Will of Robert Howey
Of Sussex 1782
In the Name of God Amen, I Robert Howey in the Township of Hardwick, County of
Sussex and in the West Division of the Province of New Jersey, being weak of
body but of perfect mind and memory Thanks be to Almighty God, And knowing the
uncertainty of this mortal life do make this my Last Will and Testament,
Imprimis, I resign my soul into the hands of my Heavenly Father that gave it me,
as for my body I do order and request my Executors hereafter named to bury it in
a Christian Like manner, and as it Pleased Almighty God to bestow on me some of
the good things of this life, after my just debts and funeral charges be paid---
Item I give and bequeath unto my well beloved wife Martha Howey all her apparel
and ________?________horse and side saddle and a cow and furniture for a room,
and one half of the remaining part of my moveable estate, Item I give and
bequeath unto my brother Daniel Howey the sum of twenty shillings, Item I give
and bequeath unto my brother William Howey the sum of ten pounds, Item I give
and bequeath unto my nephew, Abraham Howey the sum of five pounds, Item I give
and bequeath unto Joseph Howey (son of my nephew Abraham Howey) the sum of five
pounds,. Item I give and bequeath unto my brother Jonah Howey the sum of five
pounds and suit of white clothes, Item I give and bequeath unto Robert Howey
(the son of my brother Jonah Howey) the sum of five pounds, Item I give and
bequeath unto Robert Howey (the son of my brother William Howey) the sum of ten
pounds and my brown suit of cloths, Item I give and bequeath unto John Lowrey
the sum of ten pounds, Item I give and bequeath unto Matthew Lowrey the sum of
ten pounds and also four acres of bogg meadow that lays in my plantation in
Hardwick, Item I give and bequeath unto Clark Lowrey the sum of ten pounds, Item
I give and bequeath unto Martha Beer (the daughter of William & Mary Beer) the
sum of five pounds, Item I give and bequeath unto my dearly beloved wife Martha
Howey (the use and benefit of the Plantation we now live on as long as she
lives) and after her decease, I give and bequeath the same benefit of said
Plantation unto Martha Beer (the daughter of William and Mary Beer) as long as
she lives, but if she should have any children the said Plantation is to be for
the use and benefit of said children but if she should die without issue then
William Beer the son of William and Mary Beer shall have the benefit of said
Plantation to him and his heirs forever, Item I do constitute and appoint my
trusty friends Thomas Vanhorn Esq. And Matthew Lowrey my Executors to see this
my last Will and Testament be duly executed, and I do revoke and disannul all
other Wills or former Testaments by me made to be void and of no effect and this
only is my last Will and Testament As witness my hand and seal this sixth day of

same and hear him publish pronounce and declare this within writing to be his
last Will and Testament, and that at the hour thereof the said Testator of sound
and deposing mind and memory as far as this deponent knows and as he truly
believes and that George Allen and Andrew Laney the other subscribing ____?___
were present at the same time and signed their names as witnesses to the said

deceased and then the legacies in the said Testament specified so far as the
goods chattels and credits of the said deceased can thereunto extend, and that

