The will was proved 16 Jun 1869 at Carlisle by James LEIGHTON. Valued under �200. At that time it was noted that Thomas DEWHURST died 18 May 1869.

First I give and devise all that my customary messuage and tenement with all the lands and grounds thereunto belonging called and known by the name of Lowwood, situated lying and being in Witherslack in the said County of Westmorland unto my son Robert DICKINSON of Dawson Fold and James DIXON of Howe both of Lyth aforesaid, their heirs and assigns or to the survivors of them in trust nevertheless and to the intent and purpose that they the said Robert DICKINSON and James DIXON, their heirs and assigns or the survivors of them shall as soon as conveniently after my decease sell or farm or let or otherwise dispose of my estate at Lowwood aforesaid for the most advantage and benefit that may be got for the same and the yearly profits or interest arising therefrom, I give unto my said son Robert DICKINSON to be by him laid out, applied for and towards the maintenance and education of my Grandchildren until such time as my Grandson John DICKINSON shall attain his full age of twenty one years. Then as soon as my said Grandson John shall have attained his full age of twenty-one years old, then I give, grant and devise unto him my said Grandson John DICKINSON, his heirs and assigns all that my customary messuage and tenement called and known by the name of Lowwood aforesaid with all the lands, grounds, closes, enclosures or parcels of land or ground thereunto belonging, situated, lying and being as aforesaid in Witherslack being parcel of the manor or Lordship of Witherslack and holden of the Earl of Derby by and under payment of the yearly customary rent of seventeen shillings and five pence halfpenny. To have and to hold the said customary messuage and tenement, lands, grounds, closes, enclosures or parcels of land or ground thereunto belonging or therewith enjoyed together with its their and every of their rights, members, hereditaments and appurtenances unto my said Grandson John DICKINSON, his heirs and assigns forever subject changed and changeable nevertheless with the payment of such legacies or sums of money as I shall hereinafter mention (that is to say).
First I give and bequeath unto my four Granddaughters, Elizabeth now wife of Thomas TOWNSON, Margaret, Isabel and Anne DICKINSON to each of them the sum of forty pounds apiece, to be paid to them by my said Grandson John DICKINSON out of my messuage, tenement and premises at Lowwood aforesaid at the end of twelve calendar months next after my said Granddaughter Anne DICKINSON shall have attained her full age of twenty one years and in case she happens to die before that time then to be paid at the end of twelve months next after my said Granddaughter Isabel hath attained her full age of twenty one years and my will and mind is that if any of my said Granddaughters should happen to die before their said legacies shall become due and payable then I order that no benefit shall accrue to the survivor of them by such death but that the legacy of such of them as shall happen to die shall become the property of my said Grandson John DICKINSON and not be paid.
Also I give and devise unto my said trustees Robert DICKINSON and James DIXON, their heirs and assigns or to the survivor of them all that my moiety or half part of all that customary, messuage and tenement, lands, grounds and premises called by the name of Bowes Tenement situated, lying and being in Witherslack aforesaid. In trust nevertheless for the uses and purposes hereinafter specified and declared (that is to say) that they the said Robert DICKINSON and James DIXON or the survivor of them shall let and to farm let all my said share of the estate called Bowes Tenement aforesaid until my Grandson Frank DICKINSON shall attain his full age of twenty one years and the rents and yearly profits thereof to be paid out by my said trustees in and for the support and education of my Grandchildren that are in their minority. And as soon as my said Grandson Frank shall have attained his full age of twenty one years, then I give grant and devise unto my said Grandson Frank DICKINSON, his heirs and assigns all that my said moiety, share or half part of all that customary messuage and tenement with the lands, grounds, closes, enclosures and parcels of land or ground thereto belonging and all my right, title, interest or demand of in to or out of the same all which said premises are as aforesaid situated, lying and being in Witherslack and called or commonly known by the name or names of Bowes Tenement or Middle Lowwood. To have and to hold all the said moiety, share or half part of all that said customary messuage and tenement, lands, grounds and premises called Bowes Tenement or Middle Lowwood aforesaid with all and singular rights, mentions, hereditaments and appurtenances thereto belonging unto my said Grandson Frank DICKINSON, his heirs and assigns for ever: subject and charged nevertheless with the payment of such legacies as I shall hereinafter give and bequeath (that is to say).
First, I give and bequeath unto my Grandson Robert DICKINSON of Queen�s College in the University of Oxford the sum of one hundred pounds. Also I give and bequeath unto my Granddaughter Malley DICKINSON the sum of forty pounds. Also I give unto my two Great Grandchildren, Robert and Elinor TOWNSON son and daughter of my said Granddaughter Elizabeth TOWNSON to each of them the sum of twenty pounds apiece, all which said four legacies my will and mind is shall be paid by my said Grandson Frank DICKINSON out of my said moiety or half part of the estate called Bowes Tenement aforesaid to the said legatees at the end of twelve months next after my said Granddaughter Malley hath attained her full age of twenty one years and in case of her death before that time then to be paid at the end of twelve months next after the youngest of the said legatees shall have attained his or her full age of twenty one years, and also my will and mind is that if any of the said four legatees last mentioned should die before their said legacies shall be due and payable, then in such case, I will and order that the legacy or legacies of such of them as shall happen to die shall belong to my said Grandson Frank DICKINSON and not be payable to the surviving legatees.
Also I give unto my Grandson Daniel DICKINSON of Dawson Fold aforesaid my Silver Tankard to be his own absolutely for ever.
All the rest, residue and remainder of my personal estate whatsoever or in whose hands soever, I give and bequeath unto my said son Robert DICKINSON, he paying out of the same all my just debts, funeral expenses and all other contingent charges about this my will and I do hereby nominate constitute and appoint him my said son Robert DICKINSON my sole Executor of this my last will and testament. And lastly, I do hereby resolve and make void all former wills and testaments by me made and do declare this to be my last will and testament. In witness thereof I have hereunto set my hand and seal, the twenty eighth day of December in the year of our Lord, one thousand seven hundred and ninety.

