William CLEMENT

Was Justice of the Peace and Sheriff of Amelia County; patented land in Amelia County 1735; will proven in that County 1760. Was a planter.

What follows is a transcription of the recorded will of William CLEMENT (d. Feb 1760 Amelia County, VA). The will is dated 18 Feb 1760 and is recorded in Amelia County, Virginia, Will Book 1, pages 157-159. The transcription was made by Marna L. Clemons from a photocopy of Amelia County, Virginia, Will Book 1, pages 157-159 on LDS microfilm #30,449.

In the Name of God Amen the eighteenth Day of February In the year of our Lord Christ One thousand seven hundred And sixty I William Clement Senior of the Parish of Raleigh In the County of Amelia Planter being sick & weak In body but in Perfect memory of mind thanks be given unto Almighty god
therefore Calling to mind the mortality of my body & knowing that it is appointed for all Men once to die Do make and Ordain this to be my last will & Testament that is to say Princibly & first I give And Recommend my soul into the Hands of Almighty god That gave it & my body I recommend to the Earth to be buried at the discretion of my Excrs. not Doubting but at the general resurrection I shall receive the same again by the Almighty Power of God and as touching my Worldly Estate Wherewith it hath Pleased
the Almighty god to bless me with in this life I Give & Demise & Dispose of the same in the same in the following manner & Form.
Item I give to my son Benjamin Clement Two Negroes to wit York & Bess all which I give to him & his Heirs Forever.
Item I give to my son Wm. Clement Caesar & Philis all which I give to him & his heirs for Ever.
Item I give to my son John Clement Two Negroes to wit Ned & Judy paying Twenty Pounds back to the Estate all which I give to him & his Heirs for Ever.
Item I give to my son Francis Clement Two Negroes to wit Jemboy & Hannah also the Land & Plantation & Mill where I now Do live containing three hundred Acres by Estimation to him & his Heirs forever. I also give to my son Francis Clement & his Heirs forever one Hundred & fifty Acres of Land which I bought of George Evins whereon the said George Evins Now do live the said Land being not yet Conveyed to me for which my will is that my Estate Pay the Remainder of the Purchase money & Desire that the said Evins convey the same by Deed to my son Francis Clement And that my Son Francis shall pay thirty Pounds to the Estate at the Death of my Wife.
Item I lend to my Daughter Elizabeth Ellyson Two Negroes to wit During her Natural life Gin & Davey & after her Decease I give Gin to Anne Ford Daughter of Hezekiah Ford Deceased & Davey to Hezekiah Ford Son of the said Hezekiah Deceased.
Item I lend to my Daughter Barshaba Major During her Natural Life Two Negroes to wit Peter & Sarah and Five Pounds Current Money & at the decease of the Bathsheba I Give the said Negroes & money to be Equally Divided Amongst all her Children.
Item I give to my Daughter Ann Pigg Two Negroes to wit Ben & Lucy all which I give to her & her Heirs for ever.
Item I lend to my Loving Wife Ann Clement During her Natural Life all my whole Estate as well the Part before Disposed of as the Part not already Disposed of & at her Decease my will is that the Land I bought of Wm. Ross and all my Estate not Given in Legacy be sold to the highest Bidder sand Equally Divided Amongst my seven Children.
Item my will & Desire is that there be no appraisment nor no Inventory Returned to the Court.

