Was then transferred to the 7th Va Regiment under John L Jennings, served full six months; that she was married under the name Rebecca Swinney to said William Moore on the _________ day in September A.D. 1804 by Benjamin Swinney in Franklin County, VA, there being no legal barrier to such marriage; that her said husband died at Giles Grahams Ashe Co, NC on the twenty-ninth day of December, 1869 and that she has not remarried since his death; that at no time during the late rebellion against the authority of the United States did she or her said husband adhere to the cause of the enemies of the Government, giving them aid or comfort, or exercised the functions of any office whatever under any authority, or pretended authority, in hostility to the United States; the she will support the Constitution of the United States; that she is not in receipt of a pension under any previous act; that she makes this declaration for the purposes of being placed on the pension rolls of the United States, under the provisions of the act approved February 14, 1871, and hereby constitutes and appoints, with full power of substitution and revocation, Agustus J McCarty of Washington, DC her true and lawful attorney to prosecute her claim and obtain the pension certificate that may be issued; that her post office is at North Fork, County of Ashe, State of North Carolina; that her domicile or place of abode is Giles Grahams in sd County and State signed Rebecca Moore her mark attest Jesse Green, Ishmael Graham .1 |

On 30 November 1874, at Ashe County, NC,, The following was recorded in the probate court orders of Ashe County: "Upon the return of the writ of lunacy heretofore issued to the sheriff of Ashe County directing a jury to enquire into the state of mind of Rebecca Moore, and also on the return of the verdict of the said jury, finding the said Rebecca a non ?comper mentis, it is ordered, on motion, that Giles Graham be appointed guardian of the said Rebecca Moore, and that he have the care and custody both of the person and the estate of the said Rebecca Moore, upon his giving bond and approved security in the sum of four hundred dollars. Bond filed, with Eli Graybeal and Jno Perkins his surety. ".8 |

This child exists only in the 1850 census. I wonder if what looks like "Lewis A" or "Louis A" could be the census taker misinterpreting his notes and meaning Louisa. If this child is age 1, that fits with Louisa who is age 12 in the 1860 census (Watauga County). But this person is listed as male. It seems out of pattern for this to be the only child with a middle initial listed in the census. |

I can't find her in the 1850 census. I wonder if she could be "Luticia," who exists nowhere else except the 1850 census. Also there was only one daughter in the 1840 census. I suspect that a neighbor supplied the census taker with information on this family in 1850, because they are all listed as being born in North Carolina, which for Susan and the older children is incorrect. Also I know Jordan's age is wrong, and Isaac's name is listed as Isaiah. |

On 16 July 1885, at Ashe County, NC,, Sarah S. Johnson made a deed of quitclaim to H.R. McMillan administrator of J.B. Johnson (dec) for $100, releasing her interest in one tract on the waters of the South Fork of New River, containing one hundred six and one-half acres. The land was described as beginning on a white oak on the west side of the Rocky Branch corner of J.H. Carson's land and known as the James Dickson corner then north 24 poles to a stake set up and white oak stump then west 76 poles to a stake in the line of an eighty tract of land which formerly belong to Catherine Johnson then with a line of said tract n 25 degrees 60 poles o two lines on the bank of the river then up the river with its several courses..... then leaving the river and for a division line between said parties n 66 degrees 12 poles to a hickory n 42 E 16 poles to a stake between two white oakes N 89 1/2 E 45 1/2 poles to stake set up on a ridge N 76 E 44 poles to the beginning.
I'm not sure why Sophina is only releasing 106 acres. Catherine Johnson owned 200 acres in total, and William and Margaret released their right to 200 acres to James B. I know Sophina was deeded 50 acres as part of James B.'s estate settlement, and here she releases 106 acres, so we're missing any document where she released the other 44 acres. Since the land sold to A.D. Reed didn't given acreage, I'm guessing it's the 44 acres and she must have released it to James B. at some point without a deed being recorded..8 |

