1. ATTORNEY JAMES2 OATES (UNKNOWN1) was born Abt. 1660, and died Bef. 24 Jul 1703 in North Carolina (Source: The Will is now in the State Dept. of archives and History, Raleigh, N.C. Wilslow's History of Perquimans County.). He married ELIZABETH PERRY EIVENS.

The name of Oates appears in ancient British records in the various forms of Otho, Odo, Otes, Oattes, Oats, Oates and others, of which the last spelling is the most frequently used in America today. The name of Fitz Otes occurs in the Roll of Battle Abbey, among the followers of William the Conqueror, who led the Normans into England in the year 1066 A.D. "The Name and Family of Oates," - Media Research Bureau.

The Oates family is of Danish descent and came into England before the time of recorded history, possibly as early as the ninth century. The name is found in the Domesday Book, Ragman's Roll, and the Roll of Hundreds. In Cornwall they owned the great castles of Perran Sabolire and St. Agnes. "Our Family Heritage, " by Minnie Speer Boone.

A few Royalist, unwilling to submit to Cromwell, went to the Island of Barbados, West Indies. "August 12, 1663 a group of Gentlemen and Persons of Good Quality desirous of settling the goodly land of Florida at Cape Faire (Fear), made petition for a Charter of Corporation as "Barbados Adventurers Inc." to settle there, with their Negroes and servants. One of the signers was Mr. Richard Eivens. The first settlers arrived 24 May 1664. Their first settlement was called Charles Town but later changed to Clarendod. Richard Eivens accompanied the ship sent to Virginia for supplies which foundered off the Barrier beach north of Cape Hatteras. The shipwrecked crew and passengers finally reached land around Albemarle Sound and stayed there. The colony of the Cape Fear River broke up in 1667, some of the settlers going to Albermarle County, others to Port Royal, S.C. "North Carolina Booklet (DAR) 1903, page 3, per Boone

JEAMES OLD (OATES) was born 1660, died 1703, married by Thomas Hawes on 11 September 1694 to ELIZABETH EIVENS, widow of Richard Eivens (believed to be the son of Richard Eivens Sr., who came from Barbados to Carolina after 1663).

The will of Richard Eivens, dated 7 Sept 1692, probated 2 Oct 1693, mentions children: Johnathan, Richard, Rabakah and Ann. Exors: Elizabeth Eivens, wife, and Alexander Lillington, Cousin. (Abs. of N.C. Wills before 1760, Albemarle Count, -Grimes.

A daughter, Sarah, was born 30 August 1693, three months after the death of Richard Eivens. Her mother made a deed, providing for her equally with the other children, on the eave of her marriage to James Oates. (Perquimans County, N.C., DB. A, p., 83).

James Oates appears in the early records of North Carolina as a Planter and practicing attorney at whose house the Albermarle County Court and the first General Assembly met from 1696 until his untimely death in 1703. Mrs. Winslow states he probably lived near Little River, first town settled in Perquimans Precinct.

The will of James Oates dated 24 July 1703, proven in January Court 1703/4 makes bequests to son, Joseph Oates, to wife Elizabeth Oates, and to Jonathan Eivens, son of his wife by her former marriage. Sole executor, Elizabeth Oates. Witnesses were Joseph Smith and James Coles. (Abstract of N.C. Wills before 1760 - Grimes - Albermarle County.)

Joseph Oates, the son of James & Elizabeth (Eivens) Oates, was born 7 August 1697 in Albermarle Precinct, Perquimans County, N.C.

