In the name of God Amen I Richard Perkins knowing from his advanced age
of three Score years and ten in life that his days upon earth will now
some day end and being desirous of making an equal distribution of his
Estate among all of his children as far as he can taking into consideration
the advancements heretofore made to some of them do make my Will in manner
and form following.
Item 1st I direct all my debts to be paid by my executors hereinafter
named as punctually as the situation of my Estate will admit of at the
time of my death and for the purpose of enabling them to do so, I set
apart in addition to whatever money I may have on hand and the debts oweing
me to be collected by my Executors the following property To wit. Two
negro men Nicholas and John commonly called road Jno and all that part
of my tract of land called Kings tract which lies on the east side of
Candlers Mountain on the head waters of Burks branch Supposed to contain
about 300 acres to be sold by my Executors at such times and on such terms
as they may deem advisable for the Speedy discharge of all my debts.
Item 2nd I give and bequeath to my wife during her natural life time
the plantation and Tract of land whereon we reside except so much there
of as I may hereinafter in this my will give to my daughter Lucie Jane
I give to my all the household and kitchen furniture except two beds bed
steads and their usual coverings and one dozen Windsor chairs all the
Crop of Corn wheats Oats Hay fodder and Straw that may be on the place
at the time of my death whether the same may be growing or matured all
the plantation utensils of every kind including the wagon all the stock
of horses cattle Sheep and hogs except my riding horse and I give to her
in like manner for and during the time of her life Twelve Slaves namely
Ester, Sophia, Schuyler, John, Sally, Fanny, Elevira, Ann, Peyton and
Hannah and her two Children Henry and Martha, In making the foregoing
bequests to my wife it is expected by me for her to take charge of and
keep and maintain our most feeble and helpless daughter Eliza whose mental
faculties and physical strength is such as to render her totally unable
to take care of herself and to more fully enable my wife to provide for
the comfortable support of our weakly daughter I give to her the interest
on ten Shares of my Lynchburg corporation guranteed Stock in the Virginia
and Tennessee Rail The interest to be drawn by my Executors from time
to time and paid over to my wife to be applied as she may think proper.
Item 3rd. The property heretofore given to my son James H. Perkins in
Land slaves money and various other things as also debts paid for him
to Sundrie persons is considerable all of which it seems he has wasted
or in some way So deprived himself off as now to be in needy circumstances
and to give to him now more property to be at his disposal is a thing
which I decline to do and consequently I give in trust to another person
what I indent for him To wit I now give to Wm A Clement as Trustee for
the benefit of my son James H Perkins and Amanda Perkins his wife for
and during the time of their Joint lives the following, property real
and personal Two dwelling houses and all other outer buildings on the
lots of ground and the ground on which they are Situated lying on the
East side of Lynchburg and Salem Turnpike road on lot containing One acre
on which my Son and family now resides and the lot contiguous thereto
containing nine Sixteenth 9/16 of an acre all the household and kitchen
furniture now in their possession totally purchased by me and loaned to
them consisting of three beds bedsteads and bed coverings Tables Chairs
Beauro, Safe Table ware of different kinds pots ovens & c. I also give
to Wm A Clement as Trustee for them my Son and his Wife all that part
of my unsold and given away in the 1st Item of this my Will. Tract of
land known as Kings tract lying on the west side of Candlers Mountaining
containing as is supposed about 130 acres I give in lake manner to the
Trustee as aforesaid the following Stocks. To wit Ten Shares in the Lynchburg
and Salem Turnpike road. Seven Shares in the Lynchburg Hoes and fire insurance
Company four Shares in the Bank of Virginia and two shares in the Rocky
Mount Turnpike road Company now Standing on the books of the Company in
my son James H. Perkins name as originally subscribed by me and paid for
him. I also give in like manner to Wm A. Clement as Trustee for James
H. Perkins and Amanda his wife for and during their lifetimes Five Slaves
namely Pleasant and Sophia children of Isabelle who has recently died
whilst in my Sons possession Louisa and her two children Susan and Cinda
none of which property thus bestowed in trust to Wm A. Clement for the
benefit of my son James H. Perkins and Amanda his wife during their lives
and to enable them to raise and School their children is in any way to
be subject to the payment of my son James H. Perkins present debt or debts
which he may hereafter contract other than the necessary means of support
for Self and family and Schooling of their children and to then with the
consent and approbation of the Trustee to be given but is to be held by
him the Trustee whose duty is hereby injoined to be to see that none of
the Estate is wasted but on the contrary to see that its value be enhanced
as much as possible during the lifetimes of both my son James H. Perkins
and Amanda his wife and at their deaths it is my will wish and desire
for the children of my son James H. Perkins and Amanda his now three in
number for all of the Estate both real and personal with all the privileges
and all the future increase of the slaves to pass in fee Simple to them
and to all others of the children of them my son and wife which they may
hereafter have in equal portions and I do hereby give and bequeath the
same to them death of their parents forever.
