The Distribution of the Estate of Elisha Edgerton

   We the subscribers being appointed by the Honorable Court of Probate for the district of Norwich to make a division of the Estate of Capt. Elisha Edgerton Junr. Late of Norwich deceased to the widdow and among the heirs of said deceased according to Law and being duly sworn have attended and performed said service accordingly –

   viz. We have set out to Elisabeth Edgerton the widdow and relict of said deceased two several pieces of land with the bedroom on the lower floor the back or northwesterly side of the house where said deceased dwelt and the chamber over the kitchen and a right in the kitchen to do her washing cooking and other necessary business with a privilege in these rooms and to set a cubbard in the shed at the west corner of the house with a privilege in the cellar and garret and also privilege to pass to and from said different parts of said house to her set as shall be necessary and convenient and also to the well.  We have also set to said widdow the one half of the stable in the easterly side of the barn that half at the north easterly corner of said barn with the whole of the scaffold over all the stables in said barn with a privilege in the barn floor for the necessary purposes for which said floor is designed, with privilege to pass to and from said barn.  The first of the aforesaid pieces of land contains thirty six acres and 117 rods and is bounded as follows beginning by a stone wall a few feet northerly from the northwesterly corner of the house and in a line with the back side of said house then north 41o east nine rods to a heap of stones in the orchard then south 65o east twelve rods to a stone wall the southeasterly side of the lane that leads from the house to Norwich Town thence by said lane north 43o east eighteen and a half rods to an oak tree then south 44½o east twelve rods to a cherrytree a bound of Capt. Wheat’s land thence by said Wheat’s land 70o east fifty eight rods and 20 links to a heap of stones then south 39o west fifty rods to a heap of stones then north 45½o west twenty two rods across the meadow to a heap of stones by the fence under the hill then north 49o east sixteen rods to a heap of stones then north 47o west twenty five rods and 15 links then south 90o west three rods and 8 links then south 48o west eight rods then north 50o west seventeen rods and 7 links then north 38½o east seventeen rods and 10 links to a walnut tree the by day house then north 74o east six rods and 5 links to a bound below the wall then north 39½o west six rods and two links to the first corner –

   The second piece contains five acres and twenty rods and is bounded as follows beginning at a heap of stones by the lane thence as said lane runs north 66o east eleven rods and 12 links then south 81o east sixteen rods and 11 links then south 40o east twelve rods then by Capt. Wheat’s land north 28o east fifteen rods and 10 links to a bound then north 11o east eleven rods and 17 links then north 60o west ten rods then south 70o west two rods then south 89o west twelve rods then north 48o west ten rods the forgoing lines being lines of Capt. Samuel Wheats land then by land set out ot Martin the youngest son of said deceased, south 22o west thirty rods and 20 links to the first corner, which two pieces of land with the bedroom and chamber and the other privileges in the house and barn above described, with the apportenances thereof we have set out to said widdow as her Right of Dower or Third in the real estate of said deceased for her use and improvement during the term of her natural life.  We have also set out to said widdow her thirds in the personal estate amounting to the sum of one hundred and twenty four pounds twelve shillings.

   We have set out to Simon Edgerton eldest son of said deceased four shares in the real estate that is to say two shares that belong to him as eldest son of said deceased and the parts belonging to Polly Huntington and Lucy Rogers, two of the daughters of said deceased, he having purchased their parts of them (viz.)  in two several pieces of land the first of which is that on which the house and barn stands and contains thirty three acres and 111 rods with all the house, barn and other buildings except what is before set out the the widdow and is bounded as follows beginning by the lane near an oak tree at the southerly corner of land set out to Martin then by said Martin’s part north 44o west twenty four rods and 10 links then north 25o west nine rods and 8 links then south 65½o west ten rods and 6 links then south 58o west fifteen rods and 8 links then north 28o west twenty two rods and 12 links to Daniel Huntington’s land then by said Huntington’s land and land of Andrew Edgerton south 69o west forty two rods then south 7o east thirty five rods and 12 links to an oak tree a bound of James Rogers’ land then by said Rogers’ land south 75o west twenty rods and 17 links then south 10o east by Eleazer and James Rogers Junr. land forty rods and 17 links then north 70½o east by Gurdon’s part and land set out to the heirs of Mrs. Davidson and to Elisha Weston forty five rods and 5 links to a heap of stones at the lane the bound at the westerly corner of the thirds then by said thirds north 52o east twenty five rods and 6 links then north 38½o east seventeen rods and 10 links to a walnut tree by the hayhouse then north 74o east six rods and 5 links then north 39½o west six rods and 2 links to a bound in the line with the back side of the house then north 41o east nine rods to a heap of stones in the orchard then south 65o east twelve rods to the lane then by the lane the line of the thirds to the first corner – the other piece contains four acres and is bounded as follows beginning at a heap of stones in the line of Capt. Wheat’s land a bound of the widows thirds and Martin’s land then by Martin’s part south 12o west forty two rods to Capt. Wheat’s land then by said Wheat’s land south 84½o east sixteen rods then north 13o east thirty seven rods and 17 links to said Wheat’s land then by said Wheat’s land sixteen rods and 20 links to the first corner – We have set to said Simon his part of the personal estate amounting to sixty two pounds six shillings. –

   We have set to Polly Huntington, a daughter of said deceased, her part of the personal estate to the amount of £31:3 which she has already received of the administrator –

   We have also set to Lucy Rogers her part of the personal estate £31:3 which she has also received of the administrator.