My son George DODGSON to pay to my executors twenty pounds within one year next after my death.
My son Thomas DODGSON to pay to my executors three score pounds, ( forty pounds within one year after my death and twenty pounds within the second year after my death).
If my sons, George and Thomas DODGSON, do not pay the sum of four score pounds before mentioned; then I give my parcel of ground with its appurtenances known by the name of Bonin-field containing by estimation eight acres part of my messuage and tenement at Brendrigge aforesaid unto Myles BATEMAN eldest of Tullithwait and Miles HALEHEAD of Mount-joy both in Underbarrow, yeomen under the yearly rent of five shillings as part of the rent of xviij s. viij d. to be sold by them and from the price thereof I give four score pounds to my executors. The remainder of the said price to be paid to George and Thomas my sons. And if it happen that the said close called Bonnfields be sold as aforesaid for want of payment of the said four score pounds by my said sons George and Thomas DODGSON then my will and mind is that the part and share of all the premises above mentioned which my said son George DODGSON and his heirs shall have by virtue hereof shall be forty pounds at least in value better than what share thereof as may said son Thomas DODGSON and his heirs is to have.
I give to my son Thomas DODGSON a long table in the body steads(?) of the house wherein I now dwell.
To my daughters Ann DODGSON and Jane DODGSON each of them forty pounds to be paid as follows: twenty pounds each in the first year after my death and twenty pounds each within the second year next after my death.
If it happen that what debts are now owing to me from Matthew ..ington, John TURNER and John HARRISON or any of them or any part thereof shall at any time hereafter be gotten by my executors then I give my said daughters Ann and Jane ...... shall so be gotten......., equally to be divided betwixt them.
I give my grandson John DODGSON forty shillings and I will that my said sons George and Thomas nor either of them shall have.............................................................
Item all my household good (not before given) tables, bed stocks, cattle, chattels, rights, debts, credits, moveable and immoveable quick and dead whatsoever and wheresoever together with the fourscore pounds herein mentioned, the same I give and bequeath unto my sons James DODGSON and Robert DODGSON equally to be divided betwixt them.
And I make my sons James and Robert DODGSON joint executors my will, they paying my debts legacies and funeral expenses and discharging what I have before given to their sisters.
I give my fullen mill with its appurtenances being within the precincts of Crook which I purchased of Lancelot LOWTHER of Overstavely unto my sons George DODGSON, Thomas DODGSON, James DODGSON and Robert DODGSON as follows: George DODGSON and Thomas DODGSON to have the use and occupation of the said mill either of them two days in every week, and my said sons James DODGSON and Robert DODGSON to have the use and occupation of the same mill either of them one day in every week my said four sons George, Thomas, James and Robert their heirs and assigns paying the Lords rent thereof and repairing and amending the same proportionately amongst them according to the said shares they have thereof.
I give my supervisors ten shillings each for their pains to be taken herein besides their necessary expenses about this.