perfect Inventory of all and singular the goods chattels and credits of the said

Land purchased by Robert Howe of William Foster, Esq. by deed dated the eleventh day of November, 1773 for four hundred seventy acres and three rods and is part of a larger tract of land that William Foster purchased of the heirs and executors of John Alford, late of the state of Massachusetts, deceased, by deed dated the 22nd of January, 1773 and recorded at the secretary's office in Burlington. This Indenture made the Eleventh Day of November in the year of Lord one thousand seven hundred and seventy three between William Foster of Evesham in the County of Burlington and Western Division of the Province of New Jersey Esqr. of the one part and Robert Howe of Northampton In the County and province aforesaid farmer of the other part Witnesseth that he the said William Foster for and in consideration of the Sum of Seven Hundred and Seventy Pounds Lawfull money of New Jersey aforesaid to him in hand paid by the said Robert Howe at and before the Ensealing or Delivery here of the Receipt whereof the said William Foster doth hereby acknowledge and thereof and of every part and parcill thereof doth fully and clearly acquitt Release and Discharge the said Robert Howe his heirs and Executors adms. forever by these presents; he the said William Foster hath granted bargained solo Released & Conveyed and by these presents doth grant bargain Sell Release and Convey unto the said Robert Howe and to his heirs and assigns forever One Certain Piece parcill and tract of Land Lying and being on the Northeasterly Side of Oldman Creek in the Township of Woolwich in the County of Gloucester and province aforesaid and is bounded as followeth.
Beginning at a hickry Stump by the said Oldmans Creek being Corner to Henry Richman's Land and is bounded thence by the same North Forty five Degrees and Thirty two minutes East Ninty Chains and Seventy five Links to gum tree Corner to said Richman's Land then by said Richman and Benjamin Lippincott's land South-Sixty Degrees East Twenty Seven Chains + Seventy Right links to a post by a hickry in Said Lippincott's Line then by Said Fosters other Land North forty five Degrees and thirty minutes East twenty five chains to a post then North twenty six Degrees and thirty minutes west forty chains to a burnd white oak corner to land of Tenck Francis and company then North sixty one degrees west ten chains and seventy four links to a black oak in said company's line then by said Foster's land south forty six degrees west forty eight chains and fifty links to a post then south twenty two degrees west twenty chains to a gum Standing by the Southwest side of a branch of Oldman's Creek called Avises Run then down by the said run north fifty one degrees West ten chains to a white oak then North fifty five degrees west eight chains and forty five links to a white oak standing in a fork of the said run then down the said run bounded therewith the several courses thereof to the said Oldmans Creek about two chains above the bridge on Salem Road then up the said Oldman's Creek the several courses thereof to the place of beginning containing four hundred and seventy acres and three roads of land or thereabouts to be the same more or less Together with all and every the woods ways waters and water courses and all other the rights Libberties Previledges Hereditaments and appurtenances whatsoever thereunto belonging or many wise appertaining and also all the Estate Right Title Interest property possession claim and demand whatsoever of the said William Foster both in Law and Equity of in or unto the said piece and parcill & tract of land and granted and bargained premises or any part of parcill thereof and the revertions and remainders thereof Which said parcill and tract of land is part of a larger tract of land which the said William Foster purchased of Edmon Towbridge and Richard Cary of the Massachusetts Bay in New England Esq'rs Executors of the Last Will of John Alford of Charlestown in the Massachusetts aforesaid dec'd and others the Lawfull heirs and next of kin to the said John Alford Dec'd by deeds of lease and release bearing date on or about the twenty second day of January 1773 Recorded in the secretarys at Burlington in Book AC of deeds page 450 as by the said deeds may at large appear To Have and to hold all and singular the above said piece parcill and tract of land and granted and bargained premises and every part and parcill thereof according to the abovementioned & described metts and bounds with their and every of their purtenances unto the said Robert Howe his heirs and assigns to the only proper use benefit and behoof of the said Robert Howe his heirs and assigns forever and the said William Foster for himself and his heirs doth covenant grant and agree to and with the said Robert Howe his heirs and assigns by these presents that he the said William Foster and his heirs all the abovesaid piece parcill and tract land and granted and bargained premises and every part thereof with their and every of their appurtenances unto the said Robert Howe his heirs and assigns against him the said William Foster and his heirs and all and every other person and persons Lawfully Claiming or to claim by from or under him them or any of them shall and will warrant and forever defend the same and that he the said William Foster and his heirs shall and will from time to time or at any time or times thereafter at the reasonable request proper cost and charge of the said Robert Howe his heirs and assigns make do execute and acknowledge or cause to be made done executed and acknowledged all such further and other Lawfull and reasonable acts deeds and devises whatsoever for the further better and more perfect assurance and confirmation of all and singular the (inserted) above granted and bargained piece parcill and tract and premises and every part and parcill thereof with their and every of their appurtenances unto the said Robert Howe his heirs and and [sic] assigns forever as by the said Robert Howe his heirs or assigns or his or their councill Learned in the law shall be reasonably devised advised or required in witness whereof the said William Foster and Hannah his wife hath hereunto sett theire hand and seals the Day Year first above writen.

Of Sussex 1782
In the Name of God Amen, I Robert Howey in the Township of Hardwick, County of
Sussex and in the West Division of the Province of New Jersey, being weak of
body but of perfect mind and memory Thanks be to Almighty God, And knowing the
uncertainty of this mortal life do make this my Last Will and Testament,
Imprimis, I resign my soul into the hands of my Heavenly Father that gave it me,
as for my body I do order and request my Executors hereafter named to bury it in
a Christian Like manner, and as it Pleased Almighty God to bestow on me some of
the good things of this life, after my just debts and funeral charges be paid---
Item I give and bequeath unto my well beloved wife Martha Howey all her apparel
and ________?________horse and side saddle and a cow and furniture for a room,
and one half of the remaining part of my moveable estate, Item I give and
bequeath unto my brother Daniel Howey the sum of twenty shillings, Item I give
and bequeath unto my brother William Howey the sum of ten pounds, Item I give
and bequeath unto my nephew, Abraham Howey the sum of five pounds, Item I give
and bequeath unto Joseph Howey (son of my nephew Abraham Howey) the sum of five
pounds,. Item I give and bequeath unto my brother Jonah Howey the sum of five

she lives, but if she should have any children the said Plantation is to be for
the use and benefit of said children but if she should die without issue then
William Beer the son of William and Mary Beer shall have the benefit of said

trusty friends Thomas Vanhorn Esq. And Matthew Lowrey my Executors to see this

will well and truly perform the same by paying for the debts of the said
deceased and then the legacies in the said Testament specified so far as the
goods chattels and credits of the said deceased can thereunto extend, and that
he will make and ___?___ into the Prerogative Office at Burlington a true and
perfect Inventory of all and singular the goods chattels and credits of the said
deceased that have or shall come to his knowledge or ___?___ or into the ___?___
of any other person or persons for his use and render a just and true account

