Words are missing in many of the lines and those lines are noted with brackets.] This Indenture made this Twenty Sixth day of Julyone Thousand seven Hundred & Sixty three Between Richard Stith of Bedford County for and in the Behalf of the Executors of Richard Randolph Gent.of Henrico County Deceas'd of the one part and John Clement of the same County of the other part Witnesseth that the sd. Rich.d. Stith for and in Consi deration of the sum of Nine Pounds Twelve Shillings & five pence Current Money of Virginia to him in hand paid the Receipt whereof he doth Hereby Acknowledge hath Granted Bargained and Sold and by these presents doth Grant bargain Sell Deliver & Confirm unto the said John Clement his Heirs & Assigns forever one Certain Tract or Parcel of Land Containing two hundred & Ten acres formerly held of for Jacob Piborn as being part of a Tract of Twelve Thousand five Hundred & fifty Acres Granted [ ] to the sd. Rich.d Randolph Gent. Deceas'd Record [ ] had thereto will more at Large Appear Lying [ ] in Bedford County on Both sides of the North [ ] of Hunting Creek Including the Head of the sd.[ ] is Bounded as followeth Viz Begining at [ ] Corner Red Oak on the Said Patent Land [ ] Morgans Line South one Hundred thirty Eight [ ] his Corner Chestnut Thence Dividing Lines South [ ] Degrees East two Hundred & Eight Poles [ ] Thence North forty two Degrees east fifty poles to a [ ] thence North one Hundred Twenty four Poles [ ] on the Line of the said Patent and Thence along [ ] Line West two hundred & forty Poles to the first [ ] being Part of Land Convey'd by the Said [ ] sd. Richard Randolph Deceas'd to the Said [ ] by a Power of Attorney Dated the Seventh day [ ] one Thousand seven Hundred Sixty one [ ] in the General Court Referance thereto being [ ] Large appear Together with the Priviledges [ ] Belonging To have & to hold the Said Pacrel of [ ] Appertaining unto the said John Clement his[ ] Executors Administrators or Assigns or [ ] Estate of Inheritance in fee simple forever [ ] Richd. Stith doth in the behalf of the Executors [ ] & their Heirs & c. Covenant & agree to & with [ ] Clement that he the said Richd. Stith in [ ] Executors & there Heirs & c. the above Granted [ ] of Land & Premises unto the said John Clement [ ] & c. against all persons will Warrant & forever [ ] Witness whereof the Said Richard Stith hath Sign'd & affix'd his Seal the day and Year being first Written
Memorandum That on the day and Year first within written Livery of Seisin of the within Granted land and Premises was by the within Named Richard Stith made done and Executed unto the within Named John Clement according to the Tenor of the within written Deed
July 26th 1763 Receved of John Clement within named, the within Mentioned sum of Nine Pounds Twelve Shillings & five pence Richard Stith At a Court held for Bedford County July 26th 1763 This Indenture and Memorandum of Livery of Seisen and Receipt thereon indorsed were Acknowledged by Richard Stith party thereto and Ordered to be Recorded Teste Ben Howard CBC. |
