    He married 31 Oct 1789, Franklin Co., NC to Fereby Bass, daughter of Jacob Bass, Sr.

    1790 - Josiah isn't listed as a head-of-household in North Carolina, but he and Fereby seem to have still been living there, as their daughter Nancy reported on the 1850 census that she was born about 1790 in North Carolina. Josiah and Fereby were probably living with his parents, as Francis Wells Sr. had an extra young man and woman in his household in 1790.

    1800 - Josiah wasn't listed as a head-of-household in Franklin Co., NC, so likely he had already moved his family to Sumner Co., TN along with several of his Bass in-laws.

    1805 Oct - It was Josiah's brother Wyatt who gave bond when Josiah and Fereby's daughter Nancy married Abraham Rutledge in Sumner Co., TN in Oct 1805.

    1806 - By 1806, Josiah was a Captain, probably in the local county militia.

    That Josiah and Fereby had a daughter "Polly" is indicated by someone of that name charging to Josiah's account at the local general store in Gallatin, Sumner Co., TN:

    He was not the Josiah Wells who was granted land in the Georgia land lottery in 1805, as this Josiah was listed on the 1850 census in Georgia.

    1806 - their probable daughter Mariah married in Dec 1806 at or near the home of her grandfather, Frances Wells, Sr., in Muhlenberg Co., KY, to Simon Wall. Simon was also from Sumner Co., TN. Mariah did go by the nickname of Polly, but if she is the Polly who charged to Josiah's account in Sumner Co., TN in May 1807, she either returned to TN after her marriage in Dec 1806 in KY or possibly her marriage first took place in TN and was then later recorded again in KY.

    1809 Mar - Their daughter Cynthia married in Mar 1809, Sumner Co., TN to Samuel Potter with Zacheus Wilson giving bond. This Zacheus Wilson's sister later married Simon Wall's brother, Hugh.

    1808-1810 - Sumner Co., TN - Josiah was sued by William Rentfro:

Judg att having issued in the above suit and levied by the sheriff on a sorrell horse of the defendants, whereupon the said defendant comes into court and with him James Cryer and James McKain and the said Cryer and McKain undertake as special bail for said defendant viz that they will stand to abide and perform the sentence Judgment and drew of the court in the said above cause or surrender the said defendant into our prison in discharge of their bailship wherefor it is considered by this court that the property attached be thereby replevied."

    By 1813, Josiah had moved the family to Clarke Co., Alabama. It's not known when or where Feraby died, but at some point after 1810, he remarried to the widow Frances "Franky" Littlepage. She was daughter of Robert Anderson and married Benjamin Littlepage on 20 Dec 1797 in Campbell Co., VA. Their son Robert Littlepage was born 6 Oct 1808, Muhlenberg Co., KY, where Josiah's parents had settled and whose neighbors they appear to have been. Josiah may have met her on a visit there, or perhaps through friends or relatives. The distance from Gallatin, Sumner Co., TN to Greenville, Muhlenberg Co., KY was only about eighty miles, so visits back and forth wouldn't have been out of the question.

    To the Honourable the Senate and House of Representatives of the United States of America, in Congress Assembled: the humble petition of certain purchasers of public lands east of Pearl River Respectfully Showeth.
    That when your petitioners made purchase of public lands,-they did believe that they purchased them under the simple condition of paying for them in certain instalments, and under the expectation that if they failed to make payment on the day appointed,-they would be liable, as in all similar contracts, to pay the interest on their instalments from the time they became due.
    Experience has sadly convinced your petitioners that the receivers of public monies, insist, on the part of the United States, not only upon the ordinary, simple, legal interest upon instalments not paid on the day,-but on a certain forfeiture or penalty, under the name of "back interest", founded on the principle that on the failure of payment at the period appointed,-the government becomes entitled not only to interest from that time, but to interest from the very day of purchase;-thus raising a charge against the unfortunate purchaser,-not only of simple interest, but in some cases of even double or treble compound interest. Your petitioners can scarcely believe that this was ever the intention of the just and paternal government of the United States:-and they have a firm hope that the statement of the existing evil is alone sufficient to insure a remedy.
    Some of your petitioners had, perhaps, peculiar reason to deem the existing practice a severe one. They had purchased land, before they removed to the territory; and during the state of indian hostility it was impossible for an inhabitant of Georgia or Carolina to reach the land office in St Stephens with the instalment due:-and had they reached it; they would havefound the doors of the office shut, and all kinds of civil business utterly suspended.
    Your petitioners therefore humbly hope that a law will pass for refunding what is called back interest, & forbidding its collection in future: and your petitioners as in duty bound &c

    1816 - Joshua Wells bought land in Clarke Co., AL three times.

