It appearing to the Court from the affidavit of Thomas Rawlins that the
Defendants have had legal notice of this motion, and they not appearing
altho Solemnly called, on the motion of the Plaintiff by his attorney it
is considered by the Court that the Plaintiff recover against the said Defendants
Thirty four Dollars the Penalty of the Bond aforesaid together with the
Cost of this motion and the Said Defendants in Mercy & But this Judgment
is to be discharged by the payment of Seventeen Dollars and ten Cents with
Interest thereon at Six Per Centum Per Annum from the 10th day of September
1808 till paid and the Costs.

in this Suit are referred to the final determination of ? Cole, David Hunt
and William Smith or any two of them whom award thereupon is to be made
