This web page has been updated in May/June of 2011. The original intent of this site is the same as it has always been; to provide a FREE tool for researchers to help each other by the sharing of information - please support this intent by helping to keep it as accurate as possible. The information on this page represents the combined efforts of several researchers. I have verified the information by Wills, Equity, Deeds, Census and Cemetery Records where possible. During the 1960's, Wilhelm Von Hacke provided a valuable service to the Sumter County South Carolina Genealogical Society by organizing the records of that county and referencing those documents to various surnames and the individual family members. This page in no way attempts to denigrate that service. Regardless of its errors, Von Hacke's work has provided valuable research aids to local and visiting family historians.

However, many researchers have simply copied the work done by Von Hacke and included it in their own research files without seeking to read the referenced documents in order to verify Von Hacke's accuracy in his attachments. There are numerous family pages and databases located on the internet which perpetuate the inaccurancies present in Von Hacke's work.During my research trips to the various archives in Sumter and Kershaw Counties of South Carolina, hard copy works have also been found to contain unproven and inacurate information from his files.

With the ease of sending gedcom's via email and downloading or copying and pasting from online databases, the mistakes continue to be added to more and more family files. Only by researching the documents referenced in individual paragraphs found in the Von Hacke files can any researcher consider his family attachments and his document attachments as correct and proven.

Von Hacke, researching all of Sumter's records and not one particular individual, saw the big picture and not the small. In other words or as an example, as there was only one Daniel McLeod as a head of household in Sumter in the 1820 census, then in Von Hacke's mind, in 1828 that head of household Daniel must be the Daniel in Margaret McLeod's will and therefore the 1820 Census Daniel McLeod had to be her brother (named as executor). Von Hacke, researching all of Sumter's records and not one particular individual, saw the big picture and not the small.

This first McLeod written of on the typed pages transcribed from the index cards of Von Hacke. This Alexander McLeod was married to Harriet Yates; he was born in April of 1815 and was the son of Alexander and Sarah McIntosh McLeod, therefore the grandson of Angus McLeod (see paragraph on Angus McLeod below).

The maiden name of Alexander's wife is unknown; various family files have stated she was a McCaskill or a Gellis. I have found nothing to date (2006) to determine what her maiden name was, but I have reason to believe it was neither McCaskill or Gellis. (My own web page has her listed as a Gillis, I have not changed it due to search engine issues) This Alexander died in 1835; shortly thereafter, his son Norman, by that time married to Betsy McLeod, the daughter of Angus and Nancy McCutchen McLeod, began to sell his lands, some of which included portions of his father's estate, and by 1840 had migrated to Macon County Alabama along with his wife's sisters, Nancy McLeod Bethune and Polly McLeod McCoy/McKay. Norman's 1871 Will, on file in Pike County, Alabama, names some of the land of his father's estate proving his descendancy and his marriage.

Probably the son of James and Margaret Blakely McLeod (Gordon). As Von Hacke has written, an Andy McLeod is found in the 1820 Census page 106 between David and Moses McLeod - it is possible that he was the son of James and Margaret. 2 males aged 1-9, 1 male aged 10-15, 1 male aged 26 - 44, 2 females aged 1-9, 1 females aged 1-9, 1 female aged 26 - 44 - He is not apparently named in Margaret Blakely McLeod Gordon's 1814 Will, . At any rate, it is likely he was related in some way to this McLeod line due to residence. 12-19-1820 / Book F page 649 - 200 acres, a Mill and 1 acre at the NE end of the dam from Edward Reynolds