Johnson, releasing all rights to a fifty acre tract of land in return for $200. The description of the tract was a follows: "Beginning on a white oak an old corner of Catherine Johnson's land then with her old line north 50 degrees east 97 poles to a double chesnut. Thence north 47 degrees west 23 poles to a chesnut stump. Thence north 26 degrees west 33 poles to a white oak. Thence north 12 degrees west 26 poles to a stake set up as a corner of J.B. Johnson's land. Then with agreed line between J.B. Johnson and Sarah S. Johnson. Thence south 89 degrees west 45.5 poles to two white oaks. Thence south 42 degrees west 16 poles to a hickory thence south 66 degrees west 12 poles to a water oak on the bank of the South Fork of New RIver. Thence south 25 East 16 poles to a dogwood. Thence south 18.5 degrees east 104 poles to the beginning. The deed was witnessed by A.N. McMillan. It was not registered until 1898.
Catherine Johnson had 200 acres in total. Her children William and Margaret had already sold their interest in her lands to their half-brother James. This appears to be the vehicle by which one-fourth of the land was segregated for Sophina..9 |

Codicil as regards my other property my will is after all my just debts are paid off if I have any property remaining that it be evenly divided among all of my children. My theory that Mary may be the daughter of Alexander Smith and Sarah Dickson is based on the following:
I have 2 fairly early sources for the name of James' wife, the Gentry Family in America by Richard Gentry (1909) and Footprints on the Sands of Time by Dr. A.B. Cox (1900). Dr. Cox, who would have known this family personally, gave her name as "Miss Mary Smith," while Richard Gentry, who received his information from an Ashe County Gentry contemporary to himself, listed her as "____ Dixon." I am supposing that both sources are in some way correct, i.e. that she was both a Smith and a Dickson.
Normally, when siblings marry spouses with the same last name, those spouses are closely related. James Gentry's sister Elizabeth married James Smith (per Gentry Family in America). Now that James Smith appears to be the son of David Smith, son of Hugh. (see citation for that relationship.) So it follows that Mary wife of James is likely to be related to David Smith. Now I have only one list of David Smith's children, from the Heritage of Ashe County Vol 1. That list does include a Mary. It is possible that she could have been the widow of a Dickson before marrying James.
However, I also discovered that David's brother Alexander Smith was married to Sarah Dickson, daughter of Thomas Dickson. Between 1807 and 1809, Alexander Smith petitioned the General Assembly of North Carolina for a divorce from his wife, formerly Miss Sarah Dickson, on the grounds that she had deserted the family in 1801. The record stated that the couple had five children, all daughters.
In the 1800 Ashe Co census, Alexander Smith's household was 00001-31210. This corroborates the 5 daughters, although I don't know who the 6th young female would be. Possibly a daughter who died? David Smith's household consisted of 30010-21010. Now in 1810 the Ashe census included only first initials, but neither of the A. Smiths has a family anywhere close to the make-up of Alexander's. However, the D. Smith family is probably David's, except that it has extra girls beyond those that match 1800. 22001-42301. My guess is that Alexander may have moved away and his unmarried dauhters were added to David's family. Since I do not know the source of the list of David's children, I don't know whether it's possible that some of Alexander's children are included in that list.
Thomas Dickson, father of Sarah, the runaway mother, wrote a will in 1813. In it he left $300 to his wife and three of his sons. He also left "to the girl Polly who lives with David Smith ... $25 and to my son John Dickson's two children ... $40 each ; to my son-in-law Alexandria Smith.. $10, and to Peter DIck who married my daughter Nancy ...$10." From the context, I would deduce that "the girl Polly" is a grandchild. Since his daughter Sarah married David's brother, it makes sense that the most logical granddaughter of his to live with David Smith would be a daughter of Alexander and Sarah. It's also possible that she was an illegitimate daughter of one of Thomas' other daughters, but then it makes less sense that she would live with David Smith.5,6,4,7,8,9,10 |