All my messuage house wherein I now dwell and all other houses, edifices, buildings. Lands, grounds or Tenements situated at Brundrige in Strickland Kettle which my later father John DODGSON purchased of Roger FISHER of London Mercer, which he gave unto me by his last will, and also the third part of the fullen mill called Green mill unto my eldest son John DODGSON upon condition that he pay thirty pounds to my executors for the benefit of my five younger children: Cornelius, George, James, Margaret and Katherine equally divided amongst them within twelve months next after his entrance there unto and the expiration of the widow estate of my wife.
I give to my third son Jonathan DODGSON the messuage and tenement situated at Beckside in Underbarrow which I lately bought from John and Robert Wilson his son on condition that he pay one hundred pounds to my executors for the use of my five younger children - fifty pounds in the first year and fifty pounds in two years after his entrance thereto and the expiration of my wife�s widow�s estate.
If my said son Jonathan should die before he attains the age of twenty one then I give the said messuage to my fourth son Cornelius DODGSON upon condition that he pay one hundred and fifty pounds within twelve months of his entrance there unto to my executors for the use and benefit of my four youngest children equally between them.
To my son Jonathan one table, one cupboard two garners and one presser and three pair of bedstocks all of them at Beckside in Underbarrow, the same to be in lieu and full satisfaction of his child�s portion of my personal estate.
I give to my eldest son John three tenters of the best I have which he will choose and also the sum of thirty pounds; ten pounds within six months after my decease and twenty pounds immediately after he loose (ie. be free of) his apprenticeship, the same to be in lieu and full satisfaction of his child�s portion of my personal estate.
I give to my second son Thomas DODGSON one hundred pounds to be paid to him by my executors from my personal estate as shortly after he shall be loose of his apprenticeship as possible. This amount to be in lieu and full satisfaction of his child�s portion.
Whereas my loving wife of her own good will and consent has promised to be satisfied and content with the widow estate of my tenement right land, disposing all my personal estate to my children so she may be free from being executrix this my will or collecting my debts yet I give to my wife one bed of clothes in lieu of her widow�s bed and five pounds in money or five pounds worth of goods which she will choose.
I give to my brothers and sisters and my brother in law Henry GARNET and to Thomas DIXON five shillings each.
I give to every one of my servants as shall be living with me at my decease 2 s 6d.
I give unto John TYSON, John GAITESCALL, Miles FREARSON and Martin WILLAN my workmen 2s 6d each.
It is my will that a catalogue be taken of all my books and kept carefully for all my children�s use and benefit during their minority, and when they accomplish the age os xxi years my eldest son to choose and take which of the bibles he likes, and my second son the next and so on every one after in like manner till all the bibles be gone. And the remainder of my boos to be divided amongst my children at the sight and discretion of my executors.
And the remainder of my goods, chattels, cattle etc. I give to my five youngest children Cornelius, George, James, Margaret and Katherine DODGSON equally between them. And my will is that they shall be educated, maintained and brought up according to their degree and calling till they attain the age of twenty on years, and as they attain that age they to receive their equal share of what remains giving a release to my executors for the same.
I nominate my two brothers Thomas and James DODGSON as tutors and guardians to my said children during their minorities.

