Seen by the Council, the default obtained by Jean Arnaud, merchant in Ville-Marie, represented by the court officer Lepailleur, against Pierre Hunault dit Deschamps for not having appeared, or no one having appeared on his behalf, to the assignation given to him which was the conclusion of a previous default against him rendered on the 24th of January last by an act signed by Attanville, and for profit.
A reading was made of the sentence of the royal jurisdiction of Ville-Marie, which was appealed on the 25th of June 1697, according to which Pierre and Toussaint Hunault were summarily condemned to pay, either one for the other or one for both the total without division or discussion, to the said Arnaud on Michaelmas (29 September) next according to their consent, the sum of one hundred twenty seven pounds, seventeen cents in beaver pelts save that of this obligation must be deducted the sum of forty five pounds of local currency, paid by the said Pierre Hunault, and both the said Hunaut are found liable for the expenses, The act of appeal of the said sentence interjected by the said Hunault, and the publication of the same to the said Arnaud.
Given on the same day, and at the petition of the said Arnaud, in anticipation of the said appeal, by which he was allowed to have assigned to the Council the said appellant in order to have confirmed the said sentence, and [the appellant] be required to pay all of the expences, the ordinance being undersigned as conformed on the 3rd of July 1697, and the assignations given in consequence on the last day of the same month, the twenty second of February 1698.
The Council has found that this matter has been well judged, badly and without cause appealed, and the said appellant assessed for all expenses without either favour or fine.
