Buena Vista County Wills and Probate
Last Will and Testament of Fredericke Nitzke


I, Fredericke Nitzke, of the city of Storm Lake, county of Buena Vista, and state of Iowa, being of sound and disposing mind, do make, publish and declare this to be my last will and testament, hereby revoking all wills by me at any time heretofore made:

Item I. I direct that my just debts and funeral expenses be first paid out of my estate.

Item II. All the rest, residue and remainder of my estate, real, personal and mixed, of which I may die seized or possessed, or to which I may be entitled, I will devise and bequeath as follows: 1. To my son Sam Nitzke, I devise and bequeath the sum of two hundred dollars ($200.00).
2. To my son Louis Nitzke, I devise and bequeath the sum of two hundred dollars ($200.00).
3. To my son Ed Nitzke, I devise and bequeath the sum of two hundred dollars ($200.00).
4. To my daughter Anna Nitzke Ahntholz, I devise and bequeath the sum of two hundred dollars ($200.00).
5. To my daughter Mary Nitzke Hanke, I devise and bequeath the sum of five hundred dollars ($500.00).
6. To my daughter Martha Nitzke Ahntholz, I devise and bequeath the sum of three hundred dollars ($300.00).
7. To my daughter, Lillian Nitzke, I will, devise and bequeath my piano and furniture. Also my house and lot located in Storm Lake, Iowa, described as follows: Lot 8, Block 32, in the city of Storm Lake, Iowa, except the east one hundred feet thereof, upon condition, however, that my daughter, Lillian Nitzke shall first pay into the estate the sum of three thousand five hundred dollars before any title to the aforesaid real estate, vest in her, and that the said payment be made within one year, after my death. In the event that my daughter, Lillian Nitzke, does not pay the three thousand five hundred dollars for the house and lot aforesaid within one year after my death, the said house and lot shall be sold by the executor of this will, for the best price obtainable without any order or orders of court and the proceeds shall become part of my estate.
8. All the rest, residue and remainder of my estate I will, devise and bequeath to my three sons Andrew Nitzke, Ben Nitzke, and Alfred Nitzke, to be divided amongst them, share and share alike.

Item III. If anyone contests this will they shall not receive any of my estate.

Item IV. I hereby appoint my son, Alfred Nitzke, of Albert City, Buena Vista County, Iowa, executor of this my last will and testament, hereby exonerating him from giving bonds for the faithful discharge of his duties as such, and I hereby authorize and empower my said executor to sell and dispose of such of my estate as may in his judgment be advisable. Sale to be without court orders. I hereby direct that the said executor be allowed reasonable compensation for acting as such.
