Sadler, President Judge of the said Thirteenth Judicial Circuit and Frederick Wickham, Samuel Foot and Seth C. Parker, Esquires Affociate Judges of said Court of Common Pleas for the County of Huron aforesaid of the Term of September to wit on the Sixteenth day of September in the year of our Lord one thousand, eight hundred, and fifty. Be it remembered that heretofore to with on the Twenty fifth day of May in the year of our Lord one thousand, eight hundred and fifty, Franklin Sawyer, Solicitor for Petitioner filed in the Clerk's Office of the Court aforesaid that the following Petition for divorce to wit, State of Ohio, Huron County of Court of Commission Pleas June Term 1850 To the Honorable Court of Common Pleas in and for the said County in Chancery ____, ___ petition ____ ___ of said County _____ that as the 12th of February AD 1844, she was united in marriage contract to one James F Wells and whom your petitioner prays may be made party defendant to this Petition, that she said she cohabited with the said James F. until the 14th day of June, AD 1846 and that on that day, a period of over three years ago, the said James F. Wells left your Petitioner without any Just ___ or ____. The said James F. was at time engaged in the capacity of Stage driver and though your petitioner heard from twice of his whereabouts from different sources, that the said James F. Wells ceased to provide for your petitioner, or to hold any correspondence or converse with her. Your Petitioner further explains(?) that she bore her said husband two children, both sons who are now neither of them living that they both died of scarlet fever, one on the 6th of October 1849 and the other on the 7th of the same month. During(?) the times the said James F. Wells left your petitioner up to the time of the death gives petitioner had to bear the whole burden of their support, that they were sick a great deal and that her only means of support was from her own labor in working from home washing and your petitioner further stated(?) that the said James F. G. Baker and W. F. Kitteridge ___ [for?] a judgement, obtained against him in the court by them, and that a portion of the purchase money ___ of eighty and nine dollars is now in the hands of David Johnson, Sheriff of this County bring surplus of ___ paying said judgment. Wherefore your Petitioner prays that she may have service on said James F. ___ by publication, according to the Statute in such case made and provided, and that without good cause to the contrary, your honorable court may decree a divorce to your Petitioner from the said James F Wells and that your Honorable court will also order and decree that the said ___ money now in the hands of the said Sheriff to wit: in the hands of David Johnson ___ over to your Petitioner as part of such amunt of alimony as your honorable court may ___ and that your Petition may have such other and further relief in the premises as equity ___ continued until the next Term thereof and afterwards, to wit: on the day and year first ___ , came the Petitioner Sarah Wells, and having proved publication, under the Statute in each case made and provided an it appearing to the court, that the said defendant failed to plead answer or demur(?) to said Petition. She was born October 18, 1792 in the State of Vermont, and at the time of her decease was 74 years of age. After a life of severe trial and many afflictions, she has gone at lst to "the land of rest, the saints "delight" With the exception of a few weeks at a time, Mrs. Wells spent the last nine years of her life in Sandusky, Ohio. She was eminently a child of Provience and God took care of His elect. Her little rooms were a perpetual Bethel, and she was foth to leave when Providence seemed to require it. She left a few weeks since to make her closing earthly sojourn with her daughter, Mrs. Richard Jeffrey, in Norwalk, Ohio. Here she remained but few weeks and at length quietly on a Sabbith morning, just as she had often de .. she resigned her soul to God, and closed her eyes."

    Background: Col. William Stephens Smith fought in the Revolutionary War alongside generals Washington and Lafayette and served as aid to Baron von Steuben. After the war Smith served as a diplomatic representative in London (1784). Here he met and courted Abigail Adams (daughter of President John Adams and Abigail Smith Adams). The two were wed in London in 1786. They had four children: William Steuben (birth 1787 death 1850), John Adams (birth 1788 death 1834), Thomas Hollis (birth 1790 death 1791), and Caroline Amelia (birth 1788 death 1852). In 1788 the Smiths returned to America and settled near New York City. Col. Smith was appointed by President Washington as the first U.S. Marshal for the NY district (1789). Smith later was appointed to the position of surveyor for the Port of NY by President John Adams (1780).

    Fortune
    Smith sought his fortune as a land speculator and was granted a patent in 1794 for Townships 2, 3, 4, 5, 8, and 9 of the Chenango Twenty Towns - a total of 150,000 acres at a cost of 24,375 pounds sterling. Lots 2, 3, 4, and 5 are present day Eaton, Madison, Lebanon, and Hamilton respectively. Lots 8 and 9 are Smyrna and Sherburne respectively in Chenango County. In the late 18th century all of this land was wilderness. Some time after 1794 Smith either sold or turned over lots 2, 3, 4, and 5 to Sir William Pultney. Smith retained lots 8 and 9 in Chenango county and a large tract of land bordering the Chenango River in Madison County. Col. Smith's brother, Justus B. Smith, was assigned the task of subdividing and selling lots from this tract. Justus built a large house in Smith's Valley from where he conducted the land sales business. Col. Smith had a small frame house located near here which he occupied infrequently. Both Col. Smith and Justus B. died in Smith's Valley in the year 1816 and are buried in West Hill Cemetery, Sherburne.

S. Militia commanded by Col Geo. W Flemming in the War with Great Britain, declared by the United States on the 18th day of June, 1812. That he was drafted at Hamilton in the County of Madison in the State of New York on or about 25th day of March A.D. 1812 for the term of three months and continued in actual service in actual service for about three and one-half months, and was honorably discharged at Oswego in the State of New York on about the tenth day of July A.D. 1812 or some time in the month of July of that year on account of of expiration of his term of service, as will appear by the muster rolls of said company that he had a writen discharge, and filed it away with some old papers but thinking it was of no use to him, he neglected it and the same became lost and destroyed and the same is not now in existence.
    He makes this declaration for the purpose of obtaining the Bounty Land to which he may be entitled under the act granting bounty land to certain Officers and Soldiers who have been engaged in the Military Service of the United States, passed September 28, 1850. The number of the Regiment he can not recollect."

    J e Wells, 51 year old Austin nightwatchman who was shot twice late Saturday night near the Patton Transfer warehouse where he worked, died Thursday at 11:55 a m in Brackenridge hospital.
    The only charge that had been filed up until late Thursday was an assault to murder charge against W W Warren, another nighwatchman at the warehouse. That charge was filed earlier in the week.
    Police had said earlier in the week that Wells and Warren got into a fight before the shooting over who was going to move a pile of scrap iron.
    Funeral services for Wells will be conducted Friday at 4 p.m. from the Hyltin Funeral home, with Major R E Baldry of the Salvation army officiating. Burial will be in Memorial park.
    Pallbearers will be Jessie Rawley, Jasper Jones, Walter Groos, Awalt Poehl, Otto Sharpe and Robert Eller.

    Got your request here re the Wells family. So you have them on the 1930 US Census in Travis County as the last record? No other place afterwards? Jean

    I have found in the Austin City Directory for years 1930-31 a listing for Justus E. Wells and Wife, Maude E. living at 2201 1/2 Dam Blvd.. He is listed as a caretaker for the AM Legion Clubrooms.
    (pg. 538 of City Directory). Do you need a copy of this page? 1932-33 Austin Directory has Justus and wife, Maud at same address in 1930-31 and there are listings for Melville C and Louis E. at same address as Justus.

    In 1935 Directory Justus and Maude are listed at 44 1/2 street and he is working for the dairy.
    Louis and Melville are at same address. (Pg. 567)

    Justice E. and Maude E. Wells listed on pg. 683 in 1937 Austin Directory and living now at 1711 Willow Street and he is a dairyman. Lewis resides at his parent's address.
