on the oath of Richard Gammon

This indenture made this thirtieth day of August in the year of our Lord, one thousand, eight hundred and forty-two between James Gammon of River John, in the County of Pictou, yeoman, and Jannet his wife, of the one part and William Langill of River John aforesaid in the County aforesaid, yeoman, of the other part.

Witnesseth that the said James Gammon and Jannet his wife, for and in consideration of the sum of forty pounds of lawful money of the Province of Nova Scotia to them in hand paid by the said William Langill at or before the execution of these presents, the receipt whereof is hereby acknowledged. Have and each of them hath granted, bargained, sold, aliened, released, enfeoffed and confirmed and by these presents do and each of them doth grant, bargain, sell, alien, release, enfeoff and confirm unto the said William Langill, his heirs and assigns forever, a certain lot or parcel of land situate, lying and being on the eastern side of River John in the County aforesaid, abutted and bounded as follows.

That is to say, beginning at the western angle of George Holmes' land in the third division of lots on the eastern side of River John, from thence running south seventy degrees east, thirty-one chains, thence south twenty degrees west thirty-seven chains and fifty links, thence north fifty-five degrees west, thirty-five chains, thence north twenty-seven degrees and thirty minutes east, thirty-two chains and fifty links to the place of beginning. Containing one hundred acres, more or less, with all and singular, the dwellings and improvements, woods, ways, waters, watercourses, casement, hereditaments, privileges and appurtenances thereunto belonging or in any wise appertaining and the revision and revisions, remainder and remainders, yearly and other rents, issues and profits thereof and all the estate right, title, interest, claim, property and demands of him, the said James Gammon, both at law and equity and all the dower or thirds or right or title to dower or thirds of her the said Jannet his wife, in, to or upon the said lot of land and premises above grant or any part thereof.

To have and to hold the said lot of land and all and singular, other these premises, hereby granted and conveyed or mentioned or intended so to be with their and every of their appurtenances unto him the said William Langill, his heirs and assigns to his and their only proper and absolute use, benefit and behoof forever. And the said James Gammon doth hereby for himself, his heirs, executors, administrators and assigns, covenant, promise and agree to and with the said William Langill his heirs, executors, administrators and assigns in manner and form following. That is to say, that at the time of the execution of these presents, he the said James Gammon, it is and stands seized of an absolute state of inheritance in fee simple of and in the said lot of land hereby granted and conveyed or intended so to be, without any conditions or encumbrance whatsoever, and he hath good right, full power and lawful authority to sell and convey the said lot of land in manner and form as the same as hereby sold and conveyed or maintained or intended so to be. Also that he, the said James Gammon and his heirs, the said lot of land and premises above granted to the said William Langill, his heirs and assigns, against the lawful claims and demands of all and any person or persons whomsoever will warrant, maintain and forever defend by these presents.

In witness whereof the parties hereto have to these presents, their names subscribed and seals affixed the day and year first above written.

Received on the day of the date of the foregoing indenture from the herein named William Langill, the sum of forty pounds of lawful money of Nova Scotia, being in full the consideration therein mentioned to be paid by him to me.
