Last Will & Testament of James Roberts Sr



In the name of God Amen
I JAMES ROBERTS SENIOR being weak of bodily health and knowing that I will not have long to live and being of sound mind after first paying all my just debts do make my Last Will and Testment in the manner following Viz,

First, I will and bequeath to my daughter Winney Stanley all that portion of Land lying below Shelby Creek opposite The mouth of Caney Fork of Shelby by the said Winney and George Stanley paying the heirs of William Mullins the sum of $15.00

2nd I will and bequeath unto my son James Roberts Jr all the land lying above or at the Mouth of Caney Creek of Shelby and all the property that remains at my death I want it equally divided between James Roberts Jr, George Stanley and Isaac Roberts.

Thirdly The lot of Land on which I live with all the Orchard in my possesion I maintain for the use of myself and my wife during our natural lives and at our deaths I want my son Jamse Roberts Jr to ___ the same and the land on the other side of the crop fence from the House I want James Roberts Jr to attend on occupy the same in witness whereof I being in my proper mind have hereunto set my hand and Seal the first day of June 1858.

Pike County to wit I John W. (the last name is very hard to read it) E_______ clerk of the County Court in and for the County aforesaid do certify that this Will of James Roberts Sr was produced in open court upon the 21 day of Sept and proven by the oaths of J. J. Casebolt and J. Mitchell two of the subscribing witnesses hereto and orderded of Record whereupon said will with this certifficate hath been duly abs___ of Record in my Office this 25th of Sept 1858.