"Like a grandparent proudly but quietly surveying a reunion of enterprising descendants, venerable CLEMENT HILL silently watches over the industrial and commercial growth of the Stauton River Valley (Pittsylvania County, Virginia) at Hurt.
" A Virginia Historical Marker commorating CLEMENT HILL and its first owner stands beside US 29 at Hurt=="THE HOUSE ON THE HILL THREE HUNDRED YARDS TO THE WEST WAS THE HOME OF CAPTAIN BENJAMIN CLEMENT, WHO WAS ONE OF THE FIRST MAKER OF GUNPOWDER IN VIRGINIA, 1775. THE LAND GRANT WAS MADE IN 1741."
"Just a few short years ago the marker stood virtually alone, drawing the traveler's attention to the only building of significance nearby, the white structure crowning the hill just to the west, now behind a shopping center.
"The house was built by Captain (of a local militia Ranger Company, organized for protection against hostile Indians) BENJAMIN CLEMENT, probably in the 1770's, CLEMENT had begun amassing land holdings in the area in the 1740's. An area which at the time had recently seen intensive occupation by local natives, the rich lands just to the south of the river sprouted CLEMENT'S own early form
of industrial growth:TOBACCO, water-powered grist mill (he obtained permission to build one, but it is not certain whether he completed it), and--in partnership with CHARLES LYNCH from across the river, the area's first gunpowder mill.
In "The History of Pittsylvania County, Virginia" by MAUYDE CARTER CLEMENT is found, reprinted CHARLES LYNCH'S 1775 letter describing his and BENJAMIN CLEMENT"S success in making salt-petre, principle ingredient in gunpowder. He states "Without (salt-petre) we can have no powder, consequently no means of defense; but with it we shall soon have both." CLEMENT and LYNCH were already
manufacturing fifty pounds per day.
Nearly a century later another leading Pittsylvania name - HURT - became associated with the property when soon-to-become-State Senator JOHN L.HURT bought CLEMENT HILL - the ancestral home of his wife NANNIE CLEMENT. From HURT, CLEMENT HILL passed to his nephew, also named JOHN L. HURT JR, a philantropist bent on bringing prosperty to the residents of northern Pittsylvania through industrial development. From HURT"S efforts came the growth of the town of HURT, he left CLEMENT HILL, formerly home to the CLEMENTS and HURTS who made Hurt possible. In 1986 CLEMENT HILL was purchased by Altavista attorney HAROLD E. PUGH, lifelong resident of HURT, who has since
beautifully restored the building.

There is a land Grant in Charlotte Co., VA for Benjamin Clements in the year of 1768 for 400 acres on Page 261 of the VA County Rec. Quarterly Mag.
1. Benjamin fought in the French and Indian War. He filed papers to collect some type of bounty (money or land) for his particapation. Those papers have since been lost.
2. He married twice. First to Mary Baker and second to Sariah Bailey. I believe Rachel was born to Mary.
3. His father, Capt. Benjamin Clements, was in the Rangers (an early VA Militia) and was the first man to make gunpowder in the colonies (or at least the first to be documented as such). In 1775, the VA Governor figured that the colonists might not use all their gunpowder on Indians and wolves (maybe on Redcoats instead0 and began an contiscating shipments of gunpowder from Europe destined for the Colonists.
In Aug. Capt. Ben's partner, Col. Charles Lynch, published a letter in the VA Gazette proclaiming the excellent quality of the powder, but stating they needed a source of saltpetre (modern emistry--potassium nitrate. He asked all to dig out the dirt floor of their houses and published a recipe on how to boil the dirt and extract the saltpetre from it.

Info: pg.145 "The Combses Genealogy".
When Harrison married Phoebe Francis they settled in "Old Big Bottom", now east Hazard, KY.  He was a river man, building and running flatboats from the mouth of Troublesome Creek as far as New Orleans.
In 1812 he moved to Troublesome Creek where he died.

Henry Combs was my grandfather.  He married Rachael Clements before he came to Kentucky.  They had children as follows: Matthew (my father), Henry, George, James, Stephen and Frank; Bettie, Polly and Winnie. Bettie married Jerry Combs; Winnie married John Miller; Polly, Downey Stacy.

My grandfather moved to Indiana about 1837 or 1838.  He visited KY about 1848.
He reared a large family by his second wife, Phoebe Francis.

George died in Perry on Troublesome. His descendents are still there. Henry married Nancy Brown in New River, NC and reared a family on Big Creek, Perry County. Frank married Bettie Oliver first, second Polly Couch, lived and died in Perry. Stephen lived and died in Breathitt.

My father married Frankie Brown on New River, (sister to) my Aunt Nancy Brown (who was married to Henry Combs). His children were: Aaron, Alfred, Matthew, Henry, Richard, Isaac B., Wm. M., Nathan, Rachel.

Aaron married Ruth Dickerson; Alfred, Peggy Noble; Matthew, Sallie Williams; Henry, Tempie Davis; Richard, Polly Back; Isaac B., Louvisa McIntyre; Wm. M., Jane Combs, daughter of Washington and grandaughter of Mason Combs, one of the original Combes; Nathan married Miss Cline of Arkansas and is still living there.  Rachael married Isaac Back.

Alfred and Henry lived and died on Troublesome in Breathitt.  Aaron and Matthew lived and died in Missouri; Richard in Montgomery Co., Ky. Isaac B., in Wolfe County, Ky., Rachael on Quicksand, Breathitt Co., Ky,

"I was born in ............Co., KY 1812. My father Martin Couch came to Ky.  from New River (on Holston). Old John Campbell's wife was my father's sister.  Old James Lewis' wife was another.

