Further says he never had any acquaintance with Robert Howey who was said to be the owner of the Land on which Frederick Searle now lives- But witness was well acquainted with Mathew Lowry- who formerly lived on the land where the Defendant in the above cause now lives and says that said Lowry told witness he thinks as much as thirty four years ago that Robert Howey put him on that land and wanted witness to farm the land for said Lowry but offered to purchase the land from said Lowry But Lowry refused and said he could not sell for he had no deed for the land and therefore could not sell it… if he could sell it and have a Deed for it he could ^have twenty Dollars per acre or any how seven pounds per acre for the land but he could give no title and further says that he thinks as much as twelve of fourteen years after this witness was in conversation with said Mathew Lowry and wishing to purchase some lime kiln wood from said Lowry Said Lowry offered to sell witness some (tops?) and oak Wood but said to witness I cannot let you have any living Timber it is not mine only what I make use of for the use of the place the land is not mine and the woods of said Lowry and further says that his said Lowry's right was Sold with the sherif….. his John X Linn mark Sworn and Subscribed The 27th March 1816 Before Wm Kennedy in 1804 at home of James McConnell, Oxford Twp., Sussex Co., New Jersey.5 |

But said Howey three had four Brothers to wit Isaac, Daniel, William, and Jonas. Isaac Howey was the next oldest Brother to the said Robert Howey. The said Isaac Howey had a son called Abraham who came into this country from Ireland with the said Robert Howey, his uncle , which this Deponent has often heard the said Robert Howey ackn -oledge. The said Abraham Howey had two sons, Isaac and Abraham which were twins. Isaac got Drowned at a place called Duck (Dutch?) Creek in Virginney in and the said Abraham is the father of Abraham Howey who is the plaintif in this suit in the above suit and the only son of his father now living. her Sworn and Subscribed Elizabeth X McConnell At the House of James mark McConnell in the town Ship of Oxford in said County on the 26th Day of March 1816(?) Before Wm Kennedy The said Elizabeth in further Examination States that the said Robert Howey was a very Saving close man and she thinks he was Not any in debt and that he was possessed Of a considerable personal property which Mathew Lowrey she thinks made a vendue(?) and soald(?) of as he was the Executor after the Death of the said Robert Howey - and further this Depon(ent?) says not. her Elizabeth X McConnell mark Sworn and subscribed As before stated Before Wm Kennedy Adjournd until 10 a.m. tomorrow morning at same pl(ace?) 27th March 1816(?) Son Abraham 5 pounds. My youngest children, Joseph, Jesse, Mary (now Mary Butts), and Elizabeth Howey, all real estate (about 500 acres). Joseph's present wife, Lydia McConnell (now Lydia Howey) to have no dowry in his share. Wife, Elizabeth, household goods. Grandson Abraham Howey 5 pounds. Executors- wife Elizabeth and John Axford. Jersey of the first part and James McConnell jun. John McConnell and

part- Witnesseth that the said party of the first part for & in consideration
of the sum of four hundred dollars of good and lawful money of the united states
to them in hand paid at and before the ensealing and delivery of these presents
the receipt whereof is hereby acknowledged hath granted bargained
remised and confirmed and by these presents doth grant bargain sell remise release
and confirm unto the said party of the second part in their actual possession
now being and to their heirs and assigns for and during the natural life of the above
named Elizabeth McConnell a certain tract of land situate & lying in and

In the name of God, Amen. I, Joseph Howey, Sen'r of Hardin County and state of Kentucky, being weak and infirm, but of perfect mind and memory, thanks be to Almighty God and calling to mind the uncertainty of life, knowing that it is appointed unto all men once to die, do make this my last Will and Testiment in the following manner viz. I commend my soul to Almighty God, who gave it and my body to the Earth to be buried in a decent and Christian like manner at the discretion of my Executors, hereafter to be named and as to such worldly estate as it hath pleased God to bless me with I will devise and bequeath in the following manner, viz. Just debts are to be fully and legally paid..
I bequeth to my loving wife, Lydia Howey, all my movebel Estate during her life and after her deth it is to bee, if any remains, divided equally among my children to wit; Robert, Elizabeth, Joseph, Margret, Lydia, Moses, Aron & James, and I do hereby constitute and appoint my wife and my son, James Howey executors of this my last will and testement and I do hereby ...them to execute the same and every part thereof according to the true intent mening of the same and I do hereby revoke and make null and void all by me here to fore made ratifing and confirming this and no other as my last will and testiment in witness where of I have set my hand and afixed my seal this 5 day of january, 1821.
