Know all men by these presents that I Thomas Jackson of the County of Carroll of said state for and in consideration of the sum of Five Hundred and Six 75/100 Dollars cash to me in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged, hath granted bargained sold and conveyed, and by these presents doth grant bargain, sell and convey unto Thomas H. Bryans of county first aforesaid all and every of my interest in the estate of my Father, Nathan Jackson and my Mother, Margaret Jackson, both of County first aforesaid (Except my interest in the first sale of my father’s estate which occurred immediately after the death of my father) consisting of property real, personal and mixed; to the extent of the sum aforesaid to wit – Five Hundred and Six 75/100 Dollars, and I hereby for and in consideration of the sum aforesaid empower, authorize and direct the Executors of my father’s and the administrators of my mother’s to turn over and pay to the said Thomas H. Bryans in aggregate, the sum aforesaid as unreservedly as he would pay the same to me, my heirs Exrs or Admrs and I convey the same to wit – my interest, legacies or parts in the said estate to the said Bryans against the claim of myself my heirs and assigns Exrs or Admrs and against the claims of all other persons whatever, to the extent of Five Hundred and Six 75/100 Dollars as aforesaid and I hereby authorize, direct and empower the said Thos H. Bryans to receive  and receipt said administrators and Exrs for the same as fully and particularly as I myself might or could do  were I personally present at the doing of the same. And I the said Thomas Jackson for the consideration aforesaid do hereby pledge, obligate promise and bind myself my heirs Exrs and administrators in the event – that my said interest and legacies or parts of the Estate aforesaid do not amount to the said sum  of Five Hundred and Six 75/100 Dollars with the exception of the sale before excepted to pay the said Thomas H. Bryan the whole or the part of the said amount that may be  required to make the amount in full as aforesaid, Whatsoever said defect may be if any, I promise to pay the sum as fully as if said defect was Specific and named in a promissory note and said note due the 20th of December 1861. The names of “William A Jackson” erased and “Thomas Jackson” interlined before signing. In witness whereof I have hereunto set my hand and seal January 5, 1861.