My father settled at the Mouth of Lick Branch in Perry County. He had seven sons, Joe, Thomas, Eli, John, Charlie, Ira. All these are dead but me. He had a brother John who came with him. John had sons: Wm., Andy, Lige, Dick, the latter died young. My father also had another brother James whose son lives in Clay "Stutter" John.

My grandfather John Couch came with them.... My mother was Sally Hall, Aunt of Philip Hall. They came a long time before I was born. My father was born before his parents came here."

In the above letter please let me add a couple of things that I know as the great-grandson of "SI" Couch. JPD

Martin and Sally Hall Couch were both born in 1785 and were both listed in the 1850 Perry Co., KY census. One of them died in 1856. The other shortly after.  John Couch, father of Martin, is listed in the 1830 Perry Co. Census.

Polly Couch, d/o John Couch, was the wife of "Old John" Campbell. Sallie Couch, d/o John Couch, was the w/o James Lewis II. Both were sisters of Martin Couch.

If Sarah is the Aunt of Philip Hall, as the article states, she must be the d/o of John Hall SR who married Mary "Polly" Hash in Grayson Co., NC. Her father never came to KY. I have proof of lineage in my files. JPD

I have picture of Eli and Polly in my files. Also have 4 deeds with her name on them. Have been to her grave in Hazard Cemetery alongside Eli just inside the gate.  Have pictures of graves of Eli and Polly.
Polly is buried just inside Hazard Cemetery, alongside of Elias. Daughter Margaret had child out of wedlock named Cassius. Eli and Polly raised Cassius. He is shown living with them in 1910 Perry Census. Also shown with Eli as his guardian in school census. It is also possible that Polly died in 1910 and was not buried until a year later. This was sometimes the custom to have the funeral a year later. See Records of Dr. Luke COMBS and also records of William O'Connnor. Also 1850 Census of Perry Co.

Elias was a Civil War Vet in the Union Army. He was in the Three Forks Batallion. Eli was in Company #1, 14th Cavalry. I have record. He was also in the 19th Regiment Infantry of KY. He became ill in VA and Matt Horn told me my great-grandmother, Polly Combs Couch, took 2 pack mules over the mountains, found him, and nursed him back to health in Hazard, KY. In 1920 Elias is enumerated with Matt Horn
(High St.) Relationship grandfather. Also enumerated is a Eli Couch 79 Perry V78 s24 l29 with Nancy 59. Eli has land grant of 200 acres in Book 71, Page 259, dated 8/23/1865 on Big Creek in Perry Co., KY.
Marriage in Book B Perry Co., KY. #B117. Elias' "nickname" was "Gaitors", which referred to him reportedly "dancing out of his shoes". I would have loved to have known him. I was about a year old
when he died. I'm sure my mother made sure he knew me! An article in the Perry Newspaper in 1911 reported that Eli had been bitten by a "huge rattlesnake, which he immediately killed. A Dr. Denham stayed overnite with him and he survived." I have picture of Elias and Polly Couch in my files. Also have picture of Ira and Perminia Couch in my files. Death Cert. #1484. 1910 Census shows Eli 71 m 53 Years  Polly  71, Cassius 07, GS DUFF, James 44 m 2d time Boarder with wife Sally 24. Eli was in Three Forks Batallion Enrolled Militia. William Eversole was Captain. The following description of Eli Couch is on
veteran records: Eli Couch, Private, age 23 years. Enlisted 8/12/1864 at Booneville, KY. Mustered into service, 8/17/1864 at Booneville, KY. Owed Federal Gov't $63.50 for used clothing allotment. Owed $5.15 for last haversack, belt, belt plate and cap pouch. Where born: Perry Co., KY. Black eyes, Black hair, dark complexion. 5-foot, 6-inches tall. Eli and Polly were charter members of the First Missionary Baptist Church organized on 8/27/1898. Rev. A.B. Petrey was Pastor. (DAR Book).  Record of death is in Engle Funeral Home Records. JPD

Combs was red headed and blue eyed.  Children were Bud, Jim, Maker Combs Gentry, Nan Combs Gladden, Dixie Combs Crabtree.
He is wearing his uniform from war in picture.

Notes for LAURA J. OSBORNE:
The book, "Fouke, Arkansas In Words and Pictures, 1891-1941".  Vol. 1, page 46 states that "she was full
blooded Indian".
