This Indenture Made this fourth day of September in the year of our Lord
one thousand Seven Hundred and Seventy two Between Thomas Callaway Sen.r
of the County of Pittsylvania of the one part and James
Clement of the aforesd. County of the other part. Witnesseth that
the said Thomas Callaway Sen.r for and in Consideration of the Sum of
One Hundred pounds Current Money of Virginia to him in hand paid the Receipt
whereof he doth hereby acknowledge hath granted Bargained Sold aliened
Enfeoffed and Confirmed and by these Presents do grant bargain Sell alien
enfeoff & Confirm unto the said James
Clement his heirs and assigns one Sartain Tract or parcel Land lying
and being in Pittsylv.a County aforesaid on the South fork of Sandy River
containing One Hundred acres more or less an Bounded by lines it being
the place where the said Thomas Callaway now lives on two or three acres
Excepted for the use of the Mill Bounded by a line and the Reversion and
Reversions Remainder and Remainders thereof all the Estate Right Title
Interest Claim and Demand Whatsoever of him the said Thomas Callaway Sen.r
of in and to the said Land and Premises and every part and parcel thereof
To have and to hold the Said Land and Premises with the appurtenances
unto the said James Clements
his heirs and assigns forever and the said Tho.s Callaway Sen.r does hereby
for himself his heirs Exe.c Adm.r and assigns Covenant Promise and agree
to and with the said James Clement
his heirs and assigns against all Persons Whatsoever Shall and Will Warrant
and forever Defend In Witness whereof the said Thomas Callaway Sen.r hath
hereunto Set his hand and affixed his Seal the Day and year first within
