I, Frank Hemmer, being of sound and disposing mind and memory, do hereby make, publish
and declare this to be my last will and testament, hereby revoking all former wills by me
made.
First:
I desire that all my just debts and funeral expenses be paid.
Second:
I give, devise and bequeath to my beloved wife Elizabeth Hemmer all my property
both real and personal, to be by her used and enjoyed during her natural life, and to
use and dispose of as she may deem best. Upon the death of my wife, Elizabeth Hemmer,
it is my desire and will that my son, Clem Hemmer, shall be paid the sum of Two
Thousand ($2000) from my estate, which sum shall be in full of his share of my estate.
One half (1/2) of said sum to be paid him within six months from date of my wife's death
and balance in one year from date of her death and in case said amount cannot be paid
out of my estate without selling real estate, it is my desire that my other heirs make up
the amount necessary to meet above payments.
Third:
It is my will and desire that the balance, residue , and remainder of my estate
after making all or part of the above payments be divided between my four children,
Maggie Gales, Coney Reuhlen, Peter Hemmer, and Frank Hemmer, share and share alike.
Fourth:
It is my further will that my wife, Elizabeth Hemmer, shall act as executrix of
this my last will during her natural life, and that she be not required to give any bond
for the performance of her duties as such executrix, and that she be not required to file
any inventory of my estate.