   We have set to Gurdon Edgerton, a son of said deceased, two pieces of land the first of which contains eleven acres and 65 rods and is bounded as follows beginning at a heap of stones a bound of Simon’s part in the line of Eleazer and James Rogers Junr. land then by said Rogers’ land south 7o east thirty two rods and 7 links then by James Rogers’ land north 77½o east twenty one rods and 10 links then south 13½o east fifty nine rods and 7 links then south 28o east two rods and 20 links then by Joshua Maples’ land south 88o east eight rods and 6 links then by James Rogers’ land north 48o east eight rods and 13 links then north 10½o east sixteen rods and 15 links then north 30o east eighty three rods to a heap of stones in the line of land set out to Simon then by Simon’s land south 70½o west eighteen rods to the first bound – the second piece contains one acre and 49 rods and is bounded as follows beginning by the highway that leads from town to James Rogers’ at the corner of Capt. Wheat’s land then by said Wheat’s land north 70o west twenty four rods and 5 links then south 3o west by land set to Elisha Weston eleven rods to a heap of stones then south 69o east eighteen rods to the highway then by the highway ten rods and 10 links to the first corner – We have also set to said Gurdon his part of the personal estate to the amount of £31:3. –

   We have set to Martin Edgerton, a son of said deceased, two pieces of land the first of which contains eleven acres and seven rods and is bounded as follows beginning at the lane at the easterly corner of Simon’s land then by Simon’s part north 44o west twenty four rods and 10 links then north 25o west nine rods and 8 links then south 65½o west ten rods and 6 links then south 58o west fifteen rods and 8 links then north 28o west twenty two rods and 12 links to Daniel Huntington’s land then by said Huntington’s land north 69o east fifty eight rods then by Capt. Wheat’s land south 48o east twenty two rods then by the thirds south 22o west thirty rods and 20 links to the lane then by the lane to the first corner – the second piece contains two acres and 159 rods and is bounded as follows beginning at the line of Capt. Wheat’s land a bound of the third and of Simon’s land then by the thirds south 39o west fifty rods to Capt. Wheat’s land then by said Wheat’s land south 84½o east twenty two rods and 20 links then north 12o east by Simon’s land forty two rods to the first corner – We have also set to said Martin his part of the personal estate amounting to £31:3. –

   We have set out to Elisha Weston the only heir of Betsey Weston eldest daughter of said deceased two pieces of land the first of which contains nine acres and is bounded as follows beginning at a heap of stones in the line of Capt. Wheat’s land the southeasterly corner of Simon’s land then by said Wheat’s land south 84½o forty seven rods and 5 links then by land set to Mrs. Davidson’s heirs and to Gurdon north 3o east twenty six rods and 10 links to Capt. Wheat’s land then by said Wheat’s land forty two rods and 5 links to the land set to Simon then by Simon’s part south 13o west thirty seven rods and 17 links to the first corner – the second piece contains four acres and 140 rods and is bounded as follows beginning by the lane at a heap of stones at the westerly corner of the third then by the third south 50o east seventeen rods and 7 links then north 40o east eight rods then north 90o east three rods and 8 links then south 47o east twenty five rods and 15 links then south 49o west sixteen rods then south 45½o east twenty two rods then by Capt. Wheat’s land south 50o west nine rods then south 54½o west seven rods then north 34o east sixty four rods and 10 links to the lane then by the lane three rods and 5 links to the first corner – We have also set to said Elisha his part of the personal estate and improvement of the real amounting to £31:3, which he has received of the administrator in boarding and nursing and schooling. –

   We have set to Sarah Davidson and Lydia Davidson, the children and heirs of Sarah Davidson deceased daughter of said Elisha deceased two pieces of land the first of which contains eleven acres and 60 rods and is bounded as follows beginning at a heap of stones in the lane the westerly bound of land set to Elisha Weston then by land set to Simon south 70½o west twenty four rods then south 30o west by land set to Gurdon eighty three rods to land of James Rogers then by said Rogers’ land north 28o east twenty six and a half rods then north 54½o east four rods and ten links then by land set to Elisha Weston north 34o east sixty four rods and 10 links to the first corner – The other piece contains one acre and 31 rods and is bounded as follows beginning by the highway the southerly corner of land set to Gurdon then by said Gurdon’s land north 69o west eighteen rods to land set to Elisha Weston then by said Elisha’s land south 3o west fifteen rods and ten links to Capt. Wheat’s land then by said Wheat’s land ten rods and 16 links to the highway then by the highway twelve rods and 22 links to the first corner – We have also accounted to them £31:3 personal estate which was by their mother in her lifetime received of said administrator –

   Lastly reserving liberty to and for the widdow to pass and repass on and across such of the aforesaid heirs rights above set out to them as shall be necessary for her to improve her thirds above set out to her – Also liberty to and for said heirs and their assigns to pass and repass on and across such of said heirs rights and the widdows thirds as shall be necessary for them to improve their said rights and at such place or places as shall be convenient passing and least prejudicial to the interest of those heirs whose rights they pass and repass across –
