The Defendants being Summoned and Not Appearing, altho Solemnly Called,
the plantif by his Attorney produced the Said Defendants Bill final for
the Sum of Two pounds eighteen shillings. Judgment is therefor granted
to the plaintif against the said Defendants for the same with Costs. But
this Judgment Except as to the Costs, is to be discharged by the payment
of One Pound Nine Shillings with Interest thereon at the rate of five
per Centum per Annum from the Eighth day of December One thousand seven
hundred and eighty eight Until paid. Costs 5 # Tobacco at 10/5 pt 30 of
ditto at 12/6 of 71 6 Attorney fee
This day Came as well the plaintif by his attorney as the said Defendants in their proper persons & the said Defendants Confessing the plaintifs action Thereof it is Considered by the Court that the plaintif Recover against the Said Defendants the Sum of Fifteen pounds twelve shillings the Debt in the Declaration Mentioned together with his Costs by him about his Suit in this behalf appended & the said Defendants in Mercy & c. But this Judgment (Except as to the Costs) is to be discharged by the payment of Seven pounds Sixteen Shillings with Interest thereon at the Rate of five per Centum Per Annum from the 25th day of December 1788 til payment Costs 122 # Tobacco at 10/5 pc 60 # of ditto at 12/6 & 16/6. Attorney fee & tax this Judgement is to have Credit for L5.8.4 Received of Stephen Coleman Page 36 - 15 August 1791
This day came well the plaintiff by his attorney as the Said defendants in their proper persons & the said Defendants confessing the plaintifs Demand for One pound Sixteen shillings to be Just therefore Judgment is Granted the Plaintiff against the said Defendants for the same with Costs with Interest thereon at the rate of five per Centum per Annum from the 10th day of December 1789 Until paid Costs 160 # Tobacco at 12/6 pc & 71 6 Attorney fee Page 128 - 20 August 1792Ordered that Isaac Clements pay Blanks Moody 150 # of Tobacco at 12/6 po for 6 days attendance as a Witness for him against Daniel Bruce Page 169 - November 1792
Charles Lewis jr. Undertakes for the defendant that in Case he is Cast in the plea aforesaid that he shall Pay the Costs and Condemnation of the Court or Remand his Body to prison in execution for the same or that he the said Charles Lewis jr. will do it for him and the said defendant Comes and defends the force and Injury When & c. and for plea saith cc Vachell Clements ? Alexander Garden ass.ee In Debt Pittsylv.a ? This day Came the said Vachell by H. Townes his attorney and defends the force & Injury when and where ? ? and for plea saith that he Never Signed Sealed or delivered any Bond Deed or Writing Whereby to charge himself with the payment of any Money or other thing in manner and form alledged by the said Alexander Ass. aleges and this he is ready to Verify H. Townes Att.y of Deft. & of this he puts himself in the Country and the said Plaintiff Home of likewise & the Trial of the issue is Referred untill the next quarter Session Page 202 - March 1793
This day came the parties by the attornies and thereupon came also a
Jury to wit John Dyer James Dalton John Rieger Vachel
Clements Thomas Hoskins John Dyer Frederick Trump Matthew Spanks Abraham
Parrish James Garner and Charles Boothe Who being Checked treyed and Sworn
Well and Truely to try the Issue joined on the Cause, On their Oaths do
say that the said Defendant doth Owe to the Plaintiff the debt in the
Declaration Mentioned in Manner and form as the plaintiff hath alledged
and do assess the damages of him the said plaintiff by reason of the detention
of that debt besides his Costs to One penny, Therefore it is so ordered
by the Court that the plaintiff recover against the Said Defendant the
Sum of Two Pounds current Money the Debt mentioned in the Declaration
with 5 per Cent Interest thereon from the 29th day of December 1785 till
Payment together with damages by the Jurors in form aforesaid Assessd
and his Costs by him aback his suit in this behalf expanded to be Levyed
of the Goods and Chattels of the Said Estate in the hands of the said
Executor to be Administred if so much thereof he has in his hands to be
Administred and if not then the Costs to be Levied of his Own proper Goods
and Chattels Costs 55 of Tobacco @ 10/5 pc 30 of ditto @ 12/6 16 9 Cents
One Dollar & 1/6
This day came the Parties by their Attornies and the said Defendant making Oath that he never gave a Note of hand as mentioned in the Plaintiffs Declaration therefore it is Ordered that this suit be Dismissed and that the Defendant recover against the said Plaintiff his Costs Costs by him about his defence in his behalf Expended The Defendants Costs. 15# of Tobacco @ 10/5 pc. 84 cents & 15/ |
