(Witness) Property | 4 April 1808 | Isaac Howey was mentioned as a child and heir at law of Isaac Howey deceased; Davis was the administrator of the estate of Isaac Howey. There was a contract between Isaac Howey and John Howey to sell the property at the time of Isaac's death. John sought relief from the New Jersey state legislature to authorize Davis to fulfill the contract. An Act of the Legislature dated 12 Nov 1807 authorized the sale. The property was 63 acres 2 roods 16 perches on the road from Swedesboro to Oldman's Creek situate in Woolwich, Gloucester Co. Sale was completed on 4 Apr 1808 for one dollar. A further sum of $250 was paid. Part of the land was that sold by Issac Richman, wife Rachel and William Mulford on 13 Sep. 1806. Sale recorded 11 April 1808. Deed also mentions children and heirs at law of Issac Howey deceased. They are Mary Howey, Benjamin Howey, Rebecca Howey, Isaac Howey, Ann Howey, Hope Howey and Martha Howey.5 |

I, William Howey of the Township of Deptford County of Gloucester and State of New Jersey being weak in body but of sound disposing mind & memory; and calling to mind the uncertainty of life, do this fifth day of the eleventh month in the Year of our Lord one thousand eight hundred and twenty two make and ordain this my last Will and Testament as follows, to wit
1. I desire that my Executors herein after named pay all my just debts and funeral charges and that they may be enabled so to do, my Will is that they make sale to the best advantage they can for my whole Estate real and personal; The remainder or residue thereof to be disposed of in the manner as follows viz.
2. To Ann my Wife I devise the whole of the residue or remainder of my Estate after my debts are paid, during her natural life, (?) at her decease my will is that what may then remain shall go to my children viz. Mary Ann Miller, Moses Howey, Abigail Ward, and Rebecca Hewitt Howey to be equally divided among them share and share alike.
3. To my daughter Rebecca Hewitt Howey I give a Bed and Bedding equal in value as near as may be to those heretofore given to my children to be taken out of my Estate before any sale thereof is made.
4. To my other children viz. Joseph Howey, Hope Huston, William Howey & Robert Howey, I give five Dollars each.
5. And lastly I constitute my beloved Wife Ann, my son Moses Howey and William Ward Executors of this my last Will and Testament.

He was then marched to Philadelphia and paroled bound not to serve again. He then lived with a brother in Sussex N.J. Coming to Niagara he received agrant of land of 400 acres at Gainsborough on Lot 9, Conc. 2.Also owned Lot 11 Conc. 2, Caister Twnp. which was willed to Cornelius, Daniel, Elizabeth and family. Petition dated 14 July,1798. Daniel moved to Windham about 1817 taking title to Lot 21 Conc. 12 east of Delhi or Fredericksberg as it was then known. Robert's sons Samuel and Stephen served in the 2nd Regiment, Lincoln Militia 1812-14. Stephen was wounded at the Battle of Chippewa on July 5th, 1814. The 2nd Lincoln Militia was commanded by Lt. Col. Thomas Clark and Lt. Col.Thomas Dickson; Maj. David Secord [Butler's Rangers]; Capt. Charles Askin,Capt.John Burch, James Macklin and Capt. John Rowe[ killed at Chippewa]. Cornelius Howey was sentenced to be hanged, drawn and quartered for the crime of treason at the Ancaster Assizes June 18, 1814 but was pardonned and banished to the U.S. His sympathies lay with the Americans. Robert's will, dated Dec. 12, 1803, gave 100 acres of land to his wife, Jane,Lot 9, 1st Concession in the town of Gainsborough .Further land, Lot 11 in the town of Caister was willed to Cornelius, Daniel, Elizabeth and Anne in equal shares. Lot no. 9; 1st Conc. and half of Lot 9 in the 2nd Conc. in the town of Gainsborough were willed to sons Jonah, John, Stephen,Isaac and Jane.2 |
