Last will and Testament of Joseph Ford ~~~~~~~ Found in Vol. F page 56 \endash Allen County Court House at Lima, Ohio
In the Name of the Benevolent Father of All \endash Amen:
1, Joseph Ford, of the Township of Marion, County of Allen and State of Ohio, being now about eighty-seven (87) years of age, and being of sound and disposing mind and memory, do make, publish and declare this my last Will and Testament, hereby revoking and making null and void all other last Wills and Testaments by me made here-tofore:
First: - My will is that all my just debts and funeral expenses shall be paid out of my estate, as soon after my decease as shall be found convenient.
Second: - As soon after my decease as may be deemed advisable by my executors hereinafter named, I will and direct that my said executors shall sell and convert into money all of my stock, agricultural implements and farming utensils, as also all other articles of personal property belonging to me; and also my farm situated in Marion Township, Allen County, Ohio,
containing about one hundred and sixty (160) acres of land, and my farm situated in Hardin County County, Ohio, about five (5) miles south of Forrest, containing about one hundred and fifty (150) acres, together with any and all other real estate belonging to me at the time of my death, wherever the same may be situated, and that out of the proceeds arising from the sale of my
said property (real estate and personal as well) together with the proceeds of any and all other estate belonging to me and coming into the hands of my said executors, whether now owned or hereafter acquired by me, they, my said executors, distribute and pay the same over to my children and grand-children in the following proportions, to-wit:
To my son John C. Ford, an equal one-eighth (1/8) part
thereof:
To my son Edward J. Ford, an equal one-eighth (1/8) part
thereof:
To my son Maley R. Ford, an equal one-eighth (1/8) part
thereof:
To my daughter, Anna Boroff, an equal one-eighth (1/8) part
thereof:
To my daughter, Ollie B. Morgan, an equal one-eighth (1/8)
part thereof:
To my grand-children Emmet Stukey and Inez Stukey, jointly, an equal one-
eighth (1/8) part thereof:
To my grand-son Riley Roy Tucker, an equal one-eighth (1/8) part thereof: and
To my grand-children Pearl Mericle, Ira Sarber and Jesse Sarber, jointly, an equal one-eighth (1/8) part thereof:
and in the event of the previous death of any of my said children or grand-children before the making of said distribution, then and in that event, I will and direct that the part or portion of such deceased child or grand-children shall go and be paid to his, her or their lawful heir or heirs.Third: - I hereby nominate and appoint my three sons John C. Ford, Edward J. Ford, and Maley R. Ford, or the survivors or survivor of them to be the executors of this my last will and testament, and having full confidence in their honesty and integrity I will and direct that they or either of them shall not be
required to give any bond or security for the faithful performance of their duties as such executors, but that they and each or either of them shall be duly qualified without bond. I also hereby authorize and empower my said executors to sell either at pulic or private sale and upon such terms of credit or otherwise as to them may seem best, any part and all of my said personal
property and real extate, and to ececute, acknowledge and deliver to the purchaser or purchasers of any part or portion of my real estate good and sufficient deed or deeds in the fee simple without the aid or intervention of a court. I also hereby authorize and empower my said executors to compromise, adjust, release and discharge in such manner as they may deem best any and all debts due to and owing by me.
In testimony Whereof, I have set my hand to this my last Will and Testament, at Delphos, Ohio, this second day of April, in the year of our Lord one thousand nine hundred and three.