H W Hughes Surrogate. - [S362] Sussex Co. Freeholder Minutes 1753-1863: Vol. 1, page 67. Robt Houey paid militia fine of 18-15-0.
- [S167] Sussex Co., NJ Deed Book: 12 Apr 1804. Indenture. Abraham Howey now of Philadelphia. Robert Howey, uncle of said Abraham Howey, and brother to Abraham Howey hereinafter mentioned died seized of lands. Said Robert Howey died without issue* and without disposing of his lands by his will dated 6 May 1773. The land descended to Abraham Howey, father of the aforesaid Abraham Howey afterwards died intestate**, whereby the lands descended to Abraham Howey, his son and heir-at-law. Land sold , 300 acres, to Charles Croxall for $500. Land bounds Delaware River. *One of our theories was that Robert died without issue since no children were mentioned in his will. This clears this up. ** Abraham did have a will (Sept 1773) but Robert died afterward and left Abraham his land. Abraham therefore, didn't include Robert's land in his will. In the name of God Amen. I John Howey, of Mecklenbourg County and State of N. Carolina, being at present in a weak and low condition of body but a sound and disposing memory, Blessed be God, and calling to mind the mortality of the body,and that it is appointed for all men to die, do make and ordain this my last will and Testament in the manner and form following.First of all I recommend my Soul to God who gave it,and my body to the Earth to be buried in Christianlike and descent manner at the discretion of my Executors herein after mentioned, and as touching such worldly Estate as it hath pleased God to Bless me with in this life, I give and dispose of the same as follows, first of all I will that my just debts and funeral expences be paid and discharged as soon as convenient after my decease. Note | NOTES ON ROBERT HOWEY We believe Robert Howey was born about 1785 in then Delaware (now Lehman) Township. Records indicate that he was the son of Bowdwyn Howey of Delaware Township. In 1815 Robert made a major impact on the fortunes of the Howeys of Delaware Township by regaining the 90+ acre trat that his father, Bowdewin, had lost by sheriff's sale to William Barnet 11 years earlier. Robert paid $300 for the land and we have never discovered how he came by such a sum. Robert died about 1820, leaving a wife, Charity and 5 young sons. He would have been about 35 years old then. We have not discovereed what happened to this family but the records suggest that John Nyce, then Treasurer of Pike county, had a hand in helping them handle the loss. As Treasurrer, he first filed a complaint (1822) against Charity Howey for back taxes of $181.26 on the 90+ acre tract Robert purchased in 1815. He then purchased the 90+ acre tract at Sheriff's sale for the amount of the back taxes. For the next decade he held the title until 1832, when he conveyed it, by assignment, to William and John Howey, brother and cousin of Robert. The following chronolgy depicts the events we have discovered in the short life of Robert Howey, and includes sources for the events described above. 1806 - William Howy, son of Robert & Charity Howy, baptized by Thomas Pomp, Dutch Reformed Minister of Eastern PA New York Gen & Bio. Soc. 1910, pg 97 1810 - Head of Household in Wayne County/ Middle Smithfield Township. Age probably 26-45. 1810 Federal census. 1811 - Jonathan Howy son of Robert & Charity Howy, baptized. LOWER TOWNSHIP - A wanted Villas man attempted to escape through the attic vent in his home but was arrested by a police officer who got stuck with a syringe during the arrest.
It happened on the 200 block of East New York Avenue on Tuesday evening. Police were looking for Robert Howey, 34, who was wanted on a warrant for contempt of court in a drug case in Superior Court. Police said they went to the home and spoke to his wife, Jennifer Howey, 34, who said he was not home. Police said they had seen Robert Howey enter the house.
Police said they discovered Robert Howey in the attic attempting to escape through a vent, and when confronted, he resisted arrest and fell partially through the ceiling.
When an officer patted Robert Howey down, he was stuck with an uncapped syringe. The officer was treated and released at the Cape Regional Medical Center.
Robert Howey was charged with resisting arrest, while Jennifer Howey was charged with hindering apprehension.