According to the deeds below; this 200 acres was part of a grt to Jacob Sellers which bordered Enoch McDowells grant. The 54 acres Angus bought before Jan 20 1827 Book GG page 80 and the 320 acres he bought on Jun 28 1827 Book GG page 336 were combined and adjoining the 200 acres purchased in this deal. Before 1-20-1827 / Book GG page 80 - Deed Book GG page 80 references a deed which states that Jesse Peebles sold 54 acres to Angus McLeod (where Angus McLeod now lives). The deed itself is a deed in which Shadrock Rogers sells acreage to Hugh McCall that he had previously sold to Jesse Peebles but which had been reconveyed back to Rogers by Peebles, less the 54 acres sold by Peebles to Angus. 6-28-1827 / Book GG page 336 - Hugh McCall sells the 320 acres he purchased from Shadrock Rogers to Angus McLeod. This 320 acres borders the 54 acres detailed above which Angus purchased from Jesse Peebles before 1-20-1827. 9-8-1827 / Book GG pages 255-56 - Although Von Hacke states that Angus gave 250 acres, stock. to his daughters Catherine and Margaret, the deed itself states that he sold it to them for "the sum of ten dollars to me in hand paid". The "negroes" were given "for the sum of one dollar to me in hand paid". This 250 acres includes the 54 acres sold to Angus by Jesse Peebles (the deed states Angus had a letter from Peebles that would "more clearly show and he states that he still lives on that 54 acres") and a portion of the 320 acres he purchased from Hugh McCall and for which he was showing the title. 6-14-1828 / Wills Book III page 187 - The Will of Margaret McLeod - At Margaret's death, her estate consisted of 524 acres of land valued at $262.00; 4 "negroes"; 32 head of cattle; one lot of hogs; one riding chair and buggy; cart; 1 gray mare; plantation tools, household furniture, Kitchen furniture, 1 lot sheep. The appraisers were William Arrants, Daniel McCaskill Sr., and Daniel McCaskill Jr., Archibald Fraser, and Angus McCaskill. The executor was named as Roderick Bethune. The probate file consisted of only the appraisal. No other document has yet been found regarding any sale of goods to pay debts. Margaret willed the "negroes" to her sister Catherine. The remainder of the estate of Margaret McLeod passed to her sister, Nancy McLeod, the wife of Roderick Bethune.

At her death in 1829, the Estate of Margaret McLeod included 524 acres, a portion of which was her share of the above 250 acres (Book GG pages 255-56). The entire acreage (524) was left by Margaret McLeod to her sister, Nancy McLeod Bethune, the wife of Roderick Bethune in January of 1829. Roderick sold "approximately 600" acres to John Boykin in 1839 prior to their migration to Alabama. The 524 acres and the "approximately 600 acres" were the same property (owned by Margaret McLeod at her death). Roderick requested that the land be resurveyed before title was conveyed.

The lands location next to the "Mill and 1 acre at the NE end of the dam" is confirmed in Sumter County Land Conveyances Book D in a discussion of the location of New Hope Presbyterian Church a.k.a. McLeod Cemetery- "The old graveyard is shown on a plat recorded in Sumter County Land Conveyances Book D; the land was granted to Enoch McDowell in the 1700's and was owned by several families during the following years; the McLeods; Spears, Shadrack Rodgers, Jesse Peebles, Hugh McCall, and Roderick Bethune. Roderick Bethune sold the property to John Boykin of Sumter County, SC; the deed was recorded in 1839." . Another Land Grantee Enoch McDowell received a grant for a tract of land on the NE side of present day McLeod's Mill pond in the 1700's." In the early 1900's, a descendant of John Boykin sold the 600 acres again, the deed states it lay "next to the Estate of John Robert McLeod". John Robert McLeod was the son of Daniel McLeod and Catherine McLean, therefore the nephew of Margaret McLeod and her heir, Nancy McLeod Bethune. 4-7-1831 / Book MM page 58 - Angus sold the 200 acres purchased on 12-19-1820 (Book F page 649) to his son Daniel for the "sum of seven hundred dollars to me paid". The deed states it was part of Jacob Sellers tract (as does the deed in Book F page 649) and states that a mill and 1 acre on the NE end of the dam is included.

