The last will and testament of Samuel Smith Colby follows (Vol. 433, pages 408 - 411):

I, Samuel Smith Colby of Salisbury in the County of Essex and the Commonwealth of Massachusetts, being of sound and disposing mind and memory, do make and publish this my last will and testament, hereby revoking all former wills by me made.

First, I direct that all my just debts and funeral charges be paid as soon as conveniently may be after my decease.

Second, I give my wife, Eliza A. Colby, one thousand dollars, and all my household furniture, wearing apparel, silver ware, books, pictures, tools, and all other household and housekeeping articles, whether of use or ornament, in my house or store, to her own use forever.

Third, I give and devise to my wife, Eliza A. Colby, my homestead estate in Salisbury where I now reside, including as a part thereof all my land on the opposite or southerly side of the street, lying between said street and the Merrimack River, and between land of William E. Morrill on the west and land of Ezra Merrill on the east, with my store or shop thereon, to have and to hold the same to my wife, her heirs and assign forever.

Fourth, I give and bequeth to Sam Lowell, son of the late John S. Lowell, five hundred dollars to his own use forever.

Fifth, I give, devise and bequeth the use, improvement and income of all rest, residue and remainder of my property and estate both real and personal of every name and nature and whersoever situated of which I shall die ( ? ), possessed or in any way entitled to, to my wife, Eliza A. Colby for and during her natural life.

Sixth, upon the death of my said wife, Eliza A. Colby, I give to my friend, William H. Merrill of said Salisbury, my five shares of the capital stock of the Portland, Saco and Portsmouth Railroad Company to his own use forever (note: see will of Eliza Colby. She willed this stock to her widowed sister, Hannah Morrill who was married to Amos Morrill).

Seventh, I also give and bequeth after the death of my said wife, to the treasurer or the Committee of the Salisbury Point Cemetery, five hundred dollars to be deposited in some good Savings Bank and the interest to be drawn by the said treasurer or committee semi-annually and used for the benefit of said cemetery as they may think best.

Eighth, I further give and bequeath after the death of my said wife to the treasurer or committee of the Rocky Hill Meeting House five hundred dollars to be deposited in some good Savings Bank, and the interest to be drawn semi-annually to be paid for the repairs on said house, as said committee may think best, so long as said house is used for public purposes. In case said house should be destroyed, I give said sum of five hundred dolllars to the Selectment of the town of Salisbury for the benefit of the sidewalks herein after mentioned.

Ninth, I further give and bequeath after the death of my said wife to the Selectment of the town of Salisbury, two thousand dollars to be used under their direction by the Surveyor of Highways in the district I now reside in laying and constructing a good and substantial side walk on the north side of the street leading from the Powow River Bridge to the estate formerly owned by Jonathan Stevens in such manner and such material as said selectmen may deem proper.(Note: by the time Eliza died in 1896, what had previously been Salisbury Point had become, in 1886, part to the Town of Amesbury. Side walk construction is mentioned in the local newspaper in 1896.)

Tenth, If there is any balance of my property and estate remaining at the death of my said wife, after paying the last four bequests above named, and not herein other wise disposed of, I give, devise and bequeath the same to her then heirs at law forever. I constitute and apppoint William D. Lowell of said Salisbury executor and trustee of this my last will and testament.
In testamony whereof I have hereunto set my hnd and seal and publish and declare this to be my last will and testament in the presence of the witnesses named below this the third day of August, 1878.

Samuel served in the U.S.N., in the Civil War, was living in Gloucester, 1871.

SAMUEL V. COLBY, Sail Maker and Dealer in Cordage, No. 375 Main Street, Babson's Wharf. The headquarters for equipping vessels for the fisheries is Samuel V. Colby, sail maker and dealer in cordage. Mr. Colby is an experienced, practical man to the trade, and was born in Maine. He has been a resident of the city many years, and was formerly master of a fishing vessel. Mr. Colby has been a member of the City Council, and has always been foremost in fostering and advancing every enterprise that was for the public good. His establishment is the largest private sailmaking loft in the country.

She is survived by her parents, Starr and Jean Colby of Atherton; three brothers, Stephen Colby of Boulder, Colo., Peter Colby of Menlo Park and David Colby of Berkeley; and a sister, Betsy Colby of Morgan Hill. Contributions may be sent to the Sara Starr Colby Memorial Fund, c/o the Berkeley Society of Friends, 2151 Vine St., Berkeley, CA 94709. Services have been held.
