A jury trial is set for Feb. 23, in Drumright district court for a Yale man, according to the Drumright court clerk's office.
Terry L. Napier, 36, has been charged with first-degree manslaughter resulting from a traffic accident in 1985.
According to the complaint filed in 1985, Napier was driving a 1968 Ford pickup east on Highway 51 near Mannford while under the influence of intoxicating liquor April 29, 1985. He then hit another vehicle causing a "violent collisoion" and the death of the passenger in the 2nd vehicle.
Killed in the accident was Heidi Miller, 23, of Stillwater. Driving the 1982 Buick Regal in which Miller was riding was Richard C. Stewert of Jenks.
All three involved in the accident were taken to the Drumright hospital, according to the accident report filed by the Oklahoma Highway Patrol.
Napier was also cited for driving under the influence.
The case was previously tried in the district court, however it was declared a mistrial April 15, 1986, after the court sustained the defendant's motion to mistrial.
A reason for the mistrial was not listed in the Drumright division court clerk's minutes of the trial. Napier's attorney could not be reached for comment.
In related events, an Oilton police officer was killed that night when he was hit by a wrecker from Andy's Wrecker of Mannford.
According to the Oklahoma Highway Patrol, officer James A. Bradley was directing traffic away from the accident when he was hit by the wrecker driven by Bob Goodrich. Goodrich was called to the scene to help with the accident.
The wrecker also hit another vehicle driven by Jerry Roberson, Stillwater, that had pulled over on the shoulder.
Bradley was taken to Drumright where he died, the report said.
Goodrich was also charged with first-degree manslaughter. He died a few months before the case went to trial in what was believed to be a suicide, according to Mannford police.
That area of Highway 51 was blanketed in a heavy fog at the time of both accidents.
