Will of Kinzea Stone, 1845

In the name of God Amen I Kinzea Stone Senr of the county of Bourbon and state of Kentucky being afflicted in Body but of sound mind andcapable of disposing of my Estate do made and constitute this my last will and testatment revoking all others heretofore made by me.

First I desire that all my just debts and funeral expenses be paid first from the monies arising from the sale of my property.

Second I have heretofore given to my son James Stone the sum ofThirty five Hundred Dollars money arising from the sale of One Hundred Acres of Land part of a tract purchased by me from John L. Hickman in the year 1834 sold by me to Kinzea Stone Jr. I have also given to my son James One negro slave and other property amounting in value to the sum of seven Hundred and forty on Dollars and this is to be his portion of My Estate.

Thirdly I have heretofore given to my son Kinzea Stone Jr One hundred acres of Land out of a tract of Land purchased by me from John L. Hickman in the year 1834 including the building in which he now lives together with the orchard & spring and have executed him to a deed for the same. I have also given to my son Kinzea a negro slave and other property amounting in value to Nine hundred and twenty six Dollars & 25 cts which is to constitute his full portion of My Estate.

Fourthly I give and bequeath to my son Edward Stone One HundredAcres of Land out of a tract purchased by me from William Parker in the year 1841 The lines to be run so as to include the building in which he now lives and the building near the"Parkers Meeting House" I have heretofore given to my son Edward One negro Slave and other property amounting in value to Seven Hundred and twenty two 93/100 Dollars and this is to constitute his full portion of My Estate.

Fifthly I give and bequeath to my Son John Stone the sum of Three Thousand Five Hundred Dollars to be paid him by My Executors out of the first Monies arising from the sale of My land. I also give and bequeath to him my negro slave Henry, two Beds, Bedsteads & furniture such as the rest of My children have heretofore had, One Cow & calf, One Sow & pigs. I have heretofore given to him property of the value of One hundred and Twenty Three Dollars and this is to constitute his portion of My Estate.

Sixth. I give and bequest to my Grandson Thomas F. Stone son of my late son Elijah W. Stone decd Two Thousand Dollars to be paid him by my Executors out of the monies arising from the sale of my land. I also give him my negro Boy Robert, one bed & furniture such as I have given my children. I have heretofore given to him property of the value of One Hundred and Twenty Three Dollars, this with what I gave his Father in his life time constitures his portion of my Estate.

Seventh. I have heretofore given to my daughter Agnes F. Carter (late Stone) the sum of One thousand Dollars in money and two negroes with other property to the value of One thousand and Thrity Dollars Making in all two Thousand thrity Dollars and for the services she has rendered my during my Sickness I give and bequeth to her one negry boy named Charles and this is to constitute her portion of my Estate.

Eighth. I have heretofore given to My Daughter Sarah J. Morris (late Stone) the sum of One thousand Dollars in Money together with two negroes and other property amounting in value to Nine Hundred and fifty Six 91/100 Dollars which is all I devize giving her.

Ninethly I have heretofore given to my daughter Nancy Clinkenbeard (late Stone) the sum of Eight hundred and fifty Dollars in Money together with two negros and other property to the value of Nine hundred and firty seven 50/100 Dollars and I now give and bequeath to her the sum of One Hundred and fifty Dollars to be paid her by My Executors so as to Make the sum given to her in Money equal to that given to my other Daughters and this is to constitute her portion of my Estate.

Tenth. I have given to my Grandson Elijah D. McVicker Son of my late daughter Fanny McVicker decd two negroes a woman named Nelly and her son Daniel who has since died and the woman is now in my possession for the receipt of said Elijah and I direct that the sum of thirty dollars per annum be paid for the servicesof sd negro to the Trustee of sd Elijah hereafter to be named and I devise and bequeath that money enough shall be paid by my Executors out of My estate to sd Trustee so as to make including the sum paid for the hire of said negro the sum of One Thousand Dollars for the benefit of my sd Grandson and I hereby appoint and constitute my son Edward Stone trustee for my said Grandson and direct that he shall receave the monies and property herin bequeath to him and manage invest and controal the same as in his own discretion he may deed best for the benefit of my sd Grandson and have the entire controal over the money & negro and the propperty arising from the same until sd Elijah shall arise at the age of twenty one years and I wish it distinctly understood that James McVickers, the father of sd Elijah is to have no controal or management over any property or money devised by the will to sd Elijah and it is to be further understood that if my said Grandson Should die before he attains the age of twenty One years then the Money and property herin devised to him with its increase is to be Equally divided amount my surviving children and this is to constitute his portion of my Estate.

Eleventh. I give and bequeath to my two Grandchildren Joseph H.and Agnes L Porter children of my late daughter Catharine Porter decd the sum of Six Hundred and Four Dollars in Money which I direct to be paid to my son Edward Stone as there trustee and having heretofore give to said Agnes L by deed of Gift a negro Girl named Vina and it is to be understood that the said negro and money herein mentioned is to be used for the joint benefit of sd Joseph H and Agnes L. in the best possible manner for the raising and Educating of them and sd Trustee is directed to pay to Each one of said Grand children upon there ariving at the age of twenty one years or marrying the distributable share of said Money & negro taking the whole as a joint property and should either of said children die before attaining the age of twenty one years and without lawful heirs begottin in Marriage the survivor is to have the whole amount demed to them boath and this constitutes the amount devized for them out of my Estate.

Twelth. I now direct that all my property real personal and mixed shall be sold at public auction Except my land which I thought advisable My Executors may sell at private sale for the best possible price. Except likewise my negro man Daniel and should there be after the payment of the specific devise heretofor made a surplus arising from my Estate it is my will and desire that the sum of five hundred dollars more be paid to my Daughter Agnes F.Carter. Five Hundred Dollars together with the sum of One Hundred and fifty heretofore devised to my son Edward Stone as the trustee for my daughter Nancy Clinkinbeard and the heirs of her body and five hundred dollars to said Edward as trustee for my Grandson Elijah D. McVickers to be used as apt. and the sum of Five Hundred Dollars to sd Edward as Trustee for my Sd Grandchildren Joseph H. & Agnes L. Porter to be used as sfd. which I last sum to be in addition to what I have allready devised to them but should there not be sufficient to pay these last divised then whatso is left to be notably divided amongst them and should there be sufficient and a surplus then such surplus to be divided amongst my children and grandchildren according to the sum of distribution in the estate. My negro man Daniel I desire to choose himself which one of my children he wishes to live with who if he wishes to purchase him shall have the same length of time to pay for him as valuation allowed by my Executors for the rest of my shares.

Lastly I hereby nominate and appoint my son Edward Stone and my friend Samuel Brooks the Executors of this my last will and testament whereof I have hereunto set my hand and seal this the Sixteenth day of November in the Year of our Lord Eighteen hundred and forty five.
