard Cathcart, or into the hands, possession of any other
person or persons for their and the same so made do exhibit into the said
Court of the Ordinary, here this shall be thereunto required and such
goods chattels and credits do well and truly administered according to law
and do make a just and true account of their actings and doings therein
when required by the said Court, and all the rest of the said goods,
chattels and credits, which shall be found remaining upon the account of
the said administration, the same being first allowed by the said Court
shall deliver and pay unto such persons respectively as are entitled to
the same by law, and if it shall hereafter appear that any last will and
testament was made by the said deceased and the same appear in Court, and
the executors obtain a certificate of the probate thereof and the said
James & Richard Cathcart do in sudh case, if requried, render and
deliver up the said Letters of Administration, then this obligation to be
void or else to remain in full force.

13 Oct 1827 Robert Cathcart sold land to Minor Smith
and Derril Smith, to be paid on time.
Derril Smith died in 1836.
In the estate papers of Derril Smith, a sealed note to Robert Cathcart is
listed, dated 1 Jan 1834, for $468.19, plus $158.79 interest, total
$626.98. I don't know if this is related to the above land sale or is a
different transaction.
Payments are made at various times in the form of discounts (I assume this
means the amount was deducted from Robert Cathcart's bill at the Smith and
Trapp saw mill)
8 Oct 1849 The Administrators of R. Cathcart were paid $200.15 in the
final settlement of Derril Smith's estate.
Here is my attempt to transcribe the land sale indenture: (I am sure there
are errors, the copy was not any to clear)

South Carolina
This Indenture made the 13th day of October in the year of our Lord 1827
between Minor Smith and Derril Smith of the District of Fairfield and
State aforesaid of the one part and Robt. Cathcart of the District and
State aforesaid of the other part witnesseth.
Whereas the said Minor Smith and Derril Smith, are indebted to the said
Robert Cathcart in the sum of twelve hundred and seventy two dollars and
fifty-cents by four several and promissory notes all bearing date the 13th
day of October 1827 & payable as follows
To the amounts following to wit one for seven hundred (700) dollars
payable January first 1828 and for two hundred dollars (200) payable
January first 1829 and for two hundred (200) dollars payable January first
1830 & one for one hundred & seventy two (172.50) dollars &
fifty cents payable January first 1831. Now this indenture witnesseth that
the said Minor Smith and Darrel Smith for and in consideration of the said
Debt or sum payable as aforesaid to the same Robert Cathcart and for the
better security the payment thereof to the said Robt. Cathcart according
to the terms and affect of the promissory notes aforesaid and also in
consideration of the sum of one dollar by him the said Robt. Cathcart to
us the said Minor and Derril in hand paid at and before the Sealing &
Delivery of these presents do grant bargain, sale assign release convey
and confirm unto the said Robert Cathcart and to his Heirs and assigns for
ever all that piece, parcel or tract of land containing six hundred one
acres more or less situate on Cedar Creek in the District and state
aforesaid bounded on the S.E. and N.E. by lands of Lewis Haigood and on
the North by James Bonner's land on the N.W. and S. W. by lands of John
Bonner Milling and Means being the tract conveyed to us by deed from
Samuel Robertson bearing even date with these presents and also once in
the tract adjoining the above described tract containing one hundred acres
more or less Whereon is a saw mill being a tract conveyed to us by William
Moore Esq. Sheriff of the said District being sold by J. Beaty Esq. his
predecessor in office as the property of Samuel Y. Robertson at the suit
of D. Samuel Green, Together with all and singular the rights Members and
appurtenances thereunto belonging or in any wise appertaining and the
reversion and reservations remainder and remainders rents fees and profits
thereof To Have and to Hold the said premises with the appurtenances unto
the said Robert Cathcart his heirs and assigns forever. Provided always
nevertheless and it is the true intent and meaning of the parties to these
presents that if the said Minor Smith and Derril Smith or either of them
or their Heirs Executors or Administrators shall well and truly pay or
cause to be paid unto the said Robert Cathcart the said sum of twelve
hundred and seventy two dollars and fifty cents according to the terms of
the said promissory note above mentioned then and from thence forth these
presents shall be utterly null and void, any thing herein contained to the
contrary thereof in any wise notwithstanding. And it is covenanted and
agreed upon by and between the parties to these presents that until
default shall be made in payment of the aforesaid sum as before set forth
it shall and may be lawful to and for the said Minor Smith and Derril
Smith peaceably and quietly to hold use occupy possess and enjoy all and
singular the premises above granted and released and every part thereof
with the appurtenances and to have receive and take the rent issue and
profits thereof to their own particular use and behalf, any thing herein
contained to the contrary thereof in any wise notwithstanding. In Witness
Whereof the said parties have hereunto set their hands & seals the day
& year first above written Sealed & delivered in the presence of :

"I have come across another David, probably a son of Joseph (son
of Wm. and Mary) in probate records of William Cathcart,
blacksmith, who died Chester District, SC in 1804, his estate administered
by Joseph Cathcart, Jr. Buyers at venue were Joseph Sr., Joseph Jr.,
Hugh, David, and Samuel Cathcart. I have taken Hugh, David, Joseph
Jr., and the deceased William to be the 4 males under 16 listed in the
1790 Census Fairfield District, SC with Joseph. David Cathcart is
later found in records of Monroe County, Tenn., where Joseph Sr. moved and
is buried, David shown 1823/24/25/26."
[There is a David buried in
Ebenezer (1794-1809) that I think is connected with the William/Mary
Cathcart line.]

1. It appears that this document was initially transcribed using the
surname KINCART instead of CATHCART. The signatures and witness
statements, at the end of the document, are correctly spelled as CATHCART.
2. The 20-year lapse of time between signing and recording
(1811-1831) is puzzling. I'll have to look into this.
The State of South Carolina } Know all men by these presents that
I John Kincart of Fairfield District and State of South Carolina for &
in consideration of the sum of three hundred & fifty Dollars to me in
hand paid by Samuel Kincart of the District & State aforesaid the
receipt hereof I do hereby acknowledge, have granted bargained sold
released & by these presents do grant bargain sell & release unto
the said Samuel Kincart all that plantation or tract of Land containing
two hundred acres, [excepting?] one given by Robert Carnaughen for the use
of the Presbyterian Society originally granted to Robert Carnaughen
the sixth day of February in the year one Thousand, seven hundred &
eighty six, & hath a memorial thereof entered in the secretary's
office in grant book FFFF page 21, said Land situate in, then, Camden
District on the waters of Little River, & hath such form & marks
[buildings & boundaries] as appears in the plat hereof, annexed to the
Original Grant, Together with all the rights, members hereditaments &
appurtenances to the said premises belonging or in any wise incident or appertaining,
to have & to hold all & singular the premises before mentioned
unto the said Samuel Kincart, his heirs & assigns for ever, and I, the
said John Kincart, do hereby bind myself, my heirs executors assigns or
administrators to Warrant and to forever defend all & Singular the premises
