Background is a picture of Caerlaverock Castle taken 1995 by Michelle Leeper on our trip to the Bristish Isles. My husband and I are shown walking towards the castle.

Note: If you find, "They had one child", these words are generated by my genealogical program. There may be more children, but I only entered one. 

Primary documentation used whenever possible and we know my husband's line is correct from James Maxwell on and believe he links to John and Mary Maxwell.

If you have any documented information on John Maxwell Sr. or Jr. and their children (not speculation), I welcome receiving it and will gladly add it to my database.

 

John MAXWELL, Sr.

 

Occupation - From 1740 on a farmer-Augusta, Rockbridge & Botetourt Counties, VA. and a Justice of the Peace in Botetourt County, VA. This does not necessarily indicate that he moved as we know that Botetourt County formed out of Augusta County and Rockbridge County formed out of Botetourt.

 

In ca 1738 Orange County stretched all the way from PA to N. C. and included now West Virginia, part of KY, as well as most of the western portion of Virginia. Augusta County formed out of Orange. So when you search for original records you must go to the county that existed when the record was made, not the county that exists today.

 

We do know that a John Maxwell came to American in ca 1740.  We do not know from documents available if he was married to a Mary, when he arrived or married a Mary _?_ soon afterwards.  His son John Jun. may be the one who was married to a Mary.

 

From the below document we can pretty safely say he had children: Margaret, John Jun'r, Thomas, Mary and Alexander Maxwell all born in Ireland.

Below is the original document from the Orange County Order Books.

It reads "John Maxwell came into court and under oath that he imported himself Margaret John Jun'r {r raised} Thomas Mary & Alex'r {r raised} Maxwell from Ireland to Philadelphia and from thence into this Colony ^ (at his own charge) & that this is the first time of his proving his and their rights in order to obtain land w'ch {ch raised} is ordered to be certified."

Notice he does not indicate that his wife is with him, she may will have been deceased. We presume when we say she is the Mary on the list. Most documents I have seen list husband, wife and then the children in order of age. A John Maxwell with a wife Mary started appearing on the land records ca 1750. The original document I have with her name on it is dated 16 August 1753. Here is the extraction done of one I do not have a copy of the original. 'August 29, 1750 p 42 of book and p 432 of Augusta County Order Book II. "Mary, wife of John Maxwell, relinquished *dower in deed John M.-- to Robt. Breckinridge." ' I am now leaning towards this John being John Jun'r and his being an older teenager or young adult when he came to America. But can not be absolutely sure and no one probably ever will be able to determine that.

*"relinquished dower" simply means that she gave up her right to the property (her legal share) and was allowing it to be sold. Most older land deeds have that in them. It means nothing else.

I do not have a copy of the footnotes showing where baptized, but William's footnote # is for a different place than Edly's and John's.

Note: Edly and William may be brothers of John, Sr.

April 5, 1749 Borden's Road 439 acres to John Maxwell

 

This is from the Beverley Patent 1736 that includes original grantees 1738-1815 in Orange ad Augusta Counties, VA compiled and drawn by J. R. Hiderbrand 1954 ( I have the complete map.)

 

From a book I found in Augusta County page 15 (unknown name)

 

"Augusta County, Virginia, was created in November 1738 from Orange County. Simultaneously, the sister county of Frederick was created in the lower half of the Shenandoah Valley. Until 1770, when Botetourt County, was set off, Augusta County was the largest county in the world--stretching to the Mississippi River on the west and north through the Illinois county and a corner of Wisconsin. although it was a county in 1738, there was no courthouse here in 'Beverley's Mill-place', as Staunton was originally named, until November 1745 when the county was organized. The name Augusta was given to the county in honor of Princess Augusta, mother of George III.

Present day Augusta County is the second largest county in Virginia--exceding in area only Pittsylvania County. Much of the county embraces the boundaries of the Beverly Manor grant obtained by William Beverley of Essex County in 1736. ... Another large land grant which was part of Augusta County was the Borden grant --the land being in the present day Rockbridge and Botetourt counties. ... Two of the oldest Presbyterian churches in Virginia are located in Augusta County --Augusta Stone at Fort Defiance and Tinkling Spring at Fishersville Both were founded in 1740 and both are still flourishing."

By 1755 John owned land on a branch of Cedar Creek, a branch of James River. Note on the map how close to the Natural Bridge area. This appears to be the area the John Maxwell families lived.

It appears one John Maxwell, ends in 1787 on the list when his estate was being settled and we have a second John Maxwell appearing on the list and who seems to be the one who went to Washington County, KY between 1791 and 1800. He appears on the Washington County, KY tax lists in 1800. In Sept 1797 while living in Washington County he sells land in Rockbridge County. ( I have original land record) He may also have had a wife named Mary. He probably is the son of John who died in 1786.

 

Note: Audley Maxwell appears in the tax list in 1787. On September 29, 1796,"William Maxwell of Logan County, Kentucky, power of attorney to his friend, Audley Maxwell, to convey 350 acres of land formerly owned by John Maxwell, Deceased." (We need original as this is one statement that is I believe is misread, maybe even by me.) To me this links Audley Maxwell to John Maxwell who died in 1786.

 

We also know there were sons; James, Thomas and William christened at Tinkling Springs. I can not verify who William is, but the William of Logan County, KY is said to be a friend not a brother od Audley Maxwell.

 

You also have an Alexander now appearing. these all need primary documentation not speculations to link to John Maxwell.

 

Did John Jr. have sons: Audley, Alexander and John besides Thomas, William and James MAXWELL? It is looking to me that way.

Did he also have a daughter who married in the area at about the correct time to be his daughter? Rebecca MAXWELL who was believed born Circa 1755/1758. She married John ANDERSON on 10 Jan 1775 in Botetourt County, VA, by George Skillern. Recorded in book Bontetourt County Marriages 1770-1853 by John Vogt and T. William Kethley, ©1987, page 491

 

John MAXWELL Jr.

 

I believe John Jr. is the one who died in Rockbridge County in 1786 and is probably the father of James below and the father of William, James and Thomas above. Will add more about him later.

You will note he probably could read and write because of there being a bible and two book on the inventory. We do know our line from James Maxwell and it is documented with primary documentation. We feel this is our line but there is no absolute way to document it 100%.

Second Generation

2. James "Great White Chief" MAXWELL Major. Christen 15 Aug 1745 in Old

Craig Parish which included both Stone and Tinkling Spring Meeting Houses,

Augusta County, VA. Lists father as John Maxwell. Died Before 27 Mar 1821 in

Tazewell County, VA.

"The John Maxwell family came from Ulster, Ireland in 1740, to America. (I changed the first

line from James to John) They were of Scots/Irish decent. James and his brother

Thomas came to Tazewell County, VA in 1772. James and Thomas were in

several skirmishes during the revolution (Indian skirmishes) James was big built,

had a powerful voice, straight coarse hair. Was fair complexion with blue eyes,

and considered as a very powerful man. He reared a family during the hostilities

with the Indians. The mothers lived in forts for protection, with their children. He

Settled in Tazewell County, Virginia on Cavitts Creek near Clinch River,

four miles from the Courthouse. He owned a nice farm raised horses, cattle,

sheep and hogs and was considered well to do. His stock ran at large. He

kept four large dane dogs for protection. When he went in search of his

stock, he kept one dog in front and another behind, his gun in his shoulder

and his knife in his hand. He never looked to the right nor to the left, but

looked straight forward. The Indians never molested him, they were deadly

afraid of him, they called him the "Great White Chief" He and his sons

worked hard, clearing the timber from the land, built a large crude log

house and out buildings, had a garden and planted an orchard. Autumn rolled

around and he took his sons and horses to Kings salt works, to get salt to

save his meat and for his stock. While gone some stray Indians passed

through and came to the house in the forest and tomahawked the two little

sisters, Jennie and Mattie. They had gone out into the orchard to feed their

pet lambs. The farm had been an Indian village. The cabin stood south of the

road and opposite the residence of the late Captain James S. Perry. There

were still large mounds of peri-winkle shells the Indians had gotten from

the Creek and Clinch River to use them for soup. adapted & summarized from an

article on page 374 and 375 of Annals of Tazewell County, Virginia Maxwell -

Witten article written June 2, 1918 by Mary Ann Fields.

 

I have attempted to find his marriage record and have failed. A note from

the Rockbridge County, Virginia researcher I hired by the name of Angela M.

Ruley " Marriages were not generally recorded by the Courts prior to 1778. I

seriously doubt you will find a record of this marriage unless someone had

the date from a family Bible along the way....Marriage Licenses were

required to be recorded by the court clerks in 1778 and thereafter." There

is no record of it in Augusta County, Virginia where I think they may have

been married ca 1767.

Augusta County Chancery Court Suit N. S. 45 1807 Maxwell va Pickens

James is orator and it states " ...In 1772 orator went from Botetourt, where

he lived in present Tazewell County..."

He also states that he "...had two daughters murdered by Indians in 1782

upon the land in dispute..."

"..Maj'r Maxwell had two of his daughters destroyed by Indians..." statement

by Samuel Walker

"..Maxwell's daughters.." being murdered by Indians stated by Henry Marrs

also confirmed by Thomas Perry and Christopher Marrs.

In The Name Of God Amen

I James Maxwell of Tazewell County being weak in body but of sound mind and

memory calling into mind the mortality of the body and knowing that it is

appointed for all men once to die I therefore do make and ordain this my

last will and Testament as followeth (to wit)

First I appoint my two sons William and Robert to be my Executors to settle

all my affair and after paying all my Debts to make the following

Distributions.

Itm. First I will and bequest unto Jane my well beloved wife all my personal

Estate to her use while she lives and at her decease it all that remains to

my daughter Mary as to her use as long as she lives and at her decease it

and all that remains to her son Maxwell Commell(?spelling).

Likewise unto my daughter Mary I will and bequest 150 acres of land in the

Back Valley being part of a Survey of 665 Acres at the upper end joining

lines with James Harrison and at her decease to fall to her son Maxwell Campell.

Itm. Unto my four daughter Elizabeth Margaret Jane and Nancy I bequest and

Equal share of one tract of land in the rich mountain containing 250 acres

and likewise an equal share of 515 acres of land in the back valley be the

residue of a tract of 665 acres in which Mary has her share.

Itm. Unto my two sons John and William I bequest one Dollar each they having

received there share before.

Itm. Unto my son James I bequest one dollar having received his share before.

Itm. Unto my son Robert I will and bequeath the land I now live on and a

small tract lying between the tract I live on and James Peerys with all its

appenteuences. My negro man Dan I will to my wife during her life and at her

death I will him to my son Robert.

I now make the above my last will and Testaments and renounce and do away

all other and make ordain and establish this my last will and Testament.

Maxwell decd. was exhibited in Court and duly proved by the Oaths of John

Laird, Thomas Witten and James S. Wittten the subscribing Witnesses there to

and Ordered to be recorded.-&

On the motion of William & Robert Maxwell the Executors named in the within

will who entered into Bond with Thomas Witten & James Perry their securities

in the penalty of $500 conditioned as he Law directs. Probate of the said

Will is granted them in due form.

Tazewell County Deed Book 3 p 256 28 May 1822 "This indenture made this

twenty-eighth day of May in the year of our Lord one thousand and twenty two

between David Whitley and Margaret his wife, Henry Marrs and Elizabeth his

wife, Paul Whitley and Nancy his wife, John Maxwell Junior and Jane his wife

of the one part and Mary Maxwell and *Maxwell Campell of the other part.,

all of the county of Tazewell and commonwealth of Virginia. ....... a

certain tract or parcel of land lying and being in the county of Tazewell on

Maxwell Creek a branch of Clinch River containing five hundred and fifteen

acres being the residue of a tract of 655 acres which was patented by James

Maxwell the 17th. day of Oct 1804....." (It appears these are the daughters

of James Maxwell and relate to the will above .) I quote from the will

"Itm. Unto my four daughter Elizabeth Margaret Jane and Nancy I bequest and

Equal share of one tract of land in the rich mountain containing 250 acres

and likewise an equal share of 515 acres of land in the back valley be the

residue of a tract of 665 acres in which Mary has her share." We clearly

know who the girls married but do not know the spouses of all of the sons.

In 1782 Captain Maxwell was at the head of Clinch River over twenty five

men. He was the group nearest the Washington County line.

at North Tazewell; and he built the stone house in Tazewell County, VA. This

house is still standing.

MECMEHER, 11 Jul 1820 in Tazewell County, VA. Born Circa 1777 in Washington

County, PA. Died Circa 1847/1848 in Logan County, VA (now WVA).

Logan County Deed Book C pages 108 and 460 Heirs of Moses Workman were

listed as Abijah; Elizabeth, wife of Isaac Adkins Jr.; Eleanore, wife of

Stephen Lambert; Moses with wife Polly Mullins; Henry; John; Jane Dalton;

Malinda Perry; and Barbara Dempsey.

23. Samuel W. MARRS. Born 9 May 1788 in VA. Died 7 Dec 1892 in Harmon's

Branch, Harold, Pike Co., KY.

Was in the 1st Regiment, Kentucky Volunteers, War of 1812.

Samuel's father disinherited him over his marriage, so he took his wife and

went to Kentucky to live. He bought a farm which cost him a rifle gun, one

side of cured pork and $50.00 This farm at that time was a wilderness. In

later years, there were large amounts of coal found on the farm, and he

increased his wealth. Summarized from Elaine Marrs Facklam's family group

sheets given Yates Publishing.

 

There is a land record dated the 24th day of September 1831 where a Samuel

Marrs is saying that his father is dead and he is entitled to his share of

his father Henry Marrs' estate. If this Samuel was not estranged from his

family why would he be trying to get his inheritance from the estate? Deed

He married Sarah (Sally) OWEN, daughter of Thomas OWEN Sr. & Mary (Polly)

HENRY, Circa 1814. Born 15 Apr 1796 in VA. Died 2 Aug 1871 in Pike Co., KY.

In 1816 Thomas Owens sold land in Tazewell and moved to Floyd County,

Kentucky. The name of the county changed to Pike. He paid taxes in Tazewell

County until 1814. It is believed that Samuel Marrs and Sarah Owens married

about 1813/14 in Virginia and moved to Kentucky with Sarah's father Thomas

Owens between 1814 and 1816. Some of Samuel's family returned to Tazewell

County.

He married Sarah (Sally) WORKMAN, daughter of Abraham WORKMAN & Margaret

LE(I)TNER (LIGHTNER), 26 Dec 1810 in Jacobs Cove, Tazewell Co., VA. Born 11

May 1789 in Mont. County, VA (now Tazewell County, VA) Died 9 Nov 1879 in

Grundy County, MO.

Sarah (Sally) and James were married by John Peery at Jacob's Cove VA, on 28

Dec. 1810. (taken from pension application papers.) Sally applied for a

pension for War of 1812, which she filed on February 10, 1875. Application

was rejected. She was living in Grundy County, MO with a son when she filed.

Name of son not given. Found with Wesley P. Marrs in Clay Twp. Harrison

County, MO in the 1860 Census. Have not found in 1870 Census yet. Checked

cemetery records in Harrison County, MO, neither there. Since her husband

died in Harrison County, MO, they probably came at the same time as James,

Wesley Price and Thomas Marrs to MO. Nancy Elvira Marrs was suppose to have

been born in Harrison County, MO in 1856. She was Thomas' daughter.

The book Marrs by Mabel Marrs page 15 lists Maxwell Marrs as born in 1787.

The census of 1820, 1830 and 1850 indicate that Maxwell Marrs was born ca

ten years later than the book states. He is listed as 52 in the 1850 Census

of Tazewell County, age 16-26 in the 1820, 30 to 40 in the 1830 Census.

Maxwell started paying personnel property taxes in Tazewell County, VA in

1820.

From Deed Book 3 p182 24th day of April 1821 Summarized: $1.00 to be paid on

the first day of January annually to Henry Marrs for twenty-five acres of

land including dwelling Maxwell Marrs lives in. To be paid annually for the

duration of Henry's natural life is how I read the document. I saw several

of these entries in the land records and in one I believe it stated that he

ran the family mill.

He married Nancy Jane BROOKS, daughter of John BROOKS & Jean (Jane) WHITLEY,

18 Mar 1819 in Tazewell County, VA.