"the manuscript copy of the Berkley Parish Register is not very legible, giving rise to a variety of possible interpretations of the names in the light of contemporary records. It is believe that the name John b. 7 Aug 1697 was intended to be Joseph Oates, instead of John, for the reason that there is no further evidence of John in the records, while there is ample and recurring evidence that James and Elizabeth Oates, son Joseph was born at approximately that time and place, and the Parish Register contains no other note of his birth. This register contains not only the records of births, baptisms, marriages and deaths actually occurring in the colony during the period when the entries were made, but also the family records of some of the colonists prior to their coming to Carolina, which were obviously submitted to the Rev. Mr. Blair and Mr. Hawes, at the time of the baptism of the later children. In this category, apparently, are the births of John Oates ( by the first name) B. 4 Feb 1667, Jesse, b. 31 Aug 1669, and Mary, born 16 Nov 1672. These might well have been brothers and sisters of James Oates, born in Barbados, or Nansemond County, Virginia, or even in England; or the first named John could have been intended for James. At any rate, it is obvious that these early records do not refer to the children of James Oates by his wife Elizabeth, widow of Richard Eivens, because she was only left a widow in 1693 and married James Oates in 1694." 2. JOSEPH3 OATES (JAMES2, UNKNOWN1) was born 07 Aug 1697 in Albermarle Precinct, Perquimans, North Carolina, and died 1747. He married ELIZABETH WYATT, daughter of JOHN WYATT and RACHEL CALLOWAY.

Jo Oates, at the age 19, was witness to a deed from Richard Bounds (Blount) to F. Beasley, 10 April 1716. (Perwuimans Co. DB. A, p. 366). In 1719 Joseph Oates and Samuel Phelps petitioned the Justice to have the land re-awarded to them, which had once been taken up by their fathers, and upon which title had lapsed. Ibidem.

N.C. Colonial records, Saunders, Vol. 2, P 478: "Joseph Oates being brought before this Court (Perquimans) 30 Oct 1722, by a warrant from the Chief Justice to answer to the complaint of Thomas Lovick, (Brother of the Secretary of the Province and son-in-law of the notorious Governor Eden) for passing in payment a counterfeit bill of this Province, but the matter not being proved against him so as to charge him therewith he was acquitted.

"The trumped-up charge by Thomas Lovick, brother of the Provincial Secretary, against Joseph Oates was not proven and he was immediately acquitted by the General Court, and he evidently continued to live and function as a respected citizen of the Province and County, serving as an Attorney, Juror, witness, executor, trustee and road supervisor for some fifteen years afterward." Joseph Oates, "Cordwinder," Perquimans County, 15 April 1734, assigns to Nathaniel Carruthers for 100 pounds, 200 acres "whereon I live," Yawpin. (DB. B., p.40).

On 21 May 1737, Joseph Oates of Perquimans County, Planter, for 190 pounds, conveys 450 acres to Richard Skinner, land on Mr. Lacorses (Lakers) Creek....Witnessed by Rich Cheaston (Cheson). This appears to be Joseph Oates' last transaction in Perquimans County.

Joseph Oates of Bertie County, Planter, 25 Sept 1739, Deed to John Gray, 130 acres, land on Chinkapin Creek between John Mack Fallin and Col. Mauls line, Bertie county. (Deed Bk. F, P. 143).

Joseph Oates, County of Chowan, Planter, Deed to Wm Pugh of Edgecombe County 300 acre Martin tract, 20 May 1743. (Deed Bk. F, p507).

Saunders - Colonial Records of N.C., Vol. 4, p.1043 and 1047, show land grant to Joseph Oates of 100 acres in that part of New Hanover County, later in Duplin County, 23 March 1747; also appear again, 100 acres in N.C. Grant Book 10 p.303, on north side of Goshen Swamp 7 October 1749.

Joseph Oates married Elizabeth Wyatt, dau of John Wyatt and his wife, Rachel Calloway. She was the daughter of Caleb Calloway, Justice of Albermarle County, Speaker of the first General Assembly of N.C. and an original settler of the region before 1662, and his wife, Elizabeth Laurence. Elizabeth, the dau of William Laurence and his wife, Rachel Welch, was born in Nansemond County, Virginia, in 1655. All of these families were identified with the early colonial period of North Carolina history. Joseph Oates migrated from that section with his sons, James, John, and Jethro, to the section along the boundary between New Hanover and Johnston Counties, which afterwards became Duplin and Dobbs Counties. The death Joseph Oates has been given as 1747, although North Carolina Grant Book, page 303 shows a grant of 100 acres 7 Oct 1749 to Joseph Oates, between White Oak and Pond Branches...North side of Goshen Swamp. Other deeds bear out the fact a Joseph Oates had land transactions into the 1790's. Therefore, it is assumed he lived to a ripe old age, or there were two men by the name of Joseph.

