This Indenture
made the twenty third Day of March Anoy Domina one Thousand seven Hundred
& sixty one Between John Abston of the County of Bedford of the one
Part and Stephen Clements of the same County of the other Part Witnesseth
that the said John Abston for and in Consideration of the sum of Forty Pounds
Current Money by the said Stephen Clements to the said John Abston in Hand
Paid and before the ensealing and Delivery of these Presents the Receipt
whereof he the said John Abston doth Hereby acknowledge to the said Stephen
Clement Clements his Heirs and Assigns thereof and therefore doth Hereby
forever acquit Exonerate and Discharge hath granted bargained & sold
& by these Presents doth grant Bargain Elienfe of and Confirm unto the
said Stephen Clement his Heirs and Assigns all that tract or Parcel of Land
Containing by Estimation seventy fore Acres be the same more or Less Situate
Lying and being in the County of Bedford and is Bounded as Followeth, to
wit, Beginning at Stephen Clement Clement Corner Red oak on the West side
of the River South seven Degrees West twenty three Poles to a Red oak south
sixty Degrees West forty four Poles to a pine South twenty eight degrees
West sixty Poles to a White oake South thirteen Degrees East fourteen Poles
to a Spanish Oak on the said Otter River thence Down the same as it meanders
to a red oak on the East Bank of the same thence of North eight Degrees
East forty Poles to a Dogwood North thrity two Degrees East sixty six West
to a Red oak on the said Otter River thence up the same as it Meanders to
a Hickory Thence of North forty three Degrees West twenty one Poles to a
Hickory on Stephen Clements Line the same along his Line West fifty two
Poles as it Meanders Crossing to the first Station Together with all and
singular the Houses Buildings fences Orchards Woods underwoods ways waters
Meadows Feedings and and all other benefits and advantage to the said Land
belonging or in any wise appertaining and all the Estate Right Title Interest
and Property Reversion Claims Demand of the said John Abston of in or to
the same or any Part or Parcell thereof to have and to Hold the said seventy
fore Acres of Land be the same more or less with all and every its appertenances
to the said Stephen Clements his Heirs & Assigns forever to the only
Proper use and behoof of him the said Stephen Clement his Heirs and Assigns
forever & to no other use intent or Purpose Whatsoever and the said
John Abston doth for himself and his Heirs Covenant and agree to & with
the said Stephen Clement that the said John Abston shall and will Warrant
& forever Defend the said Land and Premises hereby granted unto the
said Stephen Clement & his Heirs against the Claims & Demand of
all and every Person or Persons Whatsoever and the said Stephen Clement
his heirs and Assigns shall may from time to time and at all times forever
Hereafter freely Peacable and Quietly enter into and upon have Hold use
Occupy Possess & Enjoy the said Land & Premises hereby granted without
the Lawfull Lett suit trouble Denial Molestation or Disturbance of them
the said John Abston he or his Heirs or Assigns or any other Person or Persons
Whatsoever and also the said John Abston shall and Will at any Time Hereafter
at the request & Proper Cost and Charge in Law of him the said Stephen
Clement his Heirs and Assigns made and executed or cause to be made and
Executed such further & other Lawfull and Reasonable Acts and Conveyances
and Assurances Whatsoever as shall be adjudged Necessary for the Quiet Enjoyment
of the above Mentioned granted Land and Premises unto the said Stephen Clements
his Heirs and Assigns forever In Witness whereof the said John Abston have
Hereunto set his Hand and Seal the day & year above Written
Memorandum that on the above Mentioned Day & year Quiet and Peacable Possession of Livery of Seison was made by the within Named John Abston was made by the within Named John Abston to the within Named Stephen Clement to him and his Heirs forever. In Witness whereof he the said John Abston have hereunto set his Hand and Seal the day and year first Within Mentioned
At a Court held for Bedford County March 23 1761 This Indenture & Memorandum of Livery of Sison Hereon Indorsed were adknowledged by John Abston Party thereto and Ordered to be Redorded Teste Ben Howard CBC
