I, James Wells, of the Town of Hopkinton in the County of Kings county in the Colony of Rhode Island yeoman, being in health of body and of perfect disposed mind & memory thanks be given to almighty God for the same but calling to mind the mortality of my body and knowing that it is appointed for Man once to die, do make & ordain this my last will and testament that is to say principally & first of all, I give and recommend my soul unto the hand of the Almighty God who gave it to it, and my body I commit to the earth to be buried in a Christian, decent burial at the discretion of my Executor hereafter named, nothing doubting but at the General Resurrection, I shall receive the same again by the mighty power of God. And as touching such worldly estate where with it hath pleased God to bless me in this life, I give, devise and dispose of the same in the following manner and form.
  Imprimis, my will is and I hereby order my Executor hereafter named to pay all of my just debts and general charges out of my personal estate.
  Item, give and bequeath to my dearly beloved wife Mary Wells, my negro girl named Rose, to her my said wife's disposal forever and to her heirs & assigns. Also I give to my said wife the west half of my now dwelling house with half the lot of land I purchased of Joseph Coon being two acres and one half on which my said dwelling house now stands, namely the west half bounded easterly on the other half of said lot that I have by deed conveyed to my son, Barker Wells which west half of my said dwelling house with said west half of said lot of land I give to my said wife during the time she remains my widow. Together also I give to my said wife one half of all my household goods during her natural life, also I give my said wife ten Spanish milled dollars to be paid to her by my son, Joshua Wells yearly and every year during her natural life. Besides what my son, James Wells is bound by Bond to pay her after my death, my will is that my son Joshua find and provide for my wife at all times when my said wife shall require the same a gentle and quiet beast for her to ride when and where she shall see fit. My will is that my son Barker Wells shall find her on her land all the firewood that my said wife shall need to burn in my said house for her comfort during the time she shall remain my said widow. Further my will is that my son, Peter Wells, and my said son Joshua Wells cut and cart said wood to my said house fit for her fireplace and lay the same near my said house where it may be convenient for her use during her widowhood as aforesaid all which gifts and privileges I give to my said wife as above said, in lieu of her Right of Dower and power of thirds in my whole estate that I am now seized of ~
  Item, I give and bequeath to my beloved daughter Barbary Noyes, wife of Joseph Noyes of Westerly after the decease of my wife the aforesaid half of my household goods that I in this will gave to my said wife I give the same to my to my said daughter Barbara and to her heirs forever ~ except for the two large silver spoons which I give to my son Barker Wells & his heirs forever.
  Item, I give and devise to my aforesaid son, Barker Wells, the aforesaid west half of my said dwelling house and west half of said lot of land my said house stands on after my aforesaid wife shall cease to be my widow to him, my said son Barker, my negro boy named Braver, to his heirs forever.
  Item, I give & bequeath to my beloved son, James Wells, six shillings lawful money in addition to what I have already given him by Deed to be paid to him by my Executor.
  Item, I give and bequeath to my beloved son, Peter Wells, six shillings lawful money in addition to what I have already given him to be paid to him by my Executor.
  Item, I give and devise to my aforesaid son, Joshua Wells, all the remainder of my real and personal estate of every kind or nature so ever and to his heirs and assigns forever in order to enable him to pay all my just debts and funeral charges.
  Lastly, I constitute, make and ordain my aforesaid son, Joshua Wells, to be my whole and sole Executor of this my last will and testament hereby revoking and disallowing all former wills, legacies and bequeaths by me in anywise before named wills…"
