Words are missing in many of the lines and those lines are noted with brackets.] This Indenture Made this the 25th [ ]in the year of our Lord Christ one Thousand [ ] hundred and sixty four Between Roland [ ] Burks and sarah his wife of Bedford County [ ] one part and Adam Clement of Hallifax [ ] of the other part Witnesseth that the said Rowland [ ] Burks for and in consideration of the sum of [ ] Current money of Virginia for the use of [ ] to the said Adam Clement to him in hand [ ] the said Adam Clement the Receipt whereof [ ] hereby Acknowledge Hath Given Granted [ ] sold Aliened Enfeetted and Confirmed [ ] Presents doth give Grant Bargain Sell [ ] and Confirm unto the said Adam Clement [ ] his Heirs and Assigns forever one Certain [ ] or Parcel of Land Lying and being on [ ] Ivy Creek in the County of Bedford Containing two hun dred Acres and is Bounded as followeth , to witt, Beginning at John Mackeneys Corner pointers on Richard Woodwards line thence on Woodward North forty five Degrees west Ninety two poles to Pointers then South sixty five Degrees and one Hundred and Eighty Eight poles to a Red Oak then South forty two Degrees west one Hundred & thirty poles to a Corner then south thirty Degrees east eighty seven poles to pointers then New Lines North fifty five Degrees east three Hundred & thirty seven poles to the first Station Together with all houses Orchards Gardens Fences waters and water Cources Woods and Underwoods Profits Commodities Advantages and to all other Appurtenances whatsoever to the same Belonging or in any wise Apper taining To have and to hold the aforesaid Tract or Parcel Together with the afore Recited premises and every part and percel with their and every of their Appurtenances unto the said Adam Clement and his Heirs and Assigns forever and the said Roland Horsley Burks and Sarah his wife their Heirs Executors & Administrators doth Covenant and agree to and with the said Adam Clement his Heirs and Assigns that the said Rowland Horsley Burks and Sarah his wife their Heris & c. the above mentioned Land and Premises with their and every of their Appurtenances to the said Adam Clement his Heirs and Assigns against him the said Rowland Horsley burks his Heirs Executors and Administrators and against all other persons whatsoever shall and will Warrant and forever by these presents Defend in Witness whereof the said Roland Horsley Burks and Sarah his wife hath hereunto set their hands and affixed their seals the Day and year above Written
Memorandom that on the 25th [ ] August one Thousand seven Hundred [ ] four Quiet and peaceable Possession and [ ] the Lands and Tenements within Mentioned [ ] was had and taken by the within Named [ ] Horsely Burks and by him was Delivered [ ] within Named Adam Clement according [ ] the form and Effect of the within Written Deed [ ]
August 25th 1764 Then Received of the within [ ] Adam Clement the sum of forty Pounds [ ] Money it being the full Consideration Money [ ] Deed mentioned Recd. by me Roland Horsley Burks At a Court held for Bedford County August [ ] This Indenture and Memorandum of Livery [ ] and Receipt hereon indorsed were Acknowledged [ ] by Rowland Horsley Burks and sarah his wife [ ] first privilly Examined According to Law [ ] to be Recorded Teste Ben Howard CBC |