Item 4th To my son Thomas Perkins I as yet have given to him but little
I now give to him three separate and distinct dwelling houses and all
other buildings and privileges thereunto belonging and the lot or piece
of land which they are Situated lying on the West side of the Lynchburg
and Salem Turnpike road between said road and John Crouses lands with
Crouses line from his gate up to my corner in my Yellow house tract and
thence a straight line to be run from this corner in crouses line to the
Turnpike road as a stake Just above an apple tree near the margin of the
road containing in all as is supposed about 3 acres I give to him all
my lands houses and Tenements lying on the southern side and eastern end
of Candlers Mountain with the exception of the land sold to Henry and
James M Armsitead containing as is supposed about 325 acres I give to
him one Negro boy named Daniel Ten shares of my stock in the Lynchburg
and Salem Turnpike road four shares in the Bank of Virginia Seven shares
in the Lynchburg hoes and fire Insurance company and two Shares in the
Rocky Mount Turnpike road all of which stock now stands in the books of
the respective Companies in my name except 2 shares which already stands
in his my sons name as Originally subscribed and paid for by me for him.
I also give to him a small tract or piece of land lying at head and on
both sides of a small branch running from Winstons hill Just below Town
containing about Seventeen acres.
Item 5th I give to my daughter Mary Giles Clement all the property heretofore
given to her which is Slaves money and other things in amount is fully
equal to that given by me to her brother James H. Perkins and I now give
to her my daughter Mary Giles and her husband Wm A. Clement for and during
their Joint lives my moiety or Joint interest in the Tavern house and
all other buildings and privileges connected thereto at Campbell Court
House together with the small tract of land on which they are erected
as purchased by me in conjunction with Wm A. Clement containing --- acres
which said moiety or Joint interest in said tract of Land together with
the Tavern house and all the outer buildings and appurtenances thereunto
belonging or may in any wise belong or appertain to the same hereafter
is as to pass in fee to their present son Richard Pendleton Clement and
to all other issues of them my daughter and her husband Wm A. Clement
in equal portion if they shall have any other children, which said real
estate as one Moiety of said tract house and tenements of every description
I give at the death of their parents to my Grandson Richard Pendleton
Clement and all other of the children of my daughter from her present
wedlock for ever with this condition that in case my said Grandson Richard
P. Clement should die before he arrives at the age of Twenty one years
or before he gets married and has lawful issue from such marriage then
and in that case my will is and I hereby so direct that the said Estate
ascend to his half sister my Grand daughter Mary Elizabeth Perkins to
whom I give the same to in case of the death of her half brother Richard
P. Clement or of his having lawful issue I give to my daughter Mary Giles
two shares of stock in the Lynchburg and Campbell Court House Turnpike
road and Two shares in the Rocky Mount Turnpike Company now standing in
the name of her husband on the books of said Company as originally subscribed
and paid for by me.
Item 6th I give to my son George Perkins all the property heretofore given
to him which in amount is about the same as that given to his brother
Thomas Perkins. I now give to him my Brick Tobacco Factory process screws
and all other fixtures appertaining to the establishment together with
the lot of land containing five acres and 13/16 of acres as purchased
of Wm. Daniel and all other buildings erected thereon I also give to him
the balance of my Yellow house tract of land as not sold to Henry Lazenby
and given to his Brother Thomass in the 4th article of this my will. I
give him my Grist and Saw Mill and dwelling house and ground on which
they are erected on Rock Castle Creek containing abut 10 acres as a mill
seat. I give to him two slaves Margaret and Anthony one feather bed bed
stead and furniture Ten shares of Stock in the Lynchburg and Salem Turnpike
road. Seven shares in the Lynchburg Hoes and fire Insurance Company. Four
shares in the Bank of Virginia and Two shares in the Rocky Mount Turnpike
al of which stock is now standing on the books of the respective Companies
in my name except two shares in the Rocky Mount road which stands in his
name as subscribed and paid for by me for him.