She to keep all the houses on the said premises in good repair during the said term, my son allowing her to take wood on the premises suitable for all necessary repairs. After her decease I give the said messuage, tenements, lands and hereditments to my son George DODGSON.
It is my will that Abigail my wife shall have the free use of my household goods during her natural life. After her decease I give the same to my son George DODGSON, whom I appoint sole executor of this my last will and testament; and give to him all my goods, chattels, credits, bonds, bills, book debts and personal estate whatsoever and wheresoever he paying all my just debts, legacies and funeral expenses, and allowing my said wife the free use of my household goods for her own use during her natural life as aforesaid.

Nevertheless chargeable and charged with the payment of the annual sum of ten pounds of lawful money of Great Britain to my daughter Elizabeth DODGSON during her natural life as aforesaid.
And whereas there is in my son George DODGSON's hand the sum of thirty five pounds which will become due to my said daughter Elizabeth upon the decease of her aunt Mary BACKHOUSE being a legacy left her by her grandfather Roger BACKHOUSE deceased, it is my will that my son George shall pay her the further sum of fifteen pounds immediately after my decease.
I give to my daughter Anne now wife of John AYREY the sum of one hundred pounds if she be living at the end of twelve months after my death. But if she be then deceased and leave any surviving issue, I give the said sum of one hundred pounds to such child or children if any such be.

I give my burgage house, messuage and tenement in Stricklandgate in Kirkby Kendal where I now live to my dear and loving wife Elizabeth for the term of her natural life and chaste viduity. After her decease or marrying again I give the same to my eldest son Jonathan DODGSON.
I give: my barn in Stricklandgate, and my two closes of freehold land called Bensonwife close and Lowclose in Strickland Kettle, and my three closes of freehold land in Strickland Kettle called Mosscloses, and my freehold tenement lands and grounds called Greatbeckside, Littlebeckside and Atkinsonfolds in Underbarrow (the said three lands being subject to the lives estate therein of Abigail DODGSON my mother), and the residue of my term in the fulling mills at Beck Mills in the said county to Stephen FIELD of Kirkby Kendal Silkmaster and Isaac WILSON of Kirkby Kendal, dyer, for such trusts and purposes as are herein after mentioned.
I give to my wife such of my household goods as she shall choose to the value of eighty pounds.
The residue of my goods and chattels whatsoever (save those in my mother's possession, the use and possession I give to her during her natural life) and the same after her death with all other my personal estate whatsoever I give to Stephen FIELD and Isaac WILSON in trust that they shall out of the yearly profits of the said three closes called Mosscloses pay unto my sister Elizabeth DODGSON ten pounds yearly during her natural life agreeable to the direction of my late father's will.
And that they shall as soon as conveniently may be after my decease sell and dispose of the said barn and two closes called Bensonwife close and Lowclose and also my term in the said mills and also my goods and chattels whatsoever (save those given and disposed by me as aforesaid) in public sale. And also that they shall as soon as may be after the respective deaths of my mother and sister, sell and dispose of the said messuage, tenements, lands and premises in Underbarrow aforesaid and the said closes called Mosscloses and also the said goods in my mother's possession in public sale or otherwise.
Out of the money raised out of my real and personal estate to pay and discharge all my just debts and funeral expenses, and then I give to my wife the sum of two hundred pounds upon condition that she execute to the said Stephen FIELD and Isaac WILSON a proper release of all her dower thirds or widow right in all my said freehold lands and premises.
And the residue of the money arising out of my said real and personal estate (after deducting to themselves all their reasonable and necessary charges) that they the said Stephen FIELD and Isaac WILSON shall place the same at interest upon mortgage or real security by the advise of counsel and the interest yearly arising there from to be applied for the maintenance, education and bringing up of my children Jonathan, Robert, Abigail, Jane, Elizabeth and Ann and the said principal sum I give to my said children equally amongst them to be paid as they attain twenty one years of age or marry. In case any of them shall die in their minority or before his or her legacy shall become due and payable, and without issue of his or their bodies then I give the share and proportion of such child or children so dying to and amongst the survivors or survivor of my children share and share alike.
And provided my said wife bear unto me a child or children after the date hereof then I give such child or children an equal and proportionable share of the money to be raised as aforesaid with and amongst my other children and to have the same benefit of survivorship as my other children.
In case my son Jonathan shall die in his minority and without lawful issue, then I give to my son Robert (after the death or sooner determination of the viduity of my said wife) all that my said burgage house and tenement in Kirkby Kendal.
And in such case he shall also receive an equal share amongst my other children of the money to be raised as aforesaid.
I give the tuition of my said children to my said wife and trustees desiring that they will take great care that they be virtuously and religiously brought up and educated but incase my said wife shall marry again then I give the sole care and tuition of my children to the said trustees and the survivor of them
I appoint Stephen FIELD and Isaac WILSON executors of this my last will and testament and give each of them one guinea