It is this deed which conclusively proves that Von Hacke attached the wrong Daniel (h/o Jane Christmas) to this Angus McLeod as his son. This land remains in Daniel's family today, owned through inheritance by his great great grandson. This great great grandson's ancestry can be traced back to Daniel and Catherine McLean McLeod's only son John Robert McLeod. John Robert McLeod and his wife, Sarah Cason, and his sister, Annie McLeod, first wife of Col. Stephen Madison Boykin are buried in McLeod Cemetery, a.k.a. New Hope Presbyterian Church Cemetery, which is located next to the McLeod Mill pond of this deed. *See above paragraph on Margaret McLeod's will and the location of her Estate Lands/See also Daniel McLeod, husband of Jane Christmas below.

Her father - correct attachment; only exception...Deed GG, 255-56 shows that Margaret and Catheirine paid ten dollars for the land and stock; and one dollar for the negroes. Although Von Hacke combined this information, it is actually contained in two separate deeds.

Inherits in will of her sister Margaret - Correct; Catherine inherits the slaves that were Margaret's share of of what their father gave the two women in 1827. The remainder of the property (appr. 524 acres) contained in Margaret's estate is inherited by her sister, Nancy McLeod Bethune.

By 1830, her father, Angus McLeod, is found enumerated in the home of Roderick Bethune and her sister, Nancy. In 1827, it is likely that Angus, who was shown as aged 80-90 in the 1830 census, was preparing to leave his plantation home and so deeded it for ten dollars to his two unmarried daughters. As Margaret was obviously ill and it appeared that she would pre-decease her father, she was in effect, deeding it back to her father, in care of the daughter and son in law with whom he was living at the time of Margaret's illness.

Witn: 3-17-1835 (II, 718) - This is in all probability an incorrect attachment; Deed Book II page 718 is a deed in which Daniel McLeod, her brother, and his wife Catherine McLean, buy land from John B. McLean and his wife. It is likely that John McLean and Catherine McLean McLeod were related, so it is also likely that Catherine McLean McLeod witnessed this deed of her husband's and not this Catherine.

Since Von Hacke attributed all of the now proven records of Daniel McLeod and his wife, Catherine McLean to Daniel McLeod, the husband of Jane Christmas, it is obvious why he would have made a mistake in the attachment of this deed ....since the Daniel McLeod he thought was her brother was married to a JANE, he would have assumed that the witness to this deed was Daniel's sister. (See Angus McLeod above and Daniel McLeod below)

No further information is available regarding this Catherine McLeod, daughter of Angus and Nancy McCutchen McLeod. Whether she married or died is unknown.

The Will and the Estate File contain no identifying statement regarding the identity of the Daniel who was named Margaret McLeod's brother. The statement is proved false by the location of the land contained in Margaret's estate and the location of land inherited by the descendants of Daniel McLeod, husband of Catherine McLean. Book GG page 80 and Book GG page 336 combined with Book HH, page 58 - show that all the land purchases by Angus McLeod were adjoining or contiguous to each other (see above under Von Hacke's paragraph on Angus McLeod). Wilson); Partially Correct

All but the very end of this statement is correct. Jane B. McLeod was the daughter of Nathan A. McLeod who was the eldest son of Daniel and Jane Christmas McLeod. Nathan is the male aged 1-9 present in their 1820 Sumter District home. Jane's mother, Martha A. (--?--) married Henry L. Wilson after Nathan's death on January 17 1843. Nathan is buried at Rembert Church, Tombstone #94, in the same row as several of his siblings, his parents, and a predeceased son, James Daniel McLeod whose tombstone is #93 and reads "died May 9 1841 in the 3rd year of his age, s/o Captain N.A. and M.A. McLeod). Nathan, Martha and James Daniel are enumerated in the 1840 Sumter Census under the head of household name NA McLeod. Daniel McLeod, husband of Jane Christmas, was the administrator of Nathan's estate. Daniel and Jane did have another son named Daniel who predeceased them; Daniel McLeod Jr. was born July 13 1824 and died October 20 1831. His tombstone at Rembert Church is #90 and states he was the son of D & J McLeod and died at 7 years old.