Item 7th to my daughter Lucie Jane Perkins I have given nothing as yet
and I now give to her and the heirs of her body forever. The tract of
land purchased by me George E. Roberts as per his Deed of record as now
forming a part of my plantation and tract of land as given to my wife
for her lifetime and in addition to this part as purchased of Roberts
I give to her as much more of my tract adjoining the same as a straightline
will include by extending the present line of Roberts tract running eastwardly
to the ditch and dividing fence on the margin of the ditch from my fish
pond and then with the ditch and course of the ditch on a straight line
to my back line next to the City of Lynchburg in Alexander Liggatts land
and thence with Liggetts line to the Corner of the tract bought of Roberts
in Davises line containing in all as supposed about one hundred and thirty
acres. I give to her Five Slaves namely William, Maria, Alley and her
two children Anderson and Buick. I give to her Ten shares of Stock in
the Lynchburg and Salem Turnpike road. Four shares of stock in the Bank
of Virginia. Seven Shares in the Lynchburg Hoes and fire Insurance Company
and two shares in the Rocky Mount Turnpike road as standing now in my
name on the Books of the respective companies except two shares as originally
subscribed and paid for by me for her I give her one feather bed bedsteads
and covering such as her mama may Select for her also one Dozen Windsor
chairs.
Item 8th I give to my daughter Martha Ann Gaines wife of Gent Jno W. Gaines
of Kentucky whose name should have been mentioned in the 7th Item agreeable
to the routine of my children's ages She being older than her sister Lucie
Jane but was unexpectedly omitted by me, all the property heretofore given
to her which in Slaves and other kind of property including Five hundred
dollars recently sent to her Husband John W. Gaines in check on the Bank
of Kentucky is in amount equal to that heretofore given to any one of
the rest of my children I now give to her one young Negro man named Edward.
Thirty six shares of my Stock in the Lynchburg and Salem Turnpike Company.
Twenty two shares in the Lynchburg hoes and fire Insurance Company. Four
shares in the Lynchburg and Pittsylvania Turnpike road. Four shares in
the Bank of Virginia. Eight shares in the Virginia and Tennessee Rail
Road company, and, six share in the Rocky Mount Turnpike road all of which
stock is now standing on the Books of the respective companies except
two shares in the name of her husband John W. Gaines as Originally subscribed
by me and paid for him. It will be seen that I have given to my daughter
Martha Ann Gaines no lands instead of which I have given to her Stocks
in different incorporated Companies as an equivalent for the lands given
to the rest of children my Daughter living in a distant State caused me
to make the bequests in stocks rather than lands which m ay suit best.
Item 9th I give to my son Walter my youngest child to whom I have given
nothing, one Negro boy named Watson my riding house saddle and bridle
my gold watch Shot gun, and walking cane on which the name of his deceased
Brother Richard is inscribed as also the initials of my name which stick
I wish him to keep as long as he lives and then leave the same in the
hands of some member of the family, I also give to him at the death of
his mother all the property which I have bestowed upon her for life of
every kind and description whatever both real and personal say lands household
and kitchen furniture Stock of horses cattle sheep and hogs, crop of every
kind that may be on the place at the time of the death of my wife. Several
of the Slaves is now quite old and may be past labour at the death of
my wife which is to be kept and maintained by my son Walter Perkins during
their lifetimes.
Item 10th I give to my Grand daughter Mary Elizabeth Perkins and to the
heirs of her body forever one light coloured girl named Mary I also give
to her a lot of about three acres of ground lying on the west side of
the Lynchburg and Salem Turnpike road Just above the 1st Toll gate on
Said road with all the buildings thereon I give to her one bed bedstead
and furniture and two shares of stock in the Lynchburg and Campbell Court
House road Turnpike road to be possessed of by her whenever she shall
arrive at the age of twenty one years or sooner if she shall get married
conditioned that in case she my Grand Daughter Mary Elizabeth Perkins
should die before she arrives at the age of Twenty one years or before
having lawful issue in case she should get married then in either of these
cases it is my will wish and desire and I now so direct that the slave
Mary with all increase if any from her the house and lot of ground and
shares in the Lynchburg Turnpike road shall revert back to my Estate and
be equally divided among all of my children agreeable to the law regulating
Intestate Estates.
Item 11th All and every thing belong to me if any, which I may have omitted
to enumerate and will away and all and every thing that I may hereafter
possess or my Estate be entitled is to be equally divided among all of
my children.
Item 12th Revoking all other wills I do hereby appoint my two sons Thos.
Perkins and George Perkins and Wm A. Clement Executors to this my last
will and Testament as witness whereunto I have set my hand and Seal this
7th day of June in the year of the Lord Eight hundred and fifty four.
I acknowledge the hand of God and his almighty power in the creation and
preservation of all things glorify his most holy name for the preservation
of my life to the present time and the multiplied benefits bestowed on
me through past life put all my trust in his good providence for every
thing needful hereafter resign myself to all his future dispensation and
in death hope to meet him through the merits of our Lord and Saviour Jesus
Christ in peace.
At a County Court convened and held for Campbell County August 14th 1860
The last will and testament of Richard Perkins decd. was presented and
it appearing to the satisfaction of the Court by inspection of the same
as well as from examination of witnesses that said will is wholly in the
hand writing of the testator the same is ordered to be recorded
