Edward Walters' Will was recorded Nov Term 1862.
After all debts and funeral expenses paid, wife Sarah E. Walters to have control of whole estate and manage & cultivate the farm to educate & clothe the children they arrive at age or marry, during her widowhood or natural life. Upon her marriage or death, the whole estate to be divided equally between wife and children. Wife Sarah E. Walters to be Executrix without giving any security. Dated 8 Sept 1862. 27 Mar 1874. N. N. Cox filed a suit against Sarah E. Walters and her sons Laban and Joseph. In 1862, Edward Walters had died leaving his widow Sarah E. and children Laban, Joseph, and Mary Walters who has since married D. M. Slayden. Mary had arrived and full age and was seeking division of the property as stated in the will. Mary had sold her interest and share to Cox. He is demanding the property be divided or sold, by his attorneys, Campbell, McEwan & Bullock.

30 Mar 1874. Answer of defendants Laban Walters and Sarah E. Walters. It was true that Edward Walters, husband of Sarah, died about the time stated (1862). It was true that he had made a will and Sarah qualified as Executrix. Testate left survivors, the wife Sarah E. and children Mary J. Walters (now Slayden) and Laban and Joseph, the last of whom is a minor under age twenty one. Testate died owing a considerable amount of money which Sarah has paid out of her own means. There is a lien of $900 on the estate. These respondents know nothing about the sale of Mary Slayden's interest in her father's estate. Sarah has always been of the opinion she has a life estate in the lands that have been in her possession since her husband's death. The answer was signed R. [Randolph] M. Ewing who was apparently not only the lawyer but served as Guardian ad litum of Joseph Walters who was about age 19 or 20.

Decree was made that it was the testator's intent that the wife was to continue management and control of the estate until her death or remarriage and not to be divided until one or the other occurred. She is still living and is still a widow. The estate is vested in the children but the division is to take place in the future when one of the contingencies happens. The bill to divide the estate is to be dismissed. The defendants appealed to the next term of the Supreme Court.

Edward WALTERS and Sarah E. "Sallie" CROCKETT were married on 28 September 1843 in Williamson County, Tennessee. Sarah E. "Sallie" CROCKETT was born in 1816 in Tennessee. She died in 1894 at the age of 78 in Williamson County, Tennessee.

Laban WALTERS was born in 1847 in Williamson County, Tennessee. He died before 1878 at the age of 31.

There are estate papers in Williamson Co TN for Laban Walters Jr. dated 1878 - a record of inventory and settlement. There are files for Laban Sr. and for Lindsey L. [Laban] Walters which can be accounted for as this man's grandfather and uncle, respectively. The heirs listed were his mother, brother and sister so he never married nor had issue.

Laban was alive in 1874, when there was a lawsuit regarding the estate of his father, Edward Walters.

On 30 Mar 1878, J. R. Carothers, Admr of Laban Walters, filed his report of the Inventory. It was confirmed at the April term of court. The report is dated 22 Mar 1878.

Claim on some parties in West Tennessee for an interest in a mule for which $23 was realized. 1878.
Horse saddle & bridle sold to Jo Walters, 18 Mar 1878, for $60.

Carothers had received the payments on the notes - a total of $1465.75.
Expenses for the estate including a payment for $203 to a doctor and $80 for burial case and expenses for collecting money from West Tennessee, and other amounts, left $911.07 in the estate.

On the 14th of Nov 1878, with Mrs. Pattie Carothers, Executor of James R. Carothers, dec'd, the settlement was examined. $146.71 was still due the estate of Laban Walters, dec'd. E. J. Walters qualified as administrator de bonis non on the estate of Laban Walters and Mrs. Carothers executed a note to him for the balance. All parties were of age and present. Signed: Thos. F. Perkins, Clerk by J. H Crockett, Deputy Clerk.

Summons issued to Mrs. J. R. Carothers (admx) of James R. Carothers, admr of Laban Walters (Dec'd), to appear in court in Franklin on 14 August to render account of the estate of Laban Walters. Signed 8 Aug 1882. There is nothing in the file to indicate any more information about this Summons.

There is a paper in the file of Laban Walters Jr. that should have been filed with Laban Walters Sr. It says "Laban Walters, Inventory, 1854". Lists only three items - one old still, a pair of card, one spining wheel. Signed Edward Watters, who was admin of the older Laban's estate.

E. Joseph WALTERS was born in 1856 in Williamson County, Tennessee.

Joseph is also found in estate papers of his brother as E. J. Walters and Jo Walters - quite possibly he was Joseph Eli, or Eli Joseph Walters.

The only Williamson Co marriage for a Joseph is Joseph Watters to Lucy Tanner, 17 Jan 1878.