Book GG page 80 and Book GG page 336 combined with this deed Book HH, page 58 - show that all the land purchases by Angus McLeod were adjoining or contiguous to each other (see above under Von Hacke's paragraph on Angus McLeod). The land that Angus sold to his daughters, Margaret and Catherine in 1827 lay next to this land on Beaverdam with a mill and 1 acre on the NE end of the dam. The sale of approximately 524 acres (could be as much as 600; see above) in 1839 by the Bethune's and again in 1902 (by the Boykin's) confirm these lands lay bordering each other. The 1902 Deed showed that the acreage lay bounded on the West by the estate of John Robert McLeod. John Robert was the only son of Daniel and Catherine McLean McLeod and the land of that estate is owned by Daniel and Catherine's great great great grandson today (2007). Daniel McLeod, the son of Angus McLeod, was married to Catherine McLean. This relationship is proven by the Administration of the Estate of Sarah McLean by their son John Robert McLeod. The document was witnessed by Roderick Bethune who was the brother in law of Daniel, husband of Catherine McLean. It was also witnessed by a Catherine McLeod. It is more likely that this was the wife of Daniel and not the sister, also called Catherine and the woman who Von Hacke attributed the witnessing to in his paragraph on her.

The only thing correct about this is his parentage and the fact that he died before his father. Daniel and Jane did have a son named Daniel who predeceased them; Daniel McLeod Jr. was born July 13 1824 and died October 20 1831. His tombstone at Rembert Church is #90 and states he was the son of D & J McLeod and died at 7 years old. This is confirmed also by census records, which if you look at the age ranges of the children show clearly a deceased/missing son.

Jane B. McLeod was the daughter of Nathan A. McLeod who was the eldest son of Daniel and Jane Christmas McLeod. Nathan is the male aged 1-9 present in their 1820 Sumter District home. Jane's mother, Martha A. (--?--) married Henry L. Wilson after Nathan's death on January 17 1843. Nathan is buried at Rembert Church, Tombstone #94, in the same row as several of his siblings, his parents, and a predeceased son, James Daniel McLeod whose tombstone is #93 and reads "died May 9 1841 in the 3rd year of his age, s/o Captain N.A. and M.A. McLeod). Nathan, Martha and James Daniel are enumerated in the 1840 Sumter Census under the head of household name NA McLeod. Daniel McLeod, husband of Jane Christmas, was the administrator of Nathan's estate.

This Daniel is connected to the James and Margaret Blakely McLeod (Gordon) family. Moses B. McLeod was their child. The 1830 Sumter Census shows only two Daniel McLeod's, one the husband of Jane Christmas, and the other the husband of Catherine McLean (son of Angus McLeod). There were two Daniel McLeod's in the Kershaw District in 1830. It is unclear which Daniel was the trustee for the children of Mose B. McLeod.

Please Note: The above paragraph is more disjointed and confusing than Von Hacke's paragraphs on other McLeod individuals, primarily because it jumps years when referencing documentation and includes information on what are obviously two separate women interspersed throughout. For this reason, I wll not be taking the statements in the order in which they are seen in the paragraph, but will discuss each statement in a timeline of sorts. I will also discuss his marriage and the two women that Von Hacke includes as his wives in a separate discussion.

1810 Census in Claremont as Norman McCloud: 1 m 45 or +, 1 f 1-9, 1 f 45 or +, 7 sl.

FALSE - Note the age of the Norman who was head of household in this Claremont Census - he was 45 plus. This gives a birth year of 1765 or earlier. Census records of Norman McLeod, the son of Alexander and Sarah (Gellis/?) McLeod show that he was born in Scotland cr. 1790-1800. This census enumeration is of another Norman McLeod, possibly the Norman McLeod enumerated in the Kershaw District Census of 1820, who was an alien, not naturalized and 45 +. (That Norman is not found in Kershaw in 1830.)

