This Indenture
made this Twentieth Day of July in the first year of the Reign of our sovereign
Lord George the third by the Grace of God of Great Britain France and Ireland
and the Dominion thereunto belonging King Defender of the Faith & and
in the year of our Lord Christ one thousand seven hundred & sixty one
Between William Clement of the
County of Amelia of the one Part and Henry Cox of the County of Cumberland
of the other part Witnesseth that Whereas William
Clement late of the aforesaid County of Amelia Deceased by his
last Will and Testament bearing date the eighteenth Day of February and
the year seven hundred and sixty amongst other Bequests did bequeath
unto his Son Francis Clement the
Land and Plantation whereon he then lived together with a Water Grist Mill
thereon which said Land and Water Grist Mill were afterwards conveyed by
the said Francis Clement to the
before named William Clement (Son
of the said Testator and Party to these Presents) by Deed
bearing date the twenty second Day of May one thousand seven hundred and
sixty as by the said Deed now amongst the Records in Amelia County Court
reference being thereunto being had may more fully and at large appear Now
this Indenture Witnesseth the said William
Clement for and in Consideration of the Sum of fifty Pounds Current
Money to him in hand Paid by the said Henry Cox the Receipt whereof he doth
hereby acknowledge & thereof and forever or a part and Parcel thereof
doth hereby acquit and discharge the said Henry Cox his Heirs & c forever
by these Presents Hath granted, bargain'd Sold, released & confirmd
and by these Presents doth fully clearly and absolutely grant, bargain sell
release and Confirm unto the said Henry Cox his Heir and Assigns forever
one Moiety or half part of the Water Grist Mill aforesaid together with
one half part of the rents issues and Profits thereof heretofore used reputed
taken or known as part parcel or member thereof and that he the said Henry
Cox his Heirs Exrs. and Assigns and every of them shall have use occupy
all ways Easements Liberties, Passages Conveniences and shall quietly have
free Engress Ingress & Regress into and from the said Mill and other
the said Premises for the using and occupying one Moity or half part of
the same without let or disturbance of the said William
Clement his Heirs Executors Administrators or assigns To have and To
hold the said Moiety or one half part of the said Water Grist Mill and all
and singular other the Premises with their Appurtenances unto the said Henry
Cox his Heirs Executors and Admin. to his and her own proper use & Behoof
as fully and in an ample manner as to the said William
Clement now have or may have and enjoy the same and the said Henry Cox
doth hereby covenant [?] grant and agree to and with the William
Clement [?] & in manner and form following that is to say that he
the said Henry Cox shall and Will from time to time and at all times hereafter
during his partnership in the said Mill may [?] , allow, [?] the full Moity
or half part and Portion of all such Sum and Sums of Money and other charges
whatsoever as shall grow due or payable or be convenient or necessary to
be Earn or paid for the rebuilding or Reparations of the Premises or for
the Defence of of the title therof or any parcel thereof in for upon account
of all actions, Suits Matters or things brought against him the said William
Clement or to be brought in time to come against the said William
Clement his Heirs Executors Admin. or assigns for or by reason of any
matter or thing touching or concerning the same and the said William
Clement for him and his Heirs the said Moiety or one half part of the
aforesaid Water Grist Mill and all and singular other the Premises against
him and his Heirs and all and every other Person and Persons whatsoever
claiming by from or under him them or any or either of them unto the said
Henry Cox his Heirs and Assigns shall and will warrant & forever defend
by these Presents In witness whereof the said William
Clement hath hereunto set his Hand and affixed his Seal the Day and
year first in this Indenture written

Received of Henry Cox the sum of Fifty Pounds Current Money it being the
consideration Money in the with Deed express'e In Witness whereof I have
hereunto set my Hand this 23d Day of July anno Domini 1761
At a Court held for Amelia County the 23d Day of July 1761.
This Indenture and the receipt thereon endorsed were acknowledged by the
within named William Clement Party
thereto and ordered to be recorded.
