Last Will and Testament of Patrick O. Sullivan


I, Patrick O. Sullivan, of the Town of Newell, County of Buena Vista, and State of Iowa, being of sound and disposing mind, do make, publish and declare this to be my last will and testament, hereby revoking all wills by me at any time made:

Item 1: I direct that my just debts and funeral expenses be first paid out or my estate.

Item 2: All the rest, residue and remainder of my estate, real, personal and mixed, of which I may die seized or possessed, or to which I may be entitled, I will, devise and bequeath as follows:

First: To my beloved wife, Mary D. Sullivan, I give, devise and bequeath the undivided one third of my entire property, real, personal and mixed, which shall be in full settlement of all her Statutory rights, in and to my estate.

Second: To my beloved sons, William, Thomas H., Edward Leo, George and Charley C. I give, devise and bequeath, to each a one-sixth (1/6) interest in all the rest, residue and remainder of my entire property, equally, each to share and share alike, and I direct that the remaining one sixth (1/6) interest shall be equally divided among the nine children (the five sons and four daughters herein named), each to share and share alike; and out of which property before any division s all have been made, shall first be paid to my four daughters, the amounts as hereinafter set forth, viz.:

A: To my beloved daughter, Mary Dalphin, the sum of Five Hundred Dollars ($500.00), which I give, devise and bequeath unto her.

B: To my beloved daughter, Alice Sullivan, the sum of Two Hundred Dollars ($200.00), which I give, devise and bequeath unto her.

C: To my beloved daughter, Maggie Sullivan, the sum of Two Hundred Dollars ($200.00), which I give, devise and bequeath unto her.

D: To my beloved daughter, Anna Scothorn, the sum of Two Hundred Dollars ($200.00), which I give, devise and bequeath unto her.

Third: I further order, direct, and it is my desire and wish, that all of my said property, real, personal and mixed, shall remain in the possession of, and under the absolute control of my said wife, Mary D. Sullivan, she to receive and collect all rents and monies, and to pay all taxes, and have entire control of all my said property, real, personal and mixed, until my youngest son, Charles C., arrives at the age of twenty one (21) years, after which time, the property may be divided as is set forth above; all rents and monies received by my wife from said property, over and above repairs and taxes, shall be here absolutely.

Item 3: I hereby appoint my wife Mary D. Sullivan, executrix of this my last will and testament, hereby exonerating her from giving bonds for the faithful discharge of her duties as such executrix.

IN WITNESS WHEREOF, I hereunto set my hand this thirteenth day of December, A. D. 1902.

On this Thirteenth day of December, A. D. 1902, the foregoing instrument was in our presence signed and executed by Patrick O. Sullivan and by him.declared to us to be his last will and testament, and at his request, and in his presence, and in the presence of each other, we hive subscribed our names as witnesses thereto.
