To all People to whome these Presents shall Com Greeting Know yee that Henry Kerley of the Towne of Marlborough in the County of Middlesex in the province of the Massachusetts Bay in New England yeoman for & in consideration of foure pounds thirteene shillings & four pence good & lawful[ money of New England to me in hand well & truely Delivered & paid by John Barnes Senr of the Towne & County above said yeoman the Receipt Sattisfied & paid Whereof I the said HenryKerly do by these Presents Acknowledge & therewith to be fullySattisfied & paid & therefore thereof & of every part thereof do hereby Acquitt Exonerate and forever Discharge the said John Barnes his heires executors Administrators & asignes for which consideration as atovesaid I the said Henry Kerley with the free Consent of Elizabeth my now married Wife have Granted Bargained sould enfoeffed & confirmed & by these presents for myself Convey & confirme unto him the said John Barnes his heirs executors Administrators & assignes forever about sixty seven acres of Land Lying & being within the Township of Lancaster in the Province above said & is Laid out part of it on the account of the Right & estate of my Late Honred father William Ker- Deceased & the other part of it on the account of the Right of me the said Henry Kerley in said Lancaster about one halfe of it is Laid out for Second Division upland & the other halfe for third Division upland & Lyeth on the south side of a brook called the Great brook neer to said LancasterTowne Line on the South side of the Towne a Litle above where saidTowne Line crosseth said brook part of said Land lying in a pine Plaine betwixt the Land of John Houghtons & Som Land now in Possession of John Booker bounded Southwardly & easterly by said Bookers Land &Northerly by said Houghtons Land over a Little brook & on the edge of a pine plaine till it comes to a Rocky Hill & is bounded northerly by said Hill & partly Rounds the west end of said Bookers Land --- Lyeth up the Said Little Brook taking in som oak Land towards the south end of it & som swampy ground & after this past John Bookers Land it then Lyeth on both sides the Little brook & that south end of it is bounded easterly & southerly by undivided land sd south end buting on or neere to the Towne Line which peice of Land is by estimation sixty acres more or less then being a Little Hill common Rockey upland Lying betwixt Bookers Land & this neer to Bookers northeast corner the other seven Acres Lyeth on the South side of the said John Bookers Land bounding northerly on or neer the same southe--- by the Towne Line easterly & westerly by undivided upland the south Line crossing a Little pond hole a ---fifty Pounds Right & estate on said Lancaster Towne Book with Right accordingly in all affter Divisions --(fold)-- & commonage in said Lancaster all the above bargained sixty seven acres of Land & every part ther of toge-(fold)- the fifty pounds Towne Right with all & singular the Rights privilidges emunities Liber--s profitts (torn) either in upon or belonging to said Land be ther mor or less in (tom fold) him the said John Barnes his heirs executors (hole) & assignes to Have and to Hould and Quietly & peaceably to Possess & enjoy the same in --re Possession & Estate of Inheritance forever & I the said Henry Kerley for me selfe my heires executors Administrators do covenant promiss & Grant with him the said John Barnes his Heirs executors Administratos & assignes that I the said Henry Kerley am at the signing & untill the Dilivery hereof the true Lawfull owner of all & every the said bargained premisses & have in myselfe good Right & Lawfull aut--ride thus to sell & allienate the same as above sais & shall & will at all times warrant & Defend the same free & cleer from all manner of former & other Gifts Grants bargaining sales Leases asignements Judgments excutions forfetures Seiaury mortgages Jointurs Joitails Thirds Dowers & all other acts & encumbrances whatsoever So as the said John Barnes his heirs executors Administrators & asignes shall & may for ever hereafter Have Hould Improve & enjoy lawfully all & every the said Bargained Premisses In--er to -- theire Proper use & behofe without any Lawfell Lett deniall eviction ejection mollestation disturbass or contradiction from or by me the said Henry Kerley or any my my heirs or asignes or from or by any other Person or persons whatsoever Lawfully claiming or having any Right o Title or Interest therin or to any part thereof whereby the said John Barnes his heirs or asigns Shall or may by any me---at any time be mollested in or evicted out of the quiat & peaceable possession of all or any the said bargained premisses & I the said Henry Kerley my heirs & asignes as abovesaid shall & Will at all times Grant signe seale & Deliver any other or former Instrument or Instruments & also perform -- or cause to be don any other or firmer act or acts thing or things that may be necessary for fuller confirmation of all & every the above Bargained premisses & for the true & full Performance of all as above expressed I the said Henry Kerley have here unto put my hand and seal this Twenty Eighth day of march Anno Domini one thousand Seven hundred and five and in the foureth year of the Raigne of our Souveraigne Lady Ann of England the Queen