Norman sells these 700 acres to James Skinner in 1838 (rec'd 1839) prior to migrating to Alabama. (See 8-15-1834; see 3-6-1839) and paragraph on Alexander McLeod, Norman's father. Although not stated in the Deed Gift from Alexander to Norman (1834) the 1838/9 deed of sale to James Skinner states that Mill and a Cotton Saw were included in the 700 acres. In other documents, Mill Branch is referred to a McLeods Mill Branch. From map research, it would appear that this Mill was on the Kershaw Side of the county line. (there were three McLeod Mills in what is today Lee County; which County was made up of land from Sumter and Kershaw - one McLeod Mill owned by Daniel and Catherine Mclean McLeod (McLeods Mill Pond, McCaskill Road, Lee County today), the other apparently (not yet proven) to Daniel's brother, Alexander (h/o Sarah McIntosh) prior to his death in 1824, located on Horsepen Branch, also crossing the county lines).

 

6-14-1828 Betsey McLeod, wf of Norman McLeod, and dau. of Angus McLeod (Wills III, 187).

Although Von Hacke included information on Elizabeth Lackey McLeod and on Betsy McLeod in this paragraph on Norman, he was only correct when including Betsy McLeod as his wife. Norman's Will is on file in Pike County Alabama. Recorded in 1871, this will names land that he owned at his death in Sumter and Kershaw County, that land ties in with land included in his father's estate and/or passed on to Norman. No record has been found of his selling the additional 460 acres (part of the 1160 deeded to him on 8-15-1834) prior to leaving South Carolina, and apparently, this 460 acres is part of the lands mentioned in his will.

Norman (not yet confirmed) and his wife Elizabeth (confirmed) and a son are buried in the Orion Church Cememtery in Bullock, Alabama. Elizabeth Lackey McLeod died in October of 1859 in Sumter or Clarendon County, SC, twenty years after Norman McLeod migrated to Alabama with his wife Betsy McLeod, daughter of Angus McLeod, her two sisters, Nancy McLeod Bethune (wife of Roderick Bethune) and Polly McLeod McKay/McCoy (wife of John McKay/McCoy). Sold for one dollar and the "love and affection" - N.E. side by Rembert land formerly Bishops, on N.W. by Rembert land, formerly Talmie Bishops, and S.W. by Sumter's land and on the other side by McIntosh and McLeans lands - 700 of these acres Norman bought at the Sheriffs sale from Allen Cooley; Norman sells these lands in 1838 (recorded in 1839) prior to migrating to Alabama. Deed page 442, Book I was written the same day as Alexander's Will. He also wrote deed gifts for his other children, according to the will. As there seems to have only been one Norman in Kershaw and/or Sumter County during this time frame, it would appear that this would be a correct attachment. The record should be read to confirm, using other witness names and property location.

 

3-6-1839 (Book KK page 2)- wife Elizabeth (x) McLeod -

Betsy McLeod McLeod appeared in the Kershaw Court before the Justice to release her dower rights to the property which in this deed, Norman sells to James Skinner for $1000.00 "all that tract or parcel of land situated and laying in Sumter and Kershaw Districts on the waters of Lynches Creek and Mill Branch ....with a mill and a cotton saw...bounded on the east by James Skinner and on North by McIntosh lands and on west by ? Stokes and south by Stokes land containing 700 acres more or less. The deed is dated 6th or 7th day of April 1838. It is witnessed by R.A. Bethune and a Dixon Stokes.