4. JAMES4 OATES (JOSEPH3, JAMES2, UNKNOWN1) was born 1730, and died Jan 1766. He married (1) SARAH CLAYTON 1766. He married (2) LORUHAMA STEVENS 1782.

Notes for JAMES OATES: James Oates , born 1720-30 in North Carolina, married Sarah (Clayton ?), died 1766 leaving six minor children.

He received a 300 acre land grant in Johnston County in1750; was a Deputy Clerk of the Court of Johnston County 1749-1751; was also commissioned as a Justice of the Peace 21 April 1759, and appeared as Justice of the Court July 1760. He was a Captain in the Dobbs County Militia 11 March 1761. "Story of Kinston & Lenoir County," by Johnson and Holloman. James was a Captain in 1st Company, Colonial Wars.

James Oates will dated 10 Nov 1765, after his death toward the end of the month of January 1766, was proven in the Superior Court of Dobbs County, April Term 1766. This will provided that when his youngest children should arrive at 21 years, the plantation of s'd James Oates, 275 acres, be sold and money divided. Said James Oates did thereupon appoint his brother Jethro Oates, Richard Caswell (Attorney General and Governor of N.C.), and Steven Blackman, Exors. Now...S'd Richard Caswell, Surviving Executor. (Jethro Oates having died in 1780.) Quit claim 10 January 1788. Whereas, James Oates' youngest child is arrived at 21 years, deed to Sheriff of 275 acres whereon James Oates formerly lived." Notes for JETHRO OATES: Jethro was commissioned Lieutenant 11 Mar 1761, in Captain Lewis Piplin's Company and served until 1765.

History of Perquimans County, N.C., by Mrs. Winslow, p. 290:

Petition: No date given, but from the context the date is between 1749 and 1753. Jethro Oates showeth that in the year 1738, John Wyatt in his will, left property to be divided between the children of Elizabeth Oates, his daughter, and said Jethro Oates being one of them is now come of age and prays his part of the estate, now in the hands of William Wyatt and Thomas Pierce.

On March 25, 1815 James Oates deeds land to his son Stephen Oates, of Sampson County, N.C. This same land was sold by Elizabeth, widow of Stephen, in 1838 prior to moving to Henry County, Alabama.

14. WYATT5 OATES (JAMES4, JOSEPH3, JAMES2, UNKNOWN1) was born 26 Jul 1762 in Wayne County, North Carolina, and died 13 Oct 1851 in Sumter County, Georgia. He married ELIZABETH.

Notes for WYATT OATES: Children listed in the Bible, Salley, James, Fanney and Polley were all born on June 30, 1789.

Wyatt Oates was a Revolutionary soldier in Wayne County, North Carolina. He was an orphan and the man who took him kept his age secret so as to have more years of servitude from him. His "taskmaster" admitted Wyatt Oates was born in Wayne County, N.C., on the date above stated. He volunteered as a Militia man, served two three month terms; his last tour began Jan 1781. He was in several irregular scouting parties against the Torries up to 1783. He applied for a pension November 4, 1844; moved from Wayne Co., three or four years after the war to Hancock County, Georgia, lived there thirteen years, thence to Clark County, Ga., for one year, thence to Harris County, Ga. for four years then to Sumpter County, Georgia, in 1835; the place of residence when he made application for his pension. After his death Elizabeth Oates, his wife asked that the pension be placed in her name, August 10, 1852. (Pension files, National Archives, Washington, D.C.)

