1813 Indenture

State of Carolina

This indenture made this first Monday of June in the year of our Lord one thousand eight hundred and thirteen between Benjamin Nabors sheriff of Laurens District in the state aforesaid of the one part and William Fuller of the same place of the other. Whereas Isham Fuller decd of the State and District aforesaid was at the time of his decease seized in fee simple and possessed of a plantation and tract of land containing two hundred and twenty eight acres more or less situate lying and being in the State and District aforesaid on Little River bounded on lands of the Widow Rogers, Isiah Hollingsworth, Daniel Mitchell and the Widow Glenn, and whereas writ of partition issued from the Court of Common Pleas for the District aforesaid aforesaid [sic] directed to certain commissioners to make partition and division of the said tract of land among the legatees of the aforesaid Isham Fuller decd and the commissioners appointed as aforesaid having made return to the court, that the said land could not in justice be divided among the legatees aforesaid, the court then ordered that the sheriff of the District aforesaid should on the first Monday in June 1813 sell the said tract of land on a credit of twelve months to make partition and divide between the legatees of the said Isham Fuller deceased. In obedience to said order of the court to said Benjamin Nabors sheriff aforesaid did on this day expose the aforesaid tract of land for sale on a credit of twelve months and did sell the same land to William Fuller for the sum of five hundred and ten dollars he being at that price the highest and last bidder for the same. Now this indenture witnesseth that the said Benjamin Nabors for and in consideration of the sum of five hundred and ten dollars have granted, bargained, and sold and by these presents do grant bargain and sell unto the said William Fuller the whole right and title of Isham Fuller decd to all that plantation and tract of two hundred and twenty eight acres of land more or less as above mentioned and described together, with all and singular the rights, members, hereditaments and appurtenances thereunto belonging or in any wise incident or appertaining. In witness whereof the said Benjamin Nabors hath hereunto set his hand and seal the day and year first above written

I William Burnside of the Justice of quorum for the District aforesaid do hereby Certify unto all who it may concern that Martha Bonds Fuller the wife of the within named William Fuller did this day appear before me and upon being privately and separately examined before me did declare that she does fully voluntarily and without any compulsion dread or fear of any person or persons whomsoever Renounce release and forever relinquish unto the president and directors of the branch bank of the State of South Carolina at Columbia all her right and claim of power also all her interest and Estate of in or to all and singular the premises within mentioned and released. Given unto my hand and seal this 28th February

Personally came before me Jones Fuller who being sworn in due form saw and on oath saith that he was present and saw Benjamin Nabors sign seal and deliver the within deed to William Fuller and that he also saw Benjamin Garner subscribe his name as witness with himself