By 1840, Norman and Elizabeth (Betsy McLeod, dau. of Angus McLeod) are found in Macon County Alabama along with Roderick and Nancy McLeod Bethune (who also are seen selling property in 1838/9 prior to migration) and with John and Polly McLeod McKay (no records yet found regarding any sale of their property, research is ongoing).(Deed accessed and copied June 2005 Sumter Co. This deed is not the deed in which Norman sells the land to Joel Stokes, it is a deed which references the prior sale. Tysy Stokes is selling to Elizabeth McCullum, the deed references that Joel Stokes bought it from Norman, then sold it to Tysy Stokes. This particular deed has not yet been found and examined - however - Elizabeth Lackey was not the wife of this Norman McLeod:

 

 

 

 

1) Norman and his family did not arrive in Sumter SC until 1821 (first land purchase in that year from James Ward/not present in the 1820 Census). This deed along with later census records proves that three of Elizabeth Lackey McLeod's children were born prior to 1823 in South Carolina; using later census records, these three children were born in the years between 1815 and 1823. Elizabeth Lackey McLeod's family was in Sumter by 1820 (where Jacob and Mary are enumerated) and I have not researched the Lackey's arrival time in the area, but the 1850 Sumter County SC census states that Elizabeth Lackey McLeod and Mary Lackey, her mother, were both born in South Carolina in 1795 and 1765 respectively, as were all the children.

 

 

 

 

2) More importantly, the Will of Norman McLeod which is on file in Pike County Alabama, shows he died in Alabama in 1871 and names lands that when cross referenced to the land in his father's South Carolina estate, prove his identity. Census records from Alabama show his arrival there by 1840, along with his brother-in-laws Roderick Bethune and John McKay. The 1850 Alabama Census shows his wife, Elizabeth, as living with him, aged 51 born in North Carolina, as does the 1860 Alabama Census. In contrast, Elizabeth Lackey McLeod is found in the 1840 Sumter South Carolina household of her widowed mother; and in the 1850 census as a head of household living with several of her children (now an every name census) and her mother, Mary Lackey.

Again, this is the record of Elizabeth Lackey McLeod (see 1850 census to confirm names of heirs), but not a record of the wife of this Norman McLeod. Researcher of Elizabeth Lackey should also view this record in its entirety to determine if her estate names her husband.

Although Von Hacke attaches this census enumeration to Elizabeth Lackey McLeod, it is obvious that he questions the attachment. There is an Elizabeth McLeod as head of household in the 1820 Sumter Census living near to Mary Lackey and the females aged 1-9 do fit the ages of Elizabeth's two oldest daughters, however, Elizabeth being named head of household and with no presence of an adult male, it indicates widowhood or perhaps abandonment.

 

 

Elizabeth had children after 1823, so she was not widowed in 1820. However, the census takers were sometimes quite literal regarding the rules of the census - enumerating only those who were living in the home on/before a certain date. If Elizabeth's husband traveled and did not live with her all year, this could be why the census taker enumerated her as a head of household.

It is interesting that a lawsuit is indexed for the Kershaw County Court of Common Pleas entitled "Mary Lackey vs Norman McLeod" dated about 1820. We have been attempting to identify our own Norman McLeod, the son of Angus and Nancy McCutchen McLeod in light of a family legend that he was a bounder or ne'r do well - there are several lawsuits against a Norman McLeod in the Kershaw Court of Common Pleas AND some descendants of Elizabeth Lackey McLeod claim that her husband was OUR Norman- please see Norman McLeod to learn more. Could Elizabeth Lackey actually have been married to OUR Norman McLeod and was he, as family legend would indicate, a man who went in and out of South Carolina therefore never appearing in census records with his wife and children?

 

 

However, it should be noted that one Sumter Researcher states that Elizabeth Lackey McLeod's husband was not a NORMAN but an ALEXANDER (McLeod) who died about 1826. This has not yet been verified, but a death in or around 1826 for Elizabeth's husband would fit other known information regarding her. UPDATE JUNE 2008 - I HAVE VERIFIED THAT SEVERAL DEEDS STATE THAT ELIZABETH, THE DAUGHTER OF MARY LACKEY WAS THE WIFE OF A NORMAN MCLEOD....

Continuing: Elizabeth is never found in a household with a husband. In 1830, she and her children are probably in her mother's home:
