C.W. Grose Will



In the Office of the Clerk of the County Court of Fayette County, West Virginia:

June 29, 1950

This day there was offered for probate in this office, a paper writing bearing date of the 29th day of March 1950 purporting to be the last Will and Testament of Charles Wesley Grose deceased, who departed this life on the 18 day of June, 1950 and upon which appears the names of R. Millard Boley and Howard Fox, Melvin G. Ramsey, the attesting witnesses thereto.

Thereupon appeared R. Millard Boley and Howard Fox attesting witnesses, and after first being duly sworn, upon their oaths say that the paper writing was signed, sealed, published and declared by the said Charles Wesley Grose as and for his last Will and Testament in the presence of the said R. Millard Boley, Howard Fox and Melvin G. Ramsey who, at his request, and in his presence, and in the presence of one other, all present at the same time, signed their names as attesting witnesses; and there being no objections and exceptions to the probate of said will, and no just grounds for exception appearing to the Clerk, the same is here admitted to probate as and for the last Will and Testament of Charles Wesley Grose, deceased.

And by the terms of said Will, it is provided that Iva Grose Hess be appointed and qualifies as executrix thereof to serve without bond.

Thereupon appeared the said Iva Grose Hess and took the several oaths required by law, and filed her affidavit showing the distributes of said estate, and W. D. Skaggs, Elsworth Backus and Howard Fox are appointed appraisers to appraise said estate, and to make their report to this Court within a period of Sixty Days, as required by law.

Last Will and Testament of Charles Wesley Grose

I, Charles Wesley Grose, a citizen of Fayette County, state of West Virginia, being of sound and disposing mind and memory, and being cognizant of the uncertainties of this life, do make, publish and declare this to be my last will and testament, hereby expressly revoking all prior wills and codicils by me made.

Item I
I direct the payment of all my just debts and funeral expenses.

Item II
To my son Harlie N. Grose and to my daughters, Olive Mary Skaggs, Elsie Brook Backus, Ocie Pearl Ward, and to Cecil Randolph Hendrickson and Paul Hendrickson, grandsons, I give and bequeath absolutely, the sum of one dollar ($1.00) each.

Item III
All the rest, residue and remainder of my estate, both real and personal, howsoever and wheresoever situate, whether now owned by me or hereafter acquired by me, I give, devise and bequeath, absolutely and in ______? simple to my daughter, Iva Grose Hess.

Item IV
I nominate and appoint my daughter Iva Grose Hess executor of my estate and I direct that she be not required to give bond for the faithful performance of her trust.