Notes for LEWIS COGDELL OATES: Occupation- Farmer and Teacher.  When asked why Lewis named his girls what he did he replied, "When I lived in North Carolina my first daughter was born. I wanted to live in Texas so I named her Texas. When my last daughter was born I had lived in Eastern Texas eight years and wished the Hell I was back in North Carolina so I named her North Carolina".

Lewis Cogdell Oates resided on a plantation in the southern part of Duplin county, N.C. In 1850 he owned nineteen slaves, eight males, ages 60,53,40,26,19,11,5, and 3; and eleven females, ages 35,30,24,21,14,8,8,5,3,1, and 1/2 year.

When Lewis made his decision to leave his life of ease and become a pioneer in the far west, he and his family journeyed to the Atlantic Coast and took a boat which brought them around the tup end of Florida to the Gulf of Mexico, up the Mississippi River to the Red River, then up the Red River to their point of departure, then by covered wagon to Rocky hill, Angelina, Texas.

When Lewis arrived in Angelina county, Texas, he purchased from W.G. Lang, on 23 July 1858, four hundred and nine and two thirds acres of land for which he paid one thousand dollars. Lewis paid cash for this land.

Before Lewis left Duplin county, N,C, he sold nine of his slaves and brought the remaining ten with him to Angelina county, Texas. There were four males, ages 58,27,22, and 5, and six females, ages 39, 14, 13, 12, 11, and 2. Lewis provided the slaves with two homes, better known in those days as slave houses.

Lewis was a school teacher as well as a farmer. Besides tilling the soil, the slave's job was to assist Lewis at his favorite sport. He loved to hunt and spent much time at it. It was the slave's duty to build high split rail fences; sufficiently high enough that the deer could not jump over. When the high fences were finished, so as to form a huge corral, the slaves would take down a section of the fence at night so the deer would get in the corral where Lewis and his dogs were in wait.

Notes for WILLIAM JAMES OATES:

Oates as described by Mr. Horace Fraser Rudisill in his book "Darlingtoniana."

About 1805 Stephen Oates moved to Darlington District from Moore County, North Carolina, and settled on "Stumpy Savahhah" some six miles up the gully from the present Oates community, where he lived until his death in 1817. Most of the Stephen Oates children left Darlington County during the westward migrations of the 1820 and 1830's and Stephen's grandson, Hon. William C. Oates, was the Governor of Alabama in 1894.

Stephens son, James Oates (1786-1873), remained in Darlington and moved to the site of the present Oates Crossroad, 14 miles west of the courthouse on or about the 22nd day of November 1824, when he purchased lands on both sides of Boggy Gully from Moses Mathis Jr. Here he spent the rest of his days tending his land.

William James Oates was the actual founder of the Village of Oates. He was the son of James and grandson of Stephen, the first settler. About 1850 William James Oates, like many other Darlingtonians succumbed to the "Florida Fever" taking up land in Columbia County and opening a store. During the war between the States he served in a Florida unit and was taken prisoner. After the war, instead of returning to Florida he returned to Darlington - the place of his birth - to care for his aged father and manage his affairs. At his fathers death he received a substantial inheritance. He opened a general store at a crossroads on his fathers plantation. The enterprise prospered and was the nucleus around which the community grew. The crossroads was officially named "Oates" in 1880 when a U.S. Post Office by that name was opened there with Henry Stuckey as the first post master.

At the death of William James Oates, his two sons Craven N. and William L. continued his business under the name of C.N. Oates & Brother. During the succeeding quarter century several enterprises flourished in the village. The firm of Moore and Oates was organized for the manufacture of wagons, buggies and carriages. J. Henry Moore being the senior partner. "The Bank of Oates" was organized in 1916 with Craven N. Oates as the first President. Early directors of this bank were R.R. Oates, William L. Oates, L.M. Lawson, L.P. Raines. T.B. Holcombe served as cashier for several years. The "Oates Pharmacy" was operated by Cecil N.
