  John Hamlin from Clements & Tucker
This Indenture made and entered into this Twenty ninth day of November one Thousand Eight hundred and forty five between Johnson Clements and William P Tucker of the county of Surry and State of North Carolina of the first part and John Hamlin of the county of Rockingham and State of North Carolina of the Second part Witnesseth that the Said Johnson Clements and William P Tucker for and in consideration of the Sum of four thousand dollars to them in hand paid by the said John Hamlin at the time of Executing these presents the receipt whereof is hereby acknowledged hath granted bargained and Sold aliened conveyed confirmed and delivered and by these presents doth grant bargain sell alien convey and confirm and deliver unto the said John Hamlin his heirs and assigns a certain tract or parcel of land lying and being in the county of Surry aforesaid on the yadkin River it being the same tract whereon the said Johnson Clements now resides and bounded as follows that is to Say Beginning at a burch on the North Bank of the yadkin River near the mouth of Hogans creek running North eighty poles to a stake thence along Jeremiah Earleys line to a white oak corner near Hogans creek thence west along Daltons line known by the name of Freemans five hundred acre tract to Haffords branch known by the name of Haffords litle branch or the bulge branch which branch is the boundary line of Charles L. Chrissmons land on the East thence Down the meanders of the Branch to the River thence down the meanders of the River to the Beginning including part of two tracts of land one the tract of land conveyed to Morgan Bryan by the Earl of Granville the other conveyed to Joshua Freeman by the State containing seven hundred and forty nine acres more or less also one other tract bounded as follows Beginning at a walnut on the west side of Hogans Creek thence running a west course untill it intersects with the old line of Samuel Freemon deceased thence a south course to the old road thence along the old road an East course to the creek at the old pool crossway below the ford thence a North East course to a Sickamore thence North to a walnut tree then up the mill pond Crossing the Creek a North Course to the Beginning walnut including Seventeen acres more or less including a mill the whole of the two tracts containing by estimation Seven hundred and forty acres more or less to have and to hold the Said lands and premises and all and Singular the tenements hereditaments woods ways waters mines minerals improvements rents issues profits remainders priviledges and appurtenances thereunto belonging or in any wise appertaining to him the Said John Hamlin his heirs and assigns to his and their own proper use and behoof in fee Simple forever and the Said Johnson Clements and William P Tucker and their heirs all and Singular the premises hereby conveyed to the Said John Hamlin his heirs and assigns shall and will warrant and forever defend from the lawful claim or claims of any and all persons whatsoever and lastly the Said Johnson Clements and William P Tucker for themselves their heirs Executors and administrators hath covenanted and agreed and by these presents doth covenant and agree to and with the Said John Hamlin his heirs and assigns that they are now at the time of Executing these presents Seized of a good Sure and indefeasible estate of inheritance in the aforesaid land and premises and that they have full power and lawful authority to convey the same in manner and form aforesaid and that the Said John Hamlin his heirs and assigns shall hence forward have and hold peaceable possession and quiet enjoyments of the Same free from any and all Judgement Executions leases mortgages trusts or cognizances dower rights and all other incumbrances heretofore accrued done or suffered by the Said Johnson Clement and William P Tucker or any other person whatsoever or hereafter to accrue be done or Suffered by them or any other person for them in their own right or by their procurement