After her marriage or decease I give the said sum of two hundred pounds share and share alike unto my brothers & sisters (to wit) Jonathan & Robert DODGSON, Abigail the wife of John BARROW, Jane the wife of John BACKHOUSE, Merchts. in Lancaster & in case my sister Elizabeth DODGSON marry it is my will that she have an equal share with my brothers & sisters aforesaid.
After all my just debts and funeral expenses are discharged I give the residue of my portion left me by my father aforesaid and five pounds which was a legacy left me by my uncle Robert CHAMBERS deceased and will become due to me after the decease of my aunt Grace CHAMBERS share and share alike, unto my brothers & three sisters aforesaid or to their lawful representatives.

I give all my personal estate to my executors upon thrust that they will dispose of the same and collect all debts that shall be due me at the time of my decease and the money raised devised to them as for my real estate upon trust to pay all my just debts and satisfy themselves for all their costs, charges and expenses attending the execution of the trusts hereby in them reposed and afterward to place out at interest sufficient amounts to raise the yearly sum of eighteen pounds which is to be paid to my dear wife during her natural life and the residue to be given equally to my four children James, Thomas, Mary and Alice to be paid to them when they attain the age of twenty one years at the end of two years after my decease. If any of the four children should die without issue before receiving their share then that share to be divided between my son George and the other surviving children.
After the death of my wife the money set out at interest for the annuity to be equally divided amongst my younger children.

I give to my sons George DODGSON and John DODGSON the said shop and warehouse.
My wife shall release all her dower or thirds at common law in all my closes or parcels of land called Moss Closes in Strickland Kettle hereinafter given to my son John DODGSON.
I give to my wife all my plate, linen, books and household goods and furniture for her own use and also the sum of three hundred pounds in.
I my wife does not release her dower rights then I give the property in Stricklandgate aforementioned to my son George DODGSON and the Moss Closes in Strickland Kettle to my son John subject to the dower rights of my sister in law Elizabeth DODGSON widow of mt late brother Robert DODGSON; and al the plate, line etc and the three hundred pound to be added to my personal estate and effects.
I give all my good, chattels, stock in trade, money, securities and other personal estate and effects to my executors upon special trust to pay all debts, funeral expenses and probate charges and upon the conditions aforesaid to deliver to my wife all my plate, linen etc and pay her three hundred pounds .
And then to place eight hundred pounds in real or personal security and from the interest to pay to my sister in law Elizabeth DODGSON an annuity of thirty pounds according to the will of my later brother Robert DODGSON and a further annuity of thirty shillings agreeable to his request during the term of her chaste viduity and the remainder of such interest added to my personal estate.
I give the interest, income, produce and profits of the rest of my personal estate for the maintenance and education of all my children in their respective minorities; my wife and executors to serve as joint executors. But if my wife remarried then I give the guardianship of such of my children under the age of twenty on to my executors only.
As my children attain the age of twenty one years I give them four hundred pounds.
When my youngest child attains the age to twenty one the remainder of my personal estate to be divide between them.
My executors to deduct for themselves the costs and charges arising out of the discharge of my will.
In addition I give to each of my executors five guineas.

To my three daughters Elizabeth DODGSON, Jane CARR and Abigail DODGSON equally between them all other plate, books, linen, clothes and wearing apparel, household goods and furniture whatsoever and all my money, securities for money and other personal estate and effects subject to the payment of all debts, funeral expenses, probate charges and legacies to my executors hereinafter mentioned.
To my executors five shillings each
If any of my said three daughters shall die in my lifetime and not leave any lawful issue that shall survive me I give the share or shares of such of my daughters so dying to my son George DODGSON and his surviving sister or sisters.