    The 1816 Clarke Co., AL (at that time still Mississippi Territory) shows that Josiah still had four sons and a daughter living at home, along with his wife who by this time was probably Frances "Franky." His sons-in-law Abraham Rutledge and James Reed were listed nearby. As Abraham had drowned in the Salitpa River in late 1819, this must have been daughter Nancy Rutledge's household.

    COFFEEVILLE. Interior village and post office in Clarke County, located in Sec. 9, T. 9 N., R. I. W., on the east bank of Tombigbee River, 22 miles west of Grove Hill, and 85 miles north of Mobile. Population: 1912—220. It is on the old stagecoach road from Mobile to Greensboro, where this road crosses the Tombigbee. The town was named for Gen. John Coffee. ln 1808, William Murrell settled here. The first settlers who followed were the Major Thomas Figures, James, Robert, Hugh and Charles Cassity, Nathaniel Malone, Deas and Thornton families. The first preacher was a a Methodist, Rev. Matthew Sturdivant, who preached here in 1808. ln 1816 a Baptist church, was built two miles north of the town, and is in use at this date. Cotton was shipped by barge to Mobile, and on the return trip, these pole-propelled boats went up the river as far as Tuscaloosa. The first cotton gin for this region was built by Josiah Wells. Within a few miles of the village are Turkey and Mitchell Indian Reservations.

    1 & 3 May 1820, Clarke Co., AL court records - Josiah was either the tax collector or more likely putting up money for the bond. Either way, he was doing well financially:

    1st Feb 1821 - Son-in-law Abraham Rutledge's estate appraised by Jesse Summers and William Barron.

    Josiah Well/Wills died 1821 and his estate was recorded 14 Sep 1821. His widow Frances Wells/Wills and widowed daughter Nancy Rutledge were appointed to administer the estate.

    In March 1822, the total of the estate sale was $1630.70, and his son William B. Wells at some point sued the estate.
    There was apparently a will, but it has since been lost.

    Mariah and Simon's marriage ceremony was performed by Charles Lewis, Esq., whose widow Josiah's father Francis Wells Sr. would marry a few years later.

    Mariah used the nickname Polly in many of her legal records in Missouri.

    Cynthia was a then uncommon name that was frequently used in Fereby Bass's family, and the Zacheus Wilson who gave bond for her marriage would shortly afterwards become the brother-in-law of Mariah "Polly" Wells Wall's husband Simon Wall's brother Hugh.

    The Cooper family (including Samuel's parents and most of his siblings) went to Kentucky for a few years before finally settling in Cooper Co., MO. In KY, they lived in Christian Co. just across the river from where Josiah's parents lived in Muhlenberg Co.

    William's house at 108 Ashby Dr., Eutaw, AL is on the National Historical Register as an example of the Greek Revival style of architecture. It was built about 1835 and has been moved from its original location 17 miles northwest of Eutaw.

    NATIONAL REGISTER OF HISTORIC PLACES INVENTORY -- NOMINATION FORM HISTORICAL SUMMARY:
    "Original owner: As specified hertofore, the original owner of the house was William B. Wills. Neither his date nor place of birth is known, but documentation of his arrival in Greene County, Alabama, in 1828 from South Carolina can be verified from the original Land Grants from the Government and from the 1830 Census. Most information concerning Wills is set forth in his nuncupative will, that is, his oral
    will declared at the time of his death before witnesses and which was subsequently reduced to writing. Wills was shot approximately one mile from the house site at the time that he gave his will, being unable to travel back to his home. The circumstances surrounding his death have not been determined. In said will there is a complete accounting
    of his debts and a complete inventory of all his property, real, personal and mixed, with descriptions of same. In this documentation it indicates that Wills was a planter, that he owned 63 slaves, that he had a brick kiln and blacksmith operation on his plantation and that he raised racing quarter horses. Further, the will indicates that he left a widow, Elizabeth M. Wills, who was formerly Elizabeth M. Kilpatrick.
    Although the 1830 Census documents several children of Wills, his particular will file does not have any inclusion concerning same. It may be presumed then, that these children predeceased Wills. After his death in June 20, 1840, his widow, Elizabeth M. Wills, took title to the property.
    Subsequent Owners:
    1. Elizabeth M. Wills (owned the property 1840-1849). Little is known about the widow of William B. Wills. As stated hertofore her maiden name was Kilpatrick and that her parents were William and Mary Kilpatrick and there is some suggestion that she was from Mississippi. At present, the verification of this has not been determined. Elizabeth Wills expired in 1851, failing to have remarried, and leaving no surviving children."
