(Land Grant to John Irvine McLeod)

The 100 acres that was originally "granted" to Hector McLeod appears never to have been actually approved as a grant. Accordingly, in 1877, Hector's son, John I. McLeod, applied for approval of the grant and the following is the documentation in this regard.


Affidavit of John Irvine McLeod


John Irvine McLeod, Station Master at Ferris Station in the County of Kent make an oath and saith that his father, Hector McLeod, lived for twenty years on a lot of land in the parish of Sussex located to him under the Labour Act, that he lived in a log house during this time. That Hector McLeod sold said lot to Henry Hallet, from whom this deponent purchased the same as will appear by the deed thereof, that after this deponent purchased said lot, he built thereon a frame house 22 feet by eighteen and kept his mother there after the death of his father.

That there are about forty acres cleared on this lot. That the said lot is now leased to Alfred S. Baxter by this deponent.

Grant to John Irvine McLeod


NEW BRUNSWICK.

VICTORIA, by the Grace of GOD, of the United Kingdom of Great Britain and Ireland, QUEEN, Defender of the Faith, &c. To all to whom these Presents shall come, Greeting:

KNOW YE, That We, of Our special grace, certain knowledge, and mere motion, have given and granted, and We do, by these Presents, for Us, Our Heirs and Successors, give and grant unto John Irvine his Heirs and Assigns, a Tract of Land situate in the Parish of Sussex in the County of Kings in Our Province of New Brunswick, and bounded as follows, to-wit:- Beginning at a post standing at the southwesterly angle of lot number twenty five granted to John B. Campbell in the fourth tier block one thence north one degree and fifty minutes east seventy two chains thence north eighty eight degrees and ten minutes west fifteen chains thence south one degree and fifty minutes west seventy two chains to a post and thence south eighty eight degrees and ten minutes east fifteen chains to the place of beginning containing One Hundred acres more or less and distinguished as lot number twenty six in the fourth tier block One

and also particularly described or marked on the Plot or Plan of Survey hereunto annexed; together with all profits, commodities, hereditaments and appurtenances whatsoever thereunto belonging, or in any wise appertaining; except and reserved, nevertheless, out of this present Grant, to Us, Our Heirs and Successors, all Coals, and also all Gold and Silver, and other Mines and Minerals: TO HAVE AND TO HOLD the said tract of Land, and all and singular the Premises hereby granted, with their appurtenances, (except before excepted), unto the said John Irvine McLeod his Heirs and Assigns, FOR EVER.

PROVIDED ALWAYS, and this present Grant is upon condition, that the same Grant be registered in the Secretary's Office of Our said Province of New Brunswick to which Registry shall be attached a Duplicate of the Plan hereunto annexed.

GIVEN under the Great Seal of Our Province of New Brunswick.

WITNESS, our Trusty and well beloved His Honor the Honorable Samuel Leonard Tilley C.B. Our Lieutenant Governor of Our said Province, at Fredericton, the seventeenth day of May in the Year of Our Lord one thousand eight hundred and seventy eight and in the forty-first Year of Our Reign.
