On 16 February 1761, at Northampton County, PA,, There is a very long an complicated deed for the sale of Joseph Albrect's property. I was unable to read it all, but the first page was filmed very clearly and began as follows: "between Katherine Albrecht of Macungay Twp, Northampton Co, widow and relict of Joseph Albrecht deceased and Joseph Albrecht of the same place and Susanna his wife, John Albrecht of the same place and Margaret his wife, Jacob Schner of Whitehall Twp and Barbara his wife and Peter Trexler of Macungay Twp and Katherine his wife of the one part and Peter ?Bultz of Berks Co of the second part. Whereas Joseph Albrecht was deceased intestate having left issue by his said widow Katherine three children with the said Joseph Albrecht, Joseph Albrecht the younger (party hereto) John Albrect and Katherine the wife of the said Peter Trexler and also by a former marriage three children to wit the said Barbara who intermarried with the said Jacob Schner, Margaret who intermarried with a certain Samuel Bert [or Best] of the city of Philadelphia and Mary who intermarried with a certain Richard ." And it is my will and desire that all my real property consisting of my plantation which I do possess and occupy shall be sold after my dec by my executors hereinafter named by way of public vendue to the HIghest and best Bidder and as soon and spedily as circumstances shall permit, and the same shall be paid in three equal payments and in case the same could not be sold in the first year after my dec then the same may be rented out as my Executors after named shall think proper, and as touching all the rest and residue and remainder of my personal estate, of which coin [?] and nature soever the same may be shall likewise be sold by way of Public Vendue. And it is my will and desire the [?] to accrue from sales out of my estate shall be devita as following to wit: I will first and bequeath to the following of my daughters who attended and nursed me and my dear beloved wife deceased in sickness and in health to Maria the wife of Joseph Kostenbather or her heirs the sum of thirty pounds lawful money and to Elizabeth the wife of John Fenstermacher or his heirs the sum of twenty pounds like money be for and besides any of my other children, and then it is my will and desire that the residue and remainder of all the said sales and my estate, after when paid as aforesaid, shall be divided into ten equal and like shares which I dispose of in the following manner to wit. I give and bequeath unto my six sons or their heirs one equal and like share and shares, my son Peter, my son George, my son Jacob, my son John, my son Christopher and my son Martin, and to my four daughters or their heirs one equal and like shares. To my daughter Maria Margaret the wife of Jacob Hahn, Catherine the wife of John Remaly, Elizabeth the wife of John Fenstermacher, and Maria the wife of Joseph Kostenbather, so that my aforesaid six sons and four daughters or their heirs shall be equal and like shares (excepted as first aforesaid is excepted) which said shares is to be paid unto them by my Executors hereinafter named as soon as the said sales have been made and the Monies thereof become due and collected. And I give my Executors hereinafter named full strength and authority to execute sign seal and deliver good deeds of conveyance and lastly I nominate and appoint my aforesaid son Jacob Bender and my son Peter Bender to be the executors of this my last Will and Testament hereby revoking all other wills, legacies, and bequests by me heretofore made, and declaring this and no other to be my last will and Testament. In witness whereof I have hereunto set my hand and seal the twenty ninth day of January in the year of our Lord one thousand eight hundred and twenty. Jacob Bender Seal.
